Thomas TOOLEY, Jr., William WILLIAMS, Jr., Aden SLADE, Henry SLADE, 
Jr., John SLADE, William SLADE, Solomen RICHARDS, Thomas WILKINSON, 
Richard ALBART, Thomas JONENS, John EASTER, William ENLOES, and William 
CARDETT, a Negro. CARTER understands (on information from BOITAR) that 
they [apparently BOITAR and others] had arrived at Currituck in the 
county of Hyde with a new Galley. The defendants had “embodied” to 
seize the galley with her materiels. The defendants invited BOITAR to 
the house of Joseph WALLS for supper. When BOITAR arrived, the 
defendants seized and detained him to prevent him from stopping them. 
They then seized the Galley and all materials [there follows a long 
list of merchandise and furnishings] and 2 slaves, Tom and John, 
belonging to the plaintiff. They converted the galley and materials to 
their own use. Henry ROBINSON, Samuel MASON, Thomas MASON, Jr., Thomas 
MIXON, Benjamin JONES, Richard TOOLEY, John RICHARDS, and Christopher 
JONES, Jr. entered the galley as accomplices with the defendants in

Defendant’s petition for continuance. CROOKE states that he has another 
case pending in the court of Martin to be heard at the same time as 
this case and asks for continuance. His further statement is that on 
Dec. 1782 he was presented with a note of Francis LEE, whose widow 
CROOKE had married. CROOKE agreed to pay the note, but stated he was 
ignorant of the matter and whether any payments had already been made. 
Mr. SMITH [apparently the executor of Brice WILLIAMS to whom the money 
was owed—sg], said that none had been made. W. HERRYMAN who married a 
sister of Francis LEE & Samuel BLACK who married the mother were also 
parties to the debt, and HERRYMAN informed CROOKE that he had paid Mrs. 
MUNDINE [not sure who this is—sg] part of it. BLACK’s death “put a stop 
to my getting the amount of what he paid—his papers being in Mr. Geo 
GREYs hands can’t be easily got at.” SMITH came to CROOKE in April and 
asked for payment; CROOKE told SMITH what HERRYMAN had said, and SMITH 
said that Mrs. MUNDINE had said she had received part, but could not 
ascertain the exact amount. CROOKE then told SMITH that on his return 
he would bring in paper certificates and vouchers from HERRYMAN. He 
would also discover what BLACK had paid, and then pay the balance 
immediately. “W. SMITH contrary to good fellowship & every mark of 
politeness, issues a Writ on the very day the Note was due by 4 oClock 
in the afternoon without waiting the expiration of the day—a proceeding 
I believe scarcely to be met with in the memory of the orders of your 
Worships & I believe contrary to Law.” CROOKE believes this was done to 
deceive him, and says that SMITH has told him that he found the payment 
made by HERRYMAN among WILLIAMS papers, & heard Mrs. MUNDINE 
acknowledge it, but could not ascertain payment by BLACK. CROOKE is 
asking for continuance to allow a search of the papers of the deceased

Information: Deposition of George EVANS in the case in which George 
FAULKNER is plaintiff and Thomas CROWSON defendant. EVANS said that 
about 4 months prior to the Court in which CROWSON brought his suit, 
that being on the lands in dispute, he heard CROWSON accuse FAULKNER of 
deceiving him in that a quantity of land sold by CROWSON to FAULKNER 
said to be 2 acres was really more. CROWSON also said that FAULKNER was 
by agreement to execute a deed to him for a small quantity of land, but 
FAULKNER said that the land was already CROWSON’s because JOHNSTON had 
given him a deed for it. 

EVANS was asked if he had not since heard FAULKNER say that he was 
ready to execute the deed, and EVANS said that since the original suit 
was brought by CROWSON that he had heard FAULKNER say this. 

Asked if “I” spoke in jest or earnest, EVANS replied, “I took you to be 
in earnest although you were laughing.” 

Asked if he had ever heard FAULKNER say what quantity of land was 
contained in the deeds, EVANS replied, “I guesd. at 5 or 6 acres upon 
which FALCONEER replyed 8 or 10.

Asked if he had not heard FAULKNER ssay that what he had said 
concerning the land was said in jest, and that part of the land in 
dispute he had purchased from Saml CHARLESCRAFT, EVANS replied, that 
after the Action brought he did hear him say that.

Asked if he had not laid off the land that FAULKNER sold to CURTIS, 
EVANS replied that he did, and that CURTIS seemed satisfied, but that 
land did not extend to the land in dispute, and he had heard FAULKNER 
state that he did not sell Thomas CURTIS all of the land he bought of 
Samuel CHARLESCRAFT, but this was said after CROWSON brought the suit. 
Capt. Geo. FALCONEER drew a deed said to be for the land in dispute & 
proffered it to Mr. COWSON, which he refused to accept this day.”

FALCONER to appear and answer a plea of Trespass on the case & damages 
(£10,000) brought by Thomas CROWSON. Remainder of document: Charge by 
CROWSON that he owned land adjoining Martinsborough in Pitt County, and 
that he and FALCONER reached an agreement whereby FALCONER would pay 
him $100 and deed him 1/2 acre of land, and CROWSON would deed FALCONER 
a tract of land which FALCONER (who was not unacquainted with the land) 
told CROWSON (an illiterate person) contained 2 acres of land. Since 
then FALCONER has acknowledged that the metes and bounds in the deed 
amount to more than 2 acres (i.e., 8 acres). In addition, FALCONER did 
not have the right to convey the 1/2 acre that he promised to CROWSON, 
and has not done so.

Information: This is a transcript of a case heard in Dobbs County 
Court. Alexander HARPER sued John GRAINGER stating that he had leant 
GRAINGER £1000 on October 15 1780, and that HARPER leant GRAINGER 
another £1000. Both debts were to be paid in 12 months. GRAINGER agreed 
to provide a Negro man for his use for the 12 months, and as security 
for repayment. HARPER stated, however, that GRAINGER often arranged for 
the man to be at GRAINGER’s property, so that HARPER often didn’t have 
the use of him. At the end of the 12 months, GRAINGER did not pay money 
owed. GRAINGER responded that he did in fact offer to pay HARPER and 
that HARPER refused payment, The case was tried by a jury; the case was 
continued several times until it was heard in July 1783. GRAINGER’s 
attorney asked for a stay of judgement, but the court ultimately ruled 
in favor of GRAINGER, and an appeal is brought by HARPER.

suit says that William GIBBS gave them 2 bills of exchange ($1,000 & 
$2,000) which they were to present to Messrs DORSIERS & MOWITT, who 
were to pay the OGDENs the amount required. DORSIERS & MOWITT refused 
to pay, making GIBBS liable for the amount, and he agreed to pay them.  
GIBBS has not paid, and the OGDENs state that he intended to defraud 
them of the $3000, and sue for $4000 (amount plus damages).

Information In response to an order by Superior Court for the District 
of New Bern, Thos ALDERSON and Wm. BROWN, Justices for Beaufort County, 
examined Alderson ELLISON and John WOODARD in regard to a suit heard in 
that court. ELLISON stated that he saw the copy of the words of a sale 
of a Negro belonging to the estate of Joshua PRITCHETT, decd. entered 
for use, and that at the request of Benja PARMELE he gave him a true 
copy, signed by him [ELLISON] as clerk, and that he [can’t read] of a 
Negro belonging to the estate at the instance of the Executors, and 
that Mary PRITCHETT was acting executrix of J. PRITCHETT’s estate. 
WOODARD stated that he was a witness to a bill of sale from Mary 
PRITCHETT William DAW Robert ROLAND to Alexander STEWART for a Negro

Information Oath by James HARRISON: On or about the 17 day of August 
last that he and Lawson MALLARD were on their way to camp that MALLARD 
told HARRISON that he was ordered by Col. AVERY to deliver a grey horse 
belonging to Capt. RANDAL home to the owner with a letter. A little 
below Ezekiel CLIFTON’s house MALLARD delivered the horse and letter to 
HARRISON and desired HARRISON to deliver it to RANDAL in camp. Minutes 
later, in sight of CLIFTON’s house, the Tories and British attacked 
HARRISON and fired at him and wounded him, and also shot the horse in 
the hip. HARRISON tried to escape, but was overtaken by the enemy and 
compelled to surrender; he was conducted to Major CRAIG, and the horse 
and letter fell in the hands of the enemy. Jas MCCAFFETY was wounded at 
the same time, by the side of HARRISON, while the enemy was firing.

guilty, and award the plaintiff £20,000. Motion to arrest judgement 
related to the admissibility of testimony of one of the witnesses and 
the excessive damages. Decision appealed. Defendant gave Edmond HATCH 
and Hezikiah MERRIT as security. p. 2 [inside]: William RANDALL, Esq. 
complains of Waightsill AVERY saying that on 20 Aug 1778 that he 
[RANDALL] owned a grey gelding horse of a value of £50,000, and that on 
that day RANDALL lost the horse. AVERY on the same day found the horse, 
and knowing that it belonged to RANDALL, still kept the horse, and has 
since refused to return it to RANDALL. AVERY (by his attorney) denies 
that he is guilty of the charge and asks for a trial.

Information  Petition to the “Worshipful Court of Pitt County” by David 
DONNAN, stating that he served the county for as many as 13 terms as 
states attorney, and that he was to be paid quarterly for his service, 
but that he has not received adequate satisfaction for any of those 
courts, to his great inconvenience and distress. He is being daily 
harassed by those to whom he is indebted. DONNAN then says, “…with all 
due concessions for his former Indiscretions and with equal Deference 
to your Worships as the first Court in conjunction with whom He has had 
the Honor …of being Assistant to the support of Civil Government and 
Distributive Justice in this State; takes this method to request your 
Worships to throw the vail of your charity over whatever may have 
appeared short of that Dutiful Regard which your Worships may have 
tho’t justify the due and him Deficient in, as your State’s Attorney…”

John ATKINSON are defendants: SAGE states that about the 5th Day of 
September in the year 1784 that Moses STANDLY and Daniel ATKINSON came 
to SAGE’s house and asked him to draw a note of hand and SAGE told him 
“he would not have anything to do in so unjust thing as he knew that to 
be, but if they would chuse Two men to arbitrate the Matter Betwixt 
tham that if they allowd STANDLY anything he would lend ATKINSON the 
money to pay STANDLY.” STANDLY refused, but said he would deduct £20 
from the amount owed if ATKINSON would give his son John as security on 
the note. SAGE asked STANDLY what his motive for that was, rather than 
Mr. John ASHE and Mr. Joseph TUKE which he already had for security for 
£80. If he did receive money from anyone, it was better to get it from 
John ASHE unjust than from William ATKINSON’s innocent Father and 
Brother, because SAGE believed that Mr. ASHEs getting William ATKINSON 
to go into Publick Service in his Room [i.e., place—sg] was the cause 
of [William] ATKINSON gitting into bad company and becoming a horse 
thief. SAGE told STANDLY that it was as great a crime for him to take 
the money from those innocent persons as it was for William ATKINSON to 
steal his mare, and STANDLY ought to have Caried W. ATKINSON to justice 
for the theft. STANDLY  still insisted on getting a note for £60 from 
Daniel and John ATKINSON to be paid in one month, or he would proceed

father, William BORDEN in attending to a suit brought by Henry DICKSON. 
BORDEN and DICKSON had agreed to the appointment of William BRYAN, and 
Joseph LEECH, Esqs. and Thomas OGDEN as referees, their decision to be 
the rule of court. Almost a year elapsed from the appointment with 
nothing done about the suit as far as BORDEN junr. knew. He had in his 
possession accounts of nearly £300 against DICKSON, which he was always 
willing to produce with sufficient notice. At the November term “last”, 
he was informed by Mr. KNOX (attorney for DICKSON) on a day or two 
before the rising of the court about an hour or two before sunset that 
the referees were to sit that evening to determine the suit. BORDEN 
junr replied that he was entirely unprepared as had neither the 
accounts nor his witness present. He had summoned his witness several 
terms before that the witness was then sick and did not attend and that 
he had it not in his power to produce his accounts but by riding 35 
miles. He asked if he would appoint any time when it was possible for 
to attend, and he would endeavor to prepare himself. KNOX refused to 
agree, and BORDEN attended the referees and presented his request to 
delay the proceedings, but the referees proceeded to decide the case. 
He received a letter from Mr. OGDEN dated 3 May 1785 directing him to 
attend at Newbern on the 21st of the same month for the purpose of 
trying the case, and he did, but the arbitrators never met.

for a business enterprise in which they would be equally interested.

in carrying on the trade until about May 1781, when they divided the 
business. There follows a description of how and when payments were 
made by DISON to BORDEN, and concludes that DISON is owed a balance of 
£10.1.4. Sheet 3: Top of page is account of what DIXON’s wife (Hannah) 
received out of the merchandise which was charged to BORDEN. Bottom of 
page is oath by BORDEN junr. that items charged by DIXON to BORDEN were 
actually delivered to Mrs. Hannah DIXON on her order and ought not to

Physick Surgery that Edward RICE moved to Virginia several years ago, 
and has never returned DICKINSON’s knowledge, DICKINSON had no 
knowledge of any suits against him in New Bern District Court since Mr. 
JOHNSTON his counsel gave up his practice. DICKINSON was informed by 
Blake BAKER about the New Bern suits during the last Edenton Superior

1748 that he settled on John HARRODS improvement above Greens Ford, 
where he lived for 3 years. In that time Greens Path bore up the creek 
(Greens Ford) and through the slough or pocoson to the Woolf pit & the 
path round said slough was made by the neighbors to his house. During 
the time that he lived there, John GREEN came to his house and told him 
that the path through the slough was the path he had marked. About 7 
years ago, TULLY was at the home of John SANDERS who told TULLY that he 
would one day if living be an evidence to prove Greens Ford and Path, 
because the people had got a way of calling the path round the slough 
Greens Path. Mary [Molly] SANDERS said that Greens Path at the time of 
her knowing the same did bow off from the Creek through the swamp or

a debt owed to him. VINEY was summoned by Deputy sheriff Abel ROUNTREE, 
and VINEY’s attorney David WITHERSPSOON defended the case. A jury was 
summoned, consisting of William GOOD, Thomas DUNN, Joseph JACKSON, 
William SPIGHT jr, Wright STANLY, William Brice FONVIELLE, Wilson 
BLOUNT, Hugh PUGH sr. Thomas WILLIS, Shadrach ALLEN, Levi FULSHER &

Information Deposition of Thomas DAILY Jun that on 6 September 1784 he 
was at the house of Joseph HANCOCK. Capt Colimo MEDIA came to the house 
with a drawn sword in his hand and demanded of Mrs HANCOCK the mother 
of Ehraim ?ELIHU where Ephraim was. Mrs. HANCKOCK asked what he wanted 
with him, and MEDICOS answer was that he wanted to split his damned 
brain out (or open). MEDICO then threatened to cut of Mrs. HANCOCKs 
hand if she did not tell him where her son was. Soon after MEDICO got 
into the room where Ephraim was with his sword still drawn. ?ELIHU 
having armed himself with a gun ordered MEDICO not to advance one foot 
further, or he’d blow his brain out. A Mr. ROBERTTON and Mr. John Mack 
NANCY intervened, and while ROBERTTON was attempting to wrest the gun 
from ELIHU, Medico made a stroke at ELIHU & cut Mr. NANCEYs finger 
badly with his sword

3 years, 9 months, 11 days and was discharged by Genl James ARMSTRONG 
in Pitt county by order of Col Hardee MURFREE to Benja BUCK to receive 
from the commissioners appointed by the late act of assembly to pay the 
soldiers all the pay due. Bottom: Oath by Abram HARDEE & James GORHAM, 
Justices that Henry ALBERTON appeared and acknowledged the above POA. 
He (ALBERTON) deposes that he was a soldier (as described above) and 
states that he kept his [written] discharge until after the war, then 
thinking it would never benefit him, he destroyed it, and that he has 
never had any pay since he returned.
