E. WILLIFORD IS INDICTED
Accused of Killing Negro and Making of Liquor

FAIRFIELD, Feb 1 (Sp) - Earl Williford, a white man of a prominent family here,
was indicted by the grand jury of the 87th district court on a charge of murder
of Monroe Higgins, a negro who was found shot to death near Fairfield about a
week ago.  The accused has been held in the County jail here since the day
after discovery of the body of Higgins, and has so far made no effort to secure
bail on the charge.
  An indictment charging manufacturing liquor was also returned against 
Williford, in a report of eleven indictments returned by the Grand Jury divided
as follows:
  One charging murder; three charging manufacturing liquor; four charging hog 
theft; one offense of removing mortgaged property from the state; and one
charging disposal of mortgaged property, and one for driving car while
intoxicated.
  The Grand Jury was finally discharged, and Judge W. R. Boyd signed up the 
minutes closing the January term of the court.

Cleo Fagin, Accused 
of Rum Making,
Freed by Kirby

FAIRFIELD, Feb 18. (UP) - Judge H. Fountain Kirby Tuesday dismissed another of 
the Fagin cases when he sustained a motion of A. B. Geppert, defense attorney
of Teague, for an instructed verdict of acquittal of Cleo Fagin, son of W. J. 
Fagin, in a charge of manufacturing intoxicating liquor.

After a jury had been selected by the state, represented by former County 
Attorney Harold Williford and District Attorney Sam McCorkle, offered 
testimony to show young Fagin was seen about the still for half an hour before
the fatal shooting of Special Ranger Tim Willard, that the still was in 
operation, whiskey running from it, and mash in barrels near by.

Judge Kirby had previously dismissed the charge of murder against young 
Fagin's father.  The elder Fagin had been accused of the killing of Special 
Ranger Willard when rangers raided a still in Freestone county.  He had been 
given a 99 year verdict by one jury and the second trial resulted in a hung jury.
