Will of Peter J. Smith, Fulton County, New York, Will Book, Ephratah Vol. 11,

Will; I Peter J. Smith of the Town of Ephratah, Fulton County, NY aged sixty 
three years.  I do hereby make, publish and declare this my last will and
testament in manner following, that is to say first   

I give and bequeath to my beloved wife Magdalin, all my household furniture,
beds, bedding and wearing apparel of every kind or name to have, hold, use and
enjoy the same during her natural life and after her decease, I give that 
same or what may be left thereof to my two daughters, viz; Harriet Eliza, wife 
of Nicholas Fancher and Delilah, wife of Aaron Cool to be divided equally
between them, share alike.  

Second; - I give to & bequeath to my two sons William F. Smith and Stephen J.
Smith all of the rest, residue and remainder of all my property counting real 
estate and personal property of every kind whatsoever to be divided equally 
between them, share and share alike, subject however to the bequest
hereinafter made which shall be a change and a lien on all the said real
estate.  

Thirdly   I give and devise to my two daughters above named, each of them the
sum of one hundred and fifty dollars to be paid to them respectively within
sixty days after my decease and I give and bequeath to my granddaughter Laury
Smith two hundred dollars and to my two grandsons, viz; Peter J. Smith and
Frederick Smith seven hundred dollars each.  Said legacies to be paid to each
of the said children when they arrive at the age of twenty one years.  

And lastly I hereby appoint my said wife Magdalin and my said son William 
F. to be the executrix and executor of this my last will, hereby revoking any 
and all former wills by me made.

In witness whereof I have hereunto set my hand and seal, this fourteenth 
day of March, in the year one thousand eight hundred and sixty four.

The foregoing instrument of which this is the second page was at the date 
thereof signed, sealed and published and declared by the said Peter J. Smith
as and for his last will and testament in presence of us who at his request
and in his presence and in presence of each other subscribed our names as
witnesses thereto.
