Spencer Co. Will Book C p. 302
In the name of God Amen, I Isaac MILLER of the County of Spencer and State of 
Kentucky, being of sound mind and disposing memory and knowing that it is 
appointed by the Almighty God for all men to die,  do make, ordain and publish, 
This as my last will and Testament in reference to the worldly things which it 
has pleased divine Providence to bestow upon me and naming  f--- as follows, 
viz:

Item: My will and desire is that my dearly beloved wife Ann MILLER shall retain 
in her possession all my landed estate, consisting of the home tract of 403 
acres also 80 acres known as the woodland tract on Sycamore Run in Spencer 
County also 68 acres of land being her possession of the tract inherited  from 
the Estate of Thomas MONTGOMERY Jr. (Dec’d) also all my servants to be kept by 
her, stock and farming utensils of every description so as to have no sale this 
to be so constrained so as to make her my sole heir under her administration as 
herein after mentioned.

Item:  I further will and desire that if my beloved wife should Conclude to 
Marry before my two little sons namely John Thomas and Benjamin MILLER shall 
arrive to the age of Twenty one years that the will take one third of the Whole 
estate and set apart the two thirds for the use and benefit of my two sons as 
named above and I further Will and desire that she should make a like Division 
to them when they shall arrive at the age of twenty one ordaining herself one 
third as in the case of her Second Marriage.

3rd Item My will and desire is if any of my Servants consisting of nine in 
numbers at this time should become disobedient or unsatisfactory that my said 
wife shall bear the power and authority without any special act or interference 
to make sale or transfer of them so as to rid her of further Annoyance by them 
her authority being equal to my own.

4th Item:  My will and desire is that my Niece Margaret CONWAY have my young 
sorrel horse called Tim and that my Two nieces (viz) Elizabeth and Margaret 
CONWAY to remain with my wife so long as it may be agreeable so to do and 
whenever they shall see proper to marry, my wife to have the discretion to give 
them such outfits as she may deem proper.

5th Item  I hereby nominate my beloved wife Ann MILLER and my nephew Thomas 
MILLER to be my executors of this my last will and Testament requiring them to 
pay all my past debts so soon as the means to do so can be had.

In Testimony whereof I set my had this 26th day of July 1850.

Executed in the presence of Alfred BODINE and Edrington WELLS.
