Smith for and in consideration of the sum of Five dollars to me in hand paid by the Trustees of the Methodist Episcopal Church South, To wit Jacob McCarty, R.L. Pilgrim, W.L. Buford, Z.P. Ford and I.M. Tatum, Trustees in trust herein after mentioned of the other part all of the County of Yell and state of Arkansas witnesseth that the said F.H. Smith and his wife Sealy Jane Smith for and in consideration of the sum of Five dollars to them in hand paid at or upon the sealing and delivery of these presents the said receipt whereof is hereby acknowledged have given granted bargained sold released and conveyed and by these presents have given granted bargained sold released and conveyed unto them the said Jacob McCarty, R.L. Pilgrim, W.L. Buford, Z.P. Ford and I.M. Tatum and their successors Trustees in trust for the uses and purposes hereinafter mentioned and declared all the estate right title interest property claim and demand whatsoever either in law or in equity which he the said F.H. Smith and his wife Sealy Jane Smith have unto and upon all and singular a certain lot or piece of land situated lying and being in the County and state aforesaid and described as follows to wit one square acre lying on the north and south line lying in the SoEast corner Section Nineteen North East Quarter of the North East Quarter it being a part of The North East Quarter of the North East Quarter containing one square acre in the South east corner all in Township four North of range twenty two west containing in the aggregate one square acre to hold all and singular described as aforesaid with all the aforesaid privileges unto the said Trustees and successors in office forever in trust that they shall erect and build or cause to be erected and built thereon a house or place of worship for the use of the members of the Methodist Episcopal Church South according to the rules and discipline which from time to time may be agreed upon and adopted by the ministers and preachers of the said church at their General Conference and in further trust and confidence that they shall at all times forever hereafter permit such ministers and preachers belonging to said church as shall from time to time be duly authorized by the General Conference of the Ministers and preachers of the said Methodist Episcopal Church South or by the annual conference to preach and expound God's holy word therein and the said F.H. Smith do by these presents warrant and forever defend all and singular the before mentioned and described lot or piece of land with all The appurtanances [sic] thereto belonging unto them the said Jacob McCarty, R.L. Pilgrim, W.L. Buford, Z.P. Ford, and I.M. Tatum and to their successors chosen and appointed as aforesaid from the claims of him the said F.H. Smith his heirs and assigns and from the claims of all other persons whatever in testimony whereof the said F.H. Smitha and Cealy J. Smith his wife to me well known personally and to be the persons whose names are subscribed to the foregoing deed and the said Frederick H. Smith and Cealy J. Smith acknowledged that they had executed the said deed for the consideration and purposes therein mentioned and set forth and the said Cealy J. Smith being by me first made acquainted with the contents of said instrument acknowledged on an examination apart from her husband that she executed the same freely and without compulsion or undue persuasion of her said husband. Brooks, Clerk of the Circuit Court and Ex-Officio Recorder, within and for the said County of Yell and State aforesaid, do hereby certify that the annexed instrument of writing was filed in my office for record, on the 31st day of January A.D. 1880, and that the same is now duly recorded in Record Book G, Page 474 and 475. Brooks, Clerk [Note: This may be recorded in Record Book 7 - the handwriting is unclear.] Submitted by: Karen Groce kag1@ra.msstate.edu --- Deed - Elias and Sarah Cathey to John Connally This Deed of Conveyance made and executed at the Township of Lower Lafave within the County of Yell in the State of Arkansas this the 24th day of January in the year of our Lord one thousand eight hundred and sixty by and from Elias Cathey and Sarah Cathey of the County and State aforesaid of the first part hereto and with John Connally of the County and State aforesaid party of the second part hereto witnesseth that the said parties of the first part for and in consideration of the sum of thirty three dollars by the said party of the second part at and before the ensealing and delivery of these presents unto them in hand paid the receipt whereof they do hereby acknowledge have granted bargained and sold aliened and conveyed and do hereby grant bargain and sell alien and convey unto the said party of the second part the hereinafter described track or parcel of land namely the North half of the North East Quarter of the North East Quarter of Section twenty four in Township four Range Twenty three ... twenty acres more or less ... County in the State of Arkansas ... with all and singular the appurtenances to the said premises belonging. To have and to hold the above granted track or parcel of land and premises unto the said party of the second part his heirs and assigns forever and the said parties of the first part and their heirs shall and will warrant and defend the same unto the said party of the second part his heirs and assigns forever against the lawful claims of all persons whatsoever. And the said Sarah Cathey wife of the said Elias Cathey for and on her part and behalf does hereby freely and fully relinquish and release unto the said party of the second part all her right and claim to dower in and to the aforesaid granted and bargained premises. Jameson on this 6th day of March 1860 to survey tract of land it being the NW fr 1/4 of section 19 and the W 1/2 of NE 1/4 of sec 19 Township 4 North Range 22 West commencing at the NW corner of section 19 run south 40 chains [forward?] No. 1/2 mile corner made corner on a Pos tOak 18 in. in diameter marked with a crop and below with the initials JB & BT thence East at a variation of 7 E 53 chs 84 L made corner stake from which willow oak 14 in. bears N 33 1/2 W 14 L m JJ&BT thence North 38 chs 75 L with a variation 8 degrees E to section line made corner stake from which a Hickory 12 in. bears S 16 1/2 W 24 L on JJ&BT thence to the beginning 55 chs the following Plat laid down on a scale of 20 chs to the inch. Surveyed and Plated by W.D. Briggs Yell County surveyor and certifide [sic] to be correct as above given. Fees: surveying $3.00, Plat $.50, Record $.50, Calculation $.50, Hier [sic] of hands $1.50. Total $6.00. [Note: The plat drawn has dimensions: 40 chains by 55 chains by 38 chains 75L by 53 chains 84 L, and is described as 213 & 54/100 acres. To me this is not obvious from the description given above by the surveyor.]
