                              THE NC CAINS

The earliest Cain in North Carolina seems to be William Cain whose name
showed 1721 on John Spires tax list in Albemarle Co. with 0 poles, 170
acres.  It appears from this record he did not live in Albermarle Co.  He
most likely was in the area of Bertie Co. which was not formed until 1722
from Chowan Co.  There was a deed which showed for him in Chowan
precinct, recorded in Deed Bk. C-1, p.319 #1521:
Henry Sims of Albemarle Co. and his wife Grace to William Caine (no
residence was given) on 16 Sep 1722 for 8 pds, 170 ac on North side of a
branch of Yourah Swamp, part of 360 ac grant to Henry Sims 1 Mar 1719.
Wit. Barnaby McKinne, Robert Sims.  To locate Yourah Swamp, I studied
some deeds to see if its location could be found.  Yourah Swamp (woods,
path, etc.) is spelled various ways in the old records: Urah, Urhah,
Youraw.  It is near Cabin Branch, Pottecasie Creek, William Whitehead
(who was there as early as 1711)  James Parker, William Brasswell (there
by 1714), Quonkey Branch, Catawiskey Pocosin, Morattock (now the Roanoke
River), William and Richard Pace.  See later for deed Bertie 3-474 and F-
190. Map p. C-85  where some of the places named here can be located.
The following deed is revealing:

   Bertie E-378 William Bennett to William Boone 10 May 1738 for 5 pds 100
ac on South side Yourah Swamp and N side Roanoak River adj.  Bennetts
pat. at KAIN'S PATH, part of pat. to William Bennett for 260 ac 4 Aug
1730. Wit. Thomas Bryant, William Taylor.
   N.C. Land Patent #2443, p.222, Pat. Bk. 3. John Oneal 2 Aug 1727, 336 ac
on Morattock River, adj William Cane and the NE side of Fishing Creek.
No county was given here, but most likely within the lines of the then
Bertie Co.
   In the Minutes of the Bertie County Court, p.130 on Aug 1734 is the
notation: John Sellers do lay out a Road from William Kanes to (Maherring
River {crossed out}) the Road ?  Swamp leading to Meherring River and
that James Lases be and is hereby appointed overseer of said Road and all
ye Inhabitants from ye Mouth of  ?  Swamp and Pottycasey Swamp and up ye
Swamp as high as ye Pocoson Branch (then up Pottycasey as high {crossed
out}) do clear and maintain (who work on {crossed out}) ye sd Road.

The words scratched here were scratched in the recorded copy in Bertie
Co.  The spelling Kane is obviously an error as no Kanes showed in this
area.  One who did in another record was also recorded as Cain.

The will of William Cain is in the file of loose wills at the N.C. State
Archives and is dated 3 Mar 1732.  On the side is written: Wm Cains will,
Ltrs granted May 2d 1734 /s/ RG DC. Recorded.  2 May 1734 is the date the
will was proved for probate.  On p.85 of the Minutes of Bertie Co. Court
for 8 May 1733 is the notation:
The Last Will and Testament of William Cain was proved in open court by
oath of Rt. Pace Junr one of the witnesses thereto and at the same time
came Elizh Cain Sole Exrx &c and took the oath of an Execx according to
Law.  BERTIE COUNTY NORTH CAROLINA COURT MINUTES 1724 THROUGH 1739 by
Weynette Parks Haun.  The original Minutes as recorded are not available
to me on film so that the published record is all that is available at

discrepancy here in the date of probate.  Though the date 2 May 1734 is
very plain on the original will, we believe the date 8 May 1733 is
correct, partly because the dates flanking this entry in the Minute Book
are for 1733, but also the widow Elizabeth seems to have remarried before
the inventory was made which was recorded in the Minutes of the Nov.
Court 1734.  Though Elizabeth could have remarried between May 1734 and
Nov. 1734, it seems more likely that the time involved was more than that
and probably the inventory was ordered because of the remarriage. We feel
that William Cain died between 3 March 1732 (date of the will) and May
1733 (date of probate as recorded in the Minutes).

One explanation as to why there is confusion as to dates in the very
early records is that prior to 1752, England used the Julian Calender
which begins the first of each year on March 25th.  It is for this reason
that many times the year is written thus: 1720/21. However, by May there
should have been no confusion because of this. Early records are usually
dark from water stains and dirt and the ink many times faded as well as
words and dates misinterpreted so that one can question any date when
accuracy is desired.  One could even argue that William Cain could have
written his will in the year 1733, then died very shortly after that
within the same year.

See p. C-90 for a xerox copy of the original will.  It reads:

North Carolina.  In the name of God Amen the third day of-March 1732 I
William Cain Senure of Bertie Precint planter being sick and weak in body
but of perfect mind and memory thanks be unto God therefore Calling unto
mind the mortality of my body and knowing that it is appointed for all
men to die, do make and ordain this my last will and Testament, that is
to say, principally and first of all I give and recommend my Soul unto
the hands of God that gave it and my body I recommend to the earth
to be buried in decent ___ Buriall at the Descresion of my Executors not
doubting but at the general Resurrection I shall Receive the same again
by the mighty power of God and as touching such Worldly Estate wherewith
it hath pleased almighty God to bless me in this life I give demise and
Disposse of the same in the following manner and form. Imprimis I give
and bequeath to Elizabeth Cain my Dearly beloved wife my plantation that
I now live upon and half the tract of land belonging to it with all the
___ fixings? ___ and all and singular the____ _____ belonging or in any
way appertaining to have and to hold occupy posses and ___ dureing her
life and after her decease to my son Hardy Cain his heires or afsignes
and by him freely to be possed and Secondly that the Residue of my
personal Estate shall be and ___ unto the proper use and behoof of my
well beloved wife Elizabeth Cain Dureing her life and after her decease
or death. Thirdly It is my will and desire that my son Hardy Cain shall
have my negro boy called Peter and one feat her bed and bed does and two
puter (pewter) deep dishes and two puter basons and one Iron pott after
his mothers death.
Fourthly.  It is my will and Desire that my Daughter Patience Cain should
have one feather bed and bed cloes and three dishes and

mothers death.
Fifthly.  It is my will and Desire that my Daughter Unis Cain should have

Sixthly It is my will and desire that my son William Cain should have a
certain tract or parcel of land and plantation containing two hundred &
ninety acres that I purchased of William Whitehead that my son William
lately lived upon by him freely to be possed and enjoyed and his heirs or
assigns forever.
Seventhly.  It is my will and Desire that my son James Cain should have
the upper part or half of my tract or parcell of land belonging to my
dwelling plantation that Joyned to the plantation where my son James Cain
now lives upon by him freely to be possed and enjoyed and his heirs or
assigns forever.
Eightly.  It is my will and Desire that my Daughter Sary Cain should have
my negro wench called Cate and her Increase and five cows and calves and
three small puter dishes and two puter basons after her mothers death or
Decease.
Ninethly.  It is my will and Desire that my Daughter Rachell Cain should
have five cows and calves and three puter Dishes and two puter basons
after her mothers Death or Decease.
Lastly.  It is my will and Desire that the Remainer of my estate that is
left or can be found after these legases aforementioned is paid of should
equally Devided amoungst all my children after my wife Death or Decease.
I will and ordaine my well beloved wife Elizabeth Cain Exor of this my
last will and Testament hereby Removing and Disannulling all other former
wills and Testaments heretofore by me maid touching or concerning any of

On p.137 of the Nov. 1734 Minutes of the County Court is recorded:
The Inventory of the Estate of Wm. Kane was duly proved by ye oath of
Elizh Drake Exrs? &c.

Though the recorded Court Minutes are not here, the book Inventories of
Estates 1726-1744 is on film here (#18,209).  See p. C-92 for xerox of
this record.  The copy is very dark with much bleeding through of the
page from the back side.  It is on p. 49 and 50 and, as was the custom
here, no date shows, and the signature with no notation as to being exrx.
It was the custom later for the exr. to sign the Inventories and also at
least three appraisors, and so it is logical to believe the Elizabeth
Drake who signed the inventory of William Cain was the widow and exrx of
the will of William Cain.

Court of Bertie Co. Minutes 7 Feb 1736 (p.201) Read the petition of
William Cain and Robert Clary.  Ordered that Joseph Regan be sum'd to
appear to shew cause why he Detains the said Legacys.

It seems from this record that Elizabeth Drake was dead.  No record of
why Joseph Regan was serving as administrator. He and Robert Clary could
have married daughters of William Cain Senr.

Of interest also is that one genealogist claimed that James   (d. 1761)
had a dau Elizabeth who married Richard Pace.  The following is of record
in Bertie Co. Court Minute Book: p.85 Will of Wm. Cain was proved by the
oath of Rt. Pace Junr and Elizh Cain sole Exx took oath 8 May 1733.  On
p.116 14 May 1734 Richard Pace Junr ackn. a deed to James Cain. See later
for abstract of this deed. p.151 Rd. Pace Junr to Rd.  Pace Senr.  pd
jurat James Cane 40 pds. (This was the court paying James Cane for
services he had performed to the court, in this case for serving on the
jury.)  I have made no study of the Pace family tho' much has been
published on this family. Apparently, the Pace record is a later one than
the above.

No record was found as to who Elizabeth Cain, the widow, married.
William Drake's wife in 1726 was Rebekah Bracewell.  Thomas Drake 1725,
1733/34, 1739 lived on the north side of Pottecasi Creek. Aaron Drake was
on Meherrin (Roanoke) River.

      Note that the probate for both William and James Cain was in June
      1761.  William's children were adults except one minor son; James'
      children were all minors.

One study claims William (d.1732) was born c. 1639, of Bertie Precinct;
his wife Elizabeth b c. 1643.  Hardy b c.1665; William c.1667, James
c.1669; Patience c.1671; Unis c.1673; Sary c.1674; Rachel c.1676. These
dates seem much too early.  If these children were with their parents by
1722 in N.C., they too should have been playing a prominent role in the
records at this early time. As there was no deed before 1733 of William
(Senr) and William (Junr), it cannot be ruled out that some of the
William Cain deeds were not for the son. However, if two adults within a
county had the same name, it was the custom to designate them Jr. and Sr.
There was no Hardy Cain deed before 1740, James Cain showed 1730, 1737,
then more frequently in the 1740s.  It cannot be ruled out that there was
an early James Cain there who was not son of William, but it is
significant, I believe, that no son of William (d.1732) was ever
administrator of his estate. Even after his widow had apparently died,
the Cain men were not administrators.  In 1736 when the legacies were
requested to be paid, I believe, it can be assumed that the sons of
William (d.1732) were, if not all over 21, then the youngest almost 21.
This then would make William's family born beginning in the early 1700s.

One of the most common errors in genealogy is that of skipping
generations. For this reason, it is important to work out approximate
dates.

Before the Revolution, very few who wished to get married, obtained a
license.  They could marry by having "banns" published or announced from
the pulpit.  The records kept by the churches have not survived to today.
Even those of the Quaker Church, who kept very good records and many, of
which, exist today, are missing from the backwoods of N.C.  where our
earliest Cains were.  One wonders if they were members of the Cane Creek
Monthly Meeting

whose surviving records begin around 1800.  It is mainly for this reason
that very little can be determined for the daughters of our earliest
Cains and much detail of our men are missing.

It is believed that Hardy Cain of MS is a descendant of William Cain, the
eldest son of William who d.1732.  For that reason, he will be discussed
last in this compilation.

Hardy Cain, son of William and Elizabeth Cain of Bertie Co., N.C., was
left a slave Peter by his father.  Note in Hardy Cain's will, he names a
slave Peter. His will is found among the loose papers at the North
Carolina State Archives and reads:

In the Name of God Amen the twenty first day of December in the year of
our Lord one Thousand--Seven hundred and Fifty four I Hardy Cain of
Edgecombe County being very sick and weak in body but of perfect mind and
Memory Thanks be given to God therefore calling to mind the mortality of
my body and knowing that it is appointed for all men once to dye do make
and ordain this my last will and Testament that is to say principly and
first of all I give and Recommend my Soul into the hand of God that gave
it and for my body I Recommend it to the Earth to be buryed in a
Christian like and decent manner at the discretion of my Executors
nothing Doubting but at the general Resurection I shall Receive the same
again by the Mighty power of God and as touching such worldly Estate
wherewith it hath pleased God to Bless me in this Life I give Devise and
Dispose of the same in the following Manner and form
Imprimis I give and Bequeath unto my well beloved Daughter Isabell Cain
the Plantation whereon I now Live with one Hundred and fifty acres of
land thereunto adjoining to be fully possessd with the same at the ___ of
her Mother and in case her Mother should not marry then to be possesd
with said Legacy at the age of Eighteen years.
Item I give and bequeath an Entry of land which I have in Johnson County
to be Equally Devided between my Daughter Peurity and the child my wife
now goes with if it is born alive and lives to posses the same and in
case it should not live and possess the sd Legacy as aforesaid then to be
divided between my Daughter Peurity aforesaid and my Daughter Sarah to be
possesed with the said Legacy at the age of Eighteen years.
Item I give and bequeath to my well beloved Daughter Sarah Cain one Negro
man named Peter and to be possessed with the property of the said Negro
at the age of Eighteen years and untill that time I devise the work of
the sd slave to my wife for the benefit of Raseing my children.
Item I give and Devise to my wife Rachel Cain for the Bennifit of Raseing
my children and paying my Just Debts all my Cattle and all my hoggs and
Likewise all my household goods to be fully Injoyed by her for the uses
aforesaid and likewise all my horse kind I likewise constitute make and
ordain my well beloved wife Rachel Cain and my loving Brother James Cain
my only and Sole Executors of this my last will and Testament and I do
hereby uterly disallow Revoke and disanul all and Every other former
Testment wills legacies and Executors by me in any ways before this time
named willd and bequeathed Ratifying and confirming this and no other to
be my last will and Testament In Witnes whereof I have here unto

James Cain left numerous records.  His will was dated 3 Mch 1761,
recorded in Edgecombe Co. June 1761 in Edg. Will Bk. A, p.70 and reads:

In the name of God Amen in the 23d day of March in the year of our Lord
1761 I James Cain of the county of Edgecomb being very sick and weak in
body but of Perfect Mind & Memory Thanks be given to God therefore
calling to mind the Mortality of my Body and knowing it is appointed for
all men once to die Do make and ordain this my Last Well & Testament that
is to say Principally & first of all I Recommend my Soul into the Hands
of God that gave it and for my Body I Recomment it to the Earth to be
Buried in a Christian Like Manner at the Descretion of my Exors Nothing
Doubting but at the general Refurection I shall Receive the same again by
the Mighty Power of God and as touching such wordly Estate wherewith it
hath been Pleased God to Blefs me with in this Life I give Divide and

His son Hardy did not live long enough to marry and raise a family. He
left all to his brother James. His will is dated 12 Apr 1774, recorded
July 1774 in Edg. Will Bk. A, p.224 and reads:

In the Grace of God Amen.
I Hardy Cain of Edgecombe County being very Sick and weak, but of Perfect
Memory do make and Ordain this to be my Last will and Teftament in Manner
& form following viz -
First. I give my Land to my Brother James Cain to him & his Heirs
forever.

As seen above, William (will 1733) had sons Hardy (will 1754) and James
(will 1761).  This Hardy (will 1754) had only daughters. James (Will
1761) had sons James (d.1795) and Hardy (d.1761), but this Hardy died
unmarried.  James (d.1795) had sons James and Hardy.  This Hardy was
younger than our Hardy of MS and he was still in the Edg./Nash area after
1810.  None of these Hardy Cains was the Hardy who. died 1813 in MS.

Many of the records are given below with no attempt on my part to further
identify them as probably a descendant of these lines should do this.

Being in good health & Perfect mind & memory Thanks be to God for it
therefore calling unto mind the mortality of my Body and knowing that it
is appointed for all men once to Dye do make & ordain this my laft will &
Testament that is to say Principaly and firft of all I give & Recommend
my Sole unto the Hands of God that gave it & for my Body I Recommend it
to the Earth to be Buried in a Chriftion Like Manner at the Defcretion of

Note by ME: Not included in this study are the Cain records of Bladen
Co., N.C.  Revolutionary War pension file W3510 of John Cain (wife
Susannah Henley)  stated John was resident of Union Co., S.C. at time of
his enlistment, was b c.1761 in N.C., that he fought in the place of his
father who was opposed to War.  This family moved to Ohio 1808, to Wayne
Co., Indiana 1817.  Other records in the file show the father was
Jonathan Cain who came from England. There was an early Jonathan Cain in
Bladen Co., N.C.

There are few service or pension Revolutionary War records for Cains of
N.C. which makes one believe they were active Quakers at the time of the
Revolution.

There is a will for Epaphradatus Moore of Bertie Co. recorded in the
loose wills at the N.C. State Archives, dated 11 June 1757, proved Oct
Court 1757 in which he named the following:  wife Elizabeth; dau Mary
Moore, dau Ann Moore; dau Grace Moore; grand son Elisha Wilson; Thomas
Moore son of my dau Ann Moore; dau Judith Hunt; son John Moore; son in
law James Haward; dau Rebekah Cain; dau Charity Walston; granddau Rachell
Walston; dau Rachel Standly;  dau Christian Moore; dau Penelope Hare;
exrs daus Mary and Ann. Wit. Charles Home, Demcy Holland, Lewis Perry.
There was a caveat against the probate of the "protended will supposed to
be made by Eppaphradatus Moore".  I do not know who his dau Rebecca
married, but it could be significant that an Edward Moore was prominent
in the family of James Cain in Edgecombe.

James Braswell names a daughter Sarah Cane in his will with no indication
of the name of her husband.  At one time I felt she could be the wife of
our William Cain because the witnesses of the will were Ruffins which
tend to link Sarah more closely to William Cain.  The will is dated 27
Sep 1760, recorded Jan 1761/2 in Edgecombe Will Bk. A-142 and reads:.
In the name of God Amen, I James Braswell of Edgecombe Co. Being in good
Health and of Sound mind & memory for Preventing Disputes in my Family
about the Estate I may leave at my Death do make this my last will and
Testament as followeth.
Item I give and Bequeath unto my son Joseph Braswell one feather bed &
Furniture which is now in his posefsion to him and his heirs forever.
Item. I give & Bequeath unto my Son James Braswell one Feather Bed and
furniture which is now in his Pofsefsion to him & his Heirs forever.

Harrell: Will of Thomas Harrell 24 Apr 1763/July Court 1763 Edg Co. names
wife Rebecca, plantation on north side Ronoak River in Bertee Co. to be
sold to educated 4 youngest children; sons Simon, Edmond (land on north
side of Tarr River); daus Seale Harrel, Elvey, Barbery Cain, Elizabeth
Bryant and Sabra Bony. Exr William Bryant,  Jonathan Cane (Caine) Wit.
Charles Evans, Thomas Bellcher, Solomon Nettles.  Thomas Harrel will was
proved by Thomas Belcher,- exrs refused and the widow Rebecca qualified
July court 1763.  Exrs of the will William Bryant and Jonathan Cane
qualified Oct Court 1763. Jan Court min. 1764. Orphan Elva Harrel chose
John Skinner as gdn Apr Ct. 1764.  Rebecca Skinner late widow of Thomas
Harrel apptd gdn to Simon, Edmund & Celia Harrel orphans of Thomas Harel
Apr Court 1764.  This proves the widow Rebecca Harrell had married ___
Skinner by Apr. 1764.

The minutes of the Edg County Court reveals the following:

William Cain (Bertie Precinct will 1733) named in his will a son William
and devised to him 290 acres purchased of William Whitehead. William Cain
had purchased this land on 6 Nov. 1726 which was part of a patent of 490
acres 16 Aug 1720 to Whitehead and adjoined the lands of Thomas Bryant,
sd Whitehead and William Bennett (Bertie Deed B-198, p C5 this
compilation).  The early drawings of the land patents are not available
to me but the descriptions of the patents have been published by
Margaret M. Hofmann and these were examined so as to possibly get a
better description of this land, but none was found for William Whitehead
for 16 Aug 1720.  Either he purchased this tract which would show only in
the deed records, or the record of the patent was lost, or possibly the
date of the patent was recorded incorrectly. William Whitehead had many
patents for land and among them are found:

   Edgecombe Deed 1-243 shows William Cane, the eldest son of William Cane
had inherited his land and sold it to Capt. Thomas Bryant on 26 Aug 1737
who on 10 May 1738 was then selling it to John ONeal for 640 ac described
as on the fork between Fishing Creek and Deep Creek on the north side
Tarr River.  See p.C-85 and p.C-87 for maps showing the locations of
Urahaw Swamp and also Fishing Creek and Deep Creek.  It appears to me
William Cain's land on Fishing Creek could be in present day Halifax Co.
in the extreme SE corner.
   Edgecombe Co. was formed from Bertie 1741 and our Cains seem to be in
Edgecombe then.  Halifax was formed 1758 from Edgecombe and because the
town of Halifax then fell in Halifax County along with the old court
house, all the early Edgecombe deed books remained in Halifax and are
today known as Halifax deed books.  But the Halifax deeds made and
recorded before Halifax Co. was formed are Edgecombe Co. deeds and are
thus designated in this compilation, though anyone wishing to check the
original deed must check the Halifax deed books.


There were other early William Cains in N.C. and these are briefly
examined here.

A will for William Cain shows in Halifax Co. Book on p.88, dated 1 May
1762, proved Sept Court 1762.  He names daughter Priscilla Drew and her
children Mildred and Jesse Drew; wife Rebecca, residual to my wife and
Jesse Drew. Wit. Joshua Bell, Richard Wills, Thomas Kent.  Exr Jesse
Drew.  If for no other reason, he could not be our ancestor because
he had no son.

Orange Co. was formed 1752, largely from Granville, partly from Bladen
and Johnston Counties.  Chatham Co. was formed from Orange Co. in 1771.
A William Cain will was recorded 1834 which is too late to be son of
William who died 1733.  The Orange Co. records will be examined more
fully below.

Patent records show there was a William Cain in Bladen Co., N.C. by Nov.
1738.  Bladen Co. has not been included in my study.

A William Cane left a will in Edgecombe Co. which I believe is the
William who was son of William (will 1733).  It is dated 13 Aug 1757,
proved June Court 1761, recorded in Edgecombe Will Bk. A-59.  See p.C-
102 for a xerox of the loose will. As you can see an edge of the paper
here has either crumbed away or has been torn so that the names of two
sons have been lost.  It reads.

In the name of God Amen the 13 day of August 1757 I William Cane of
Edgecombe County and Province of North Carolina being of Sound & Perfect
___ thanks be given unto God therefore Calling in Mind the Mortality of
my ___ and knowing that it is appointed for all men once to Die Do make &
ordain this my last will & Testament that is to say principally & first
of all I give & Recommend my Soul into the Hands of God that gave it and
for my Body I Recoment it to the Earth to be Buried in a Christian
Decent Manner at the Discretion of my Exrs nothing Doubting but at the
general Resurection I Shall Receive the Same again by the Mighty Power
and as touching my wordly goods I give & Bequeath and Dispose of the same
in manner following
I give & Bequeath unto my beloved son [crumbled away] Cane all my Cattle
on the South Side of New [crumbled away]
I give & Bequeath unto my living son a [crumbled away]  Cane my
Plantation whereon I now live [crumbled]  & half the Land Belonging with
