WILL OF JOHN YOUST

I, John Youst of Morgan County and State of Virginia do hereby make my
last will and testament in manner and form as follows to wit,

1st I desire that all the perishable part of my estate be immediately
sold after my decease and out of the moneys arising therefrom all my
Just debts and funeral expenses be paid

2ndly After the payment of my debts &c I give to my beloved wife
Elizabeth one third part of my personal estate and all my lands and
tenements for and during her natural life and after her decease I desire
that my executors hereinafter named may sell all the estate both real
and personal that may be left and the proceeds thereof equally divided
among my children or their heirs Viz, my sons Peter, John, Christian,
Lewis & Levi and my son Williams heirs he being deceased and my daughter
Polly Hume and my daughter Nancy Merchants children she being dead also
to my daughter Catharine Henry I give an equal share with the rest of my
children for her sole and seperate use free from the control or claims
of her husband Nicholas Henry or his creditors; it is my intention
however that any of my children or the husbands of my daughters that may
be indebted to me at the time of my death by note bond or otherwise that
such debts shall be considered as part of the Legacy of such child and
if any of said children shall owe more than their full share then such
excess is to be collected and distributed as above directed,

And lastly I do hereby constitute and appoint my son Levi Youst and my
Friend Isaiah Buck executors of this my last Will and Testament hereby
revoking all other or former wills or testaments by me heretofore made.
In witness whereof I have hereunto set my hand and affixed my seal this
4th day of October 1855

January Term 1856

The last will and Testament of John Youst Dec'd which at the last Term
of this Court was in part proved by the Oath of Isaiah Buck one of the
subscribing witnesses and was this day fully proved by the Oath of
Darious Shockey the other subscribing witness and admitted to probate
and Ordered to be recorded and thereupon Levi Youst and Isaiah Buck the
executors named in said will entered into bond in the penalty of six
thousand dollars conditioned as the law directs with Andrew Michael
Elijah Hovermill and George Aulabaugh their securities and the said Levi
Youst and Isaiah Buck the said named executors took the Oath as such
provided by Law,
