William Smith's Will

Know all men by these presents that I William Smith of the County of Spencer 
and State of Kentucky am held and firmly bound to Archebald Nichols of the 
County and State above named in the final sum of One thousand dollars for 
the payments of which I bind myself heirs and Executors and Administrators 
this 7th day of Novenber 1835. {seal)
Now the condition of the above is such that if the above bound William 
Smith shall well and truly make to the said Nichols a Deed to the Land on 
which the said Smith doth live except ten acres of Wood Land on the west 
side of the creek leading from Mount Eden to Snider Mill which said wood 
Land belongs to John McDonald the said Land I hold by two Bonds one from 
Daniel Sniders heirs and the remainder from John Buckley the said Nichols to 
pay on or before the first of March rent three hundred dollars and four 
hundred Dollars in the annual payments thereafter, that is to say two 
hundred Dollars the next March after the first payment and the next the 
following March: Now itis expressly understood that the said Nichols is not 
to reiquire any better title than said Smith has now to withhold any of the 
above specified payments in conswquence of the not making of said Deed. But 
well and truly to make the payments as they become due to the said William 
Smith or Eleanor his wife if She should survive him for her own use and I 
William doth also make thes to supercede all Wills & Testaments by me 
heretofore made and doth make this last Clause in the Bond to be my last 
Will and Testament this day and date above written signed sealed. N.? B. the 
owner of the mansion house and lots on which it stand and a suficiency of 
fire wood shall remain to William Smith and his wife Eleanor during each of 
their lives.

At a County Court held for Spencer County on Monday the 5th of June 1837. 
This writing purporting to be the last Will and Testament (last part is 
unreadable).

William Smith Dec'd together with the codicil thereto annexed was proved 
according to Law by the oaths of Alexander McDonald and John McDonald 
witnesses there to and is ordered to be recorded. And there being no 
Executor named in said Wills on the notion of Eleanor Smith Widow and Weed 
of said Deceased who made oath and together with Lewis M. Bailey her 
security intered into and acknowledged a Bond in the penalty of $1800 
conditions as the Law directs Certificate is granted the said Eleanor Smith 
for obtaining letter of Administration on the said Decedents Estate with his 
Will aforesaid annexed in due form.
