Application to set apart Est of James Webb for benefit of family 

Now comes John T Mathis  ____ if Jas Webb dec’d and objects to the application 
of Hannah Webb for the appointment of appraisers to set apart Est for benefit 
if the widow and child.
1st Because James Webb in his lifetime made application for and has set apart 
all his property both real and personal under the home stead executive laws of 
the State for the benefit of wife Hannah Webb Marion child Georgia Ann which 
said home stead is still of record has not been set aside.
2nd Because Hannah Webb applicant & minor child Georgia Ann have been in the

Whereas application has been made to the ordinary of said county by Mrs Emma 
Chalkly for herself and children she being the widow of G O Chalkly late of 
said county decd for the support and maintenance of herself and six minor 
children of said deceased for term of twelve months out of the estate of said 
decd. Now know ye by these pursuits that you or any three or more of you whose 
names are hence above written or hereby authorized and appointed to attend and 
set apart and assess the sum necessary for the support and maintenance of the 
family aforesaid out of the estate of said G O Chalkly deceased as may be 
seceded by you for their support and maintenance for the term of twelve months 
immediately succeeding the death of the deceased either in money or such other 
property as may be selected by said widow as a fair valuation together with so

years support out of her husband H M Clark

And that on said application your honor issued a warrant to four discreet 
appraisers as required by law to set apart and assign to her & her five minor 
children of said H.M. Clark a years support & that on Dec 17th 1898 said 
appraisers or three of them took oath before one of them swearing to execute 
said warrant.

 And that on said Dec 17th 1898 said three appraisers did set apart and assign 
petitioner & her minor children personal property in value according to said 
appraisers estimation to the amt of one hundred& seventy five dollars and 
54/100 dollars that was all they do so set apart & assign

And that at the Febry Term 1899 of your Hon Court your honor made said return 
of the appraisers the judgement of the court all of shich proceedings 
hereinfore mentioned on of file in your office

Petitioner brings this her petition to set aside said judgement & proceedings 
for the following reason. That no oath was administered to said appraisers to 
execute said warrant of appraisement & no affidavit was by them made before any 
one authorized to administer said oath or witness the affidavit

That her said husband H.M. Clark did having as an estate not only said 
previously described in the return by also 101 ¼ acres more or less of land 
being the East half of lot No 107 in the 5th district of Chattahoochee County 
said State worth now & at date of the said appraisement not exceeding the sum 
of two dollars per acre

7th 
And that said appraisers were not advised and did not know at the time of said 
appraisement that said land was part of the estate of oetitioners husband and 
that is the reason why they did not make return thereof as required by law as 
the value of said land & property does not exceed in value the sum of Five 
hundred dollars

8th 
She shows further that she was not present at the Court at the Febry Term 1899 
when said return was made the judgement of said Court & had no representation 
present & she was not advised & did not know that they made no return of said 
land till months subsequent to said judgement . Neither did she take part in 
the appraisement

either in money or such property as the widow may select do report that we have 
assessed and set apart as being necessary for the support and maintenance of 
said widow and children the sum of $300 three hundred dollars in money which 
the said widow has selected to take as follows. We the undersigned find 150 
acres of land valued at $150.00 (100 acres off lot No 27 in 11 dist and 50acres 
off south east corner Lot 112 in 11 dist) corn crop 60 bus 30.00, fodder 400 
lbs 2.00, cotton valued at 70.00 (3000 lbs seed cotton) cane valued at 8.00, 
live stock two cows and calves valued at 24.00, 5 head of hogs valued at 20.00. 
one mule valued at 15.00, farm tools 2.00, and we also set apart the following 
household furniture for the use of said widow and children three bed steds and 
three mattresses, two feather beds, 4 pillows, 15 quilts, one set of chairs, 
one table, one set of plates, one set of cups and saucers, one dining table, 
one clock, two trunks

money or property as the said widow may select do report that we have assessed 
and set apart as being necessary for the support and maintenance of said widow 
which the said widow has selected to take as follows the real estate belonging 
to said A.C. Adkins as set as below. A certain house and lot in the town of 
Buena Vista Ga No 61 in Block A of said town 25 ft front on the public sqr and 
running back 105 ft further containing 1/5 of an acre more or less. Bounded as 
follows on the east by public square – on the north by Mrs T W Bullock – South 
by J S Rogers & C H McCall.
Also a section vacant lot in said town being a part of lot No 3 containing 2/3 
of an acre more of less bounded as follows North by E B Reese- East by Bake St- 
South by 3rd Avenue- and West by Fannie Park. All in said county of Marion 
State of Georgia .
