STATE OF NORTH CAROLINA, JULY SESSIONS, 1845
Cabarrus County, NC
Be it remembered that heretofore in a COURT OF PLEAS & QUARTER SESSIONS
began and held for said County Court on the 3rd Monday in July 1845, the
following LAST WILL AND TESTAMENT were produced in open court and offered
for Probate. Present the Worshipful: R. Kirkpatrick, C. A. Miseheimer,
Samuel C. Harris, Samuel Kluts, John Shimpock.
When the last Will & Testament of JOHN REED, SR was produced in opern court
and offered for Probate and the execution thereof was duly viewed by the
oath of Henry E Reed and George Tucker, two of the subscribing witnesses
and ordered to be recorded, and John Reed & George Barnhardt, the Executors
named in the Will qualified and obtained Letters Testamentary which LAST
WILL AND TESTAMENT is in the following words of the maker:
"IN THE NAME OF GOD AMEN, I, John Reed of Cabarrus County being sound and
perfect mind and memory have thought proper this 24th day December to make,
publish and ordain this Last Will and Testament in manner following to wit:
1ST, I give and bequeath to my wife, Sally, my Negro woman, Sally: One
Negro man, woman or girl: her choice amongst all of my Negroes, two cows
and calves, choice eight head of hogs, choice two beds and bedsteads, the
corner cupboard with the furniture therein, her chest, one years provisions,
one pot and dutch oven, frying pan, one table, all the pails, and $200 in
money, and she may have at her decease shall belong to that shall help her
and maintain her, and if she should marry, the aforewith money & property
to revert back after the expenses of her maintenance be paid out of it.
The balance be equally divided among my heirs.
"2ND, It is my will that the plantation whereon I now live and all my other
lands be sold at public venue to the highest bidder after such time as my
executors may think that sufficient time of notice for the sale of my lands
with the Gold Mine shall have been given. My executors may give such credit
and put them in such installments as they may think best making best paymt
to promote the best interest, for this land or may receive cash and allow a
usual discount for interest as they may think best for the interest of my
estate. Also my Negroes not willed and all other property to be sold at
public venue agreeable to law & all money arising from the sale of said
lands, Negroes and other property, with notes, bonds, moneys on hand shall
be equally divided amongst the following heirs, namely, JOHN REED, GEORGE
REED, ELIZABETH MOTLEY, PATSEY (MARTHA) BARNHARDT, the children & heirs of
MY SON CONRAD REED, DECEASED, the children born of the BODY OF MY DAUGHTER
CATHERINE HARTSELL, DECEASED, also the share of FANNY CRATON is to be put
in the hands of GEORGE BARNHARDT AS HER TRUSTEE and be held by him
during her lifetime or till the DEATH OF HER HUSBAND, WILLIAM CREATON:
If she should survive after the death of her husband, the said George
Barnhardt, who I have appointed Trustee of her estate shall pay over to MY
DAUGHTER FANNY CREATON the remaining part in his hands of her estate, but
if she should die before her husband, Wm Creaton owes my estate shall be
deducted out of her share and of the balance, the Trustee may expend
at his discretion for the use of Mrs CREATON as he may think, necessity
and circumstances may require. The share of my DAUGHTER POLLY KISOR, as
I appoint my son, JOHN REED TRUSTEE of the part of my estate, which is to
go to her & the Trustee is to manager her estate in every respect &
particular as prescribed in the above manner herein of FANNY CREATON.
"3RD I appoint as my Executors MY SON JOHN REED AND MY SON IN LAW GEORGE
BARNHARDT of this my last Will & Test. & do hereby authorize my Executors
and privilege them to buy any property belonging to my estate, which may
have been fairly put to sale, and this clause of my Will shall be good
title for the same. In Witness whereof, I the said JOHN REED have here
unto set my hand & affixed my seal.
