Knox Co., TN. Robert moved into TN abt 1783, along with his father and
siblings. Robert was born in PA according to the 1850 Knox Co., TN census.
There are about 50 different family names listed in the will and following

The last Will and Testament and Codicil thereto annexed of Robert Smith
deceased was presented to court for probate whereupon Philip D. Bell one of
the subscribing witnesses of said will and Codicil being first duly sworn
deposeth and saith he saw the said Robert Smith sign and seal said instrument
of writing and heard him pronounce publish and declare the same to be his last
Will and Testament and codicil thereto annexed and that he was at the time of
publishing the sane mind and memory to the best in his knowledge and belief,
and J. Buckley the other subscribing witnesses to the same codicil: being
first duly sworn deposeth and saith that he saw codicil his last Will and
testament and heard him pronounced publish and declare the same to be a
codicil to his last Will and Testament and that he was at the time of
publishing the said, of sound mind and memory to the best his knowledge and
belief: which will and codicil thereto annexed were admitted to record, and
are in the words and figures following, to wit:
In the name of God Amen. I, Robert Smith, of Knox county and state of
Tennessee, being weak in body but of perfect mind and memory thanks to God the
giver of all good, calling to mind the mortality of my body and that it is
that it is appointed for all Men once to die, do make and ratify this my last
Will and Testament, hereby revoking all other wills by me at anytime made that
is to say principally and first of all I recommand my soul into the hands of
Almighty God that gave it and my body I recommand to earth from which it came.
Also my worldly property which it has pleased God help me with. I will and
dispose of in the following manner that is after my just debts and funeral
expenses are paid, I will that my wife Anny have my household furniture except
four bed and furniture, one horse her choice, one cow and calf her choice,
four head of sheep her choice, four head of hogs her choice, also that she be
decently maintained out of my other lands or property during her natural life
or widowhood.
Secondly, I will my son George Smith have the Hawkins place where he now lives
and part of the Bowen place north and south of the creek to the partition
fence that he made.
Thirdly, I will my son Adam Smith, have a place where he now lives, Beginning
on William Brown's corner in the creek, thence with Brown's line to William
Hall's corner: thence with Hall's line to old Baldy Knob road, thence to
corner; thence south 30 west to May's corner: thence with May's line to the
corner of the heirs of Joshua Brown deceased: thence with said Brown's line to
the corner William Brown and heirs of Joshua Brown deceased: thence to the
beginning.
Fourthly, I will let my son John R Smith have the place where he now lives
called the Dial place and that he have $100 out of my estate to make him up
equal with the other two of my sons George and Adam.
Fifthly, I will that all my other lands and property that is forced after my
death to be sold to the best advantage that the money to be equally divided
with all my children except Benjamin Manley and his wife Catherine and Joshua
Cole and his wife Elizabeth and David Bowman and his wife Sarah. My will is
each one of them receive 1 dollar as their part of my estate but their
children, my grandchildren received their part to be equally divided amongst
them so that each family of grandchildren receive a sum equal to the balance
of my children out of property or lands sold or each family to receive the
same proportion that their parents would have been entitled to an equal
division of the money arising from the sale my lands and property herein
directed to be sold. I will that the tract of land that I bought at the sale
of the estate of Michael Smith, deceased encumbered with the widow's Bowen be
not sold until said encumbrance is removed, and then to be sold and the money
to be divided as before directed.
I will that all my outstanding debts be collected that can be and be equally
divided among all my children.
Lastly I do nominate and appoint my son John R. Smith and William Brown to be
my executors of my last Will and Testament, confirming that they and no other
to be my will.
In testimony whereof I have hereto set my hand and offered my seal this 26th
day of July 1845

A Codicil to a Will
Whereas, I Robert Smith of Knox county and state of Tennessee, have made my
last Will and testament in writing having date July the 26th 1845 and have
thereby disposed of all my property and effects. Now I do this my writing
which thereby declare to be a Codicil to my said will to be taken as a part
thereof.
I will and direct that my slave Jordan, be emancipated by my executors on the
following conditions. After my death, by the said slave Jordan paying into
the hands of my executors the sum of $300, 100 to be paid the first year after
my death, and $200 the second year, and in case said Jordan, my slave, should
fail to pay all or any part of the said $300 in the time above specified,
thence be hired out by my executors and the proceeds of his hire to be applied
to the payment of the said $300. I will that my slave, Phoebe, be
emancipated by my executors after my death agreeable to law made and provided
in such case.
Lastly, is my desire that my present codicil be amended and made a part to my
last Will and testament to all intents and purposes.
The writing whereof I have hereunto set my hand and seal this first day of
September 1849.

same and we at his request sign our names thereto as attesting witnesses.

The last Will and Testament and codicil hereto amended, of Robert Smith,
deceased having been proved and admitted to record, to which John R. Smith and
William Brown appointed executors, and the said executors thereby mentioned
came into open court and entered into hand with Louis Luttrell and George
Smith their securities in the penal sum of ten thousand dollars. May
conditioned as the law directs, and was duly qualified as such and thereupon
letters of testimony were awarded and issued, which letters are in the words
and figures following to wit.

Whereas at our County Court held for the county of Knox at the courthouse in
Knoxville, on the first Monday of July 1851, it appeared to the court that
Robert Smith late of said county, had died, having first made his last Will
and Testament and Codicil thereto amended, in which John R. Smith and William
Brown are appointed executors and the said will having been proved admitted to
record, and the said John R. Smith and William Brown qualified as executors,
it was ordered that letters Testamentary issue, to, we therefore empower the
said John R. Smith and William Brown to take with their possession, all and
singular the goods and matters, rights and credits to the said testator,
wheresoever the same may be found, and all just debts of said testator, and
all the lega____ specified in said Will, will and truly to pay so far as the
said good, and matters, rights and credits may extend, and all things to
administer said goods, and matters, rights, and credits, according to the
letter of said will and the law of the land.

One final note, the Adam F. Smith is my gg-grandfather, son of Robert Smith.
The A. F. (Azor Freeman) Smith and Adam Smith are relatives, but I have not
been able to establish a link.

NOTE: It is obvious that the will of Robert Smith was contested in Court.
From the looks of the parties involved, the daughters of Robert were not
happy with their inheritance. Robert was a wealthy man. Not only did he
own almost 1000 acres on Beaver Creek, but he at one time owned 5 houses,
one or two of which were brick. Three he left to his sons, and two
additional ones, the brick ones, were sold at auction.
My gg-grandfather, Adam F. Smith, had left Knox County for Marion County
sometime after the 1850 census. He went back to Knox to sell his land in
1860, but continued to live in Marion Co., on Battle Creek until his death
in 1876. He probably left because of the family feud.
