Doughty, Charles M. – July 1849 – page 2

And now on this day the Account Current of Linton C. Doughty as administrator of
Charles M. Doughty, decd. heretofore filed and
continued to this term coming up for approval and conformation no exception
having been filed there to or any item thereof the
Court proceeded carefully to examine the same and upon such examination doth
find that said administrator stand charged
thereon with assets in his hands and possession amounting to the sum of one
thousand four hundred and nineteen dollars and seventy
three cents ($1,419.73) being amount of assets in his hands at his last
settlement. And that the said administrator has paid out
and expended in behalf of said Estate the sum of thirty two dollars and seventy
five cents ($32.75) since said last settlement and for
which he is justly entitled to it and is also that said administrator is
entitled to a credit of ten dollars and eighty cents
($10.80) for error in last settlement and also of two dollars and fifty cents
error in I. Denson’s note . And the Court doth
further find that the following bond note and account with which said
administrator stands charged is totally
uncollectable viz Jefferson Clury bond for $10.00 with ten per cent interest
from September 30th 1846, A. Dodson account for
$15.90, J.P. Studly’s account for $25.23, Thomas F. Ferrell’s account for
$129.31, Frances Phelps account for $375, James Caty
account for $1.50, Balance J.C. Caty & J.H. Church’s note $11.87, J.J.
Blackman’s note for $9.00, making in all the sum of two
hundred and six dollars and fifty cents ($206.50) . And the Court being
satisfied that the said amount of two hundred and
six dollars and fifty cents cannot be collected doth allow said
administrator a credit therefore and the Court doth allow said
administrator the further sum of forty one dollars for his risk and trouble
in attending to the settlement of said Estate.
All of said credit amounting in the aggregate to the sum of two hundred
and ninety two dollars and ninety three cents
($292.93) which deducted from the sum of one thousand four hundred and nineteen
dollars and seventy three cents ($1,419.73) leaves a
balance due said Estate for one thousand one hundred and twenty six dollars and
eighty three cents ($1,126.83) after deducting from which latter
sum. The sum of four hundred and sixty one dollars and sixty one cents
($461.61) amount of dower of said intestate widow
leaves the sum of nine hundred and fifty dollars and twelve cents ($958.12) and
the Court doth also further find that there are
sufficient assets to pay all claims of the first and second class against said
Estate which have been proven by the administrator or
allowed by the Court and said administrator is ordered and directed to pay the
same and after paying all said claims of the first and
second class on aforesaid there will remain in the hands of said administrator
the sum of nine hundred and thirty three dollars and
twelve cents ($933.12). And the Court doth find that the claims against
said Estate of the fourth class parsed by the administrator and
allowed by the Court amount principle and interest to the date
to the sum of one thousand five hundred ninety seven dollars and sixty
one cents ($1,597.61). And doth find that the said sum
of nine hundred and thirty three dollars and twelve cents so remaining in the
hands of said administrator to pay the debts of said Estate will pay no more
than 58 4/10 cents in each dollar of said claims of said fourth class. And said
administrator is ordered to pay each of said claims accordingly to that rate
that is to say said administrator is ordered and directed to pay to Moses
Greenwood as his dividend and prorated share of said assets the sum of one
hundred dollars and sixty seven cents ($100.67) to Marshal and Fanny the sum of
three hundred and seventy three dollars and eighty eight cents ($373.88) also
the further sum of three hundred and seventy four dollars and ninety eight cents
($374.98) to James M. Johnson the sum of ten dollars and seventy five cents
($10.75) also the further sum of Seventy two and seventy two cents ($72.72).
And said account is approved and confirmed by the Court and directed to be
entered at full length upon the record of administration accounts.

"The above and foregoing account of Lenton C. Doughty administrator of Charles
M. Doughty, deceased in a correct coy of the settlement made said administrator

Doughty, Charles M. – 16 Apr 1850 – page 6

At a Court of Probate in and for the County of Ashley begins and held in and for
the County of Ashley on the 16th day of April AD 1850 it being the first
Thursday after the 3rd Monday in said month, Present the Honorable William E.
Willis , Judge. Court being proclaimed.

Came Linton C. Doughty administrator of the Charles M. Doughty, decd. by his
attorney and represented to the Court here that a manifest and palpable clerical
error exist in the order of the Court made at the October Term 1849. Approving
and confirming said order Account Current with his said intestate Estate and the
apportionment of the money remaining in the hands of said administrator. Among
the credits of said Estate and upon inspection and examination the Court being
satisfied that an error exist in this that said widow is entitled to that the
sum of three hundred and forty dollars and fifty two cents as her dower in said
Estate but sum allowed as said dower as appears by said order is four hundred
and sixty one dollars and sixty one cents and which said sum is evidently
deducted from the sum of one thousand four hundred and nineteen dollars and
seventy three cents the amount charged on said account as due by said
administrator at his primas settlement when it is clearly apparent that it
should have been deducted from the sum of one thousand one hundred and twenty
six dollars and eighty three cents the remaining in his hands after the
allowance of the credit allowed by the Court, the Court therefore proceeded to
strike the just and true balance and determine what sums will remain on hand
after the payment of said sum of three hundred and forty dollars and fifty two
cents to said widow as her said dower to be appointed among the creditors of
said Estate and the Court doth find that after deducting said sum of three
hundred forty dollars and fifty two cents from the said sum of one thousand, one
hundred and twenty dollars and eighty three cents these properly remain in the
hands of said administrator the sum of seven hundred and eighty six dollars and
thirty one cents ($786.31). And after paying the claims of the first sums and
third class amounting to the sum of twenty five dollars which is ordered to be
paid then was to be apportioned among the creditors of the fourth class the sum
of four hundred and sixty one dollars and thirty one cents and it being … claims
of said fourth class p… by the administrator …

By the Court amount principal and interest up with dates of the above mentioned
order to the sum of one thousand five hundred and ninety seven dollars and sixty
one cents and it doth find that seven hundred and sixty one dollars and thirty
one cents said true and correct sum remaining with hand of said administrator to
pay said claims of said fourth class will pay no more 47.65 cents in the dollars
and said administrator is ordered to pay each of said claims according to that
rate that is to say said administrator is ordered and directed to pay to Moses
Greenwood on his dividend and prorate share of the said assets the sum of eighty
four dollars and seventy nine cents to Marshall & James the sum of three hundred
and six dollars and eighty cents also the further sum of three hundred and five
dollars and two cents, to James M. Johnson the sum of fifty nine dollars and
thirty cents and the further sum of seven dollars and forty eight cents.
