To the Probate Court of Madison County
Der Term of AD 1869
	This day came on to be heard the application of A. Carson and others for 
the sale of the lands of Robt Carson dec'd and to approving of the satisfaction 
of this court that Maud  Wm Elijah & Martha C. Evans-Elijah William David 
Augustus & Thos Carson and minors under the age of twenty one years and without 
a guardian and that citations have been duly issued and returned ?. Personally 
on by the Sheriff of said County and E.S. Jeffrey having been appointed guardian 
ad litus for said minor and the said Jeffery having filed his answers as such 
guardians ad Litcun and it further appearing that citations have been issued and 
executed on all the parties in interest issued to this state and that 
publication has been made as required by law in the ?.. Citizens in public 
newspaper published in Canton in Madison County, Miss and to R.T. Westbrook, 
W.F. Carson, Margaret Allen and James Carson proof of which is here now 
presented in of in court and further appraising to the satisfaction of the Court 
that the laws discussed in land petition on accounts of their nature and 
distribution can not be divided between the parties interested equally and 
fairly justify and equitable all of which is established by 
proof in open Court.  It is therefore ordered adjust and decreed that said lands 
be sold for cash to the highest bidder and that the proceeds arising from land 
sale be divided between the parties interested therein according to their 
several interests therein and the said T.H. Weatersby is hereby appointed 
commissioned for the purpose of carrying out the objects of this decree and the 
said Weathersby hereby ordered and improssed to make and execute a deed of 
conveyance of said lands to the purchases thereof and that he 
reports his actions in the premises to this Court for its confirmation and 
approval.  
Ordered, adjudged & decreed this 17th day of December 1969.

	This day came on to be heard the application for the Sale of the lands of 
said Robt Carson decd and it appearing to the satisfaction of the Court that 
Maud, Wm, Elijah and Margaret C. Evans and Elijah, Wm, David, Augustus & Thos

inpro?and show to your Honour that on or about the 18th day of Oct 1867 Robert 
Carson departed this life intestate in the County aforesaid ?and prepared of the 
following real estate lying and being situated in this county aforesed known U 
designed as the SE 1/4 and E 1/2 of SW 1/4 of SE 19- E 1/2 of NW 1/4 N 1/2 of W 
1/2 NE 1/4 Se 30 T11 R 4 East that the said Robt Carson left no debts against 
him at the time of his death that your petitioners and the other parties heir of 
the named are the heirs at law of the said Robt Carson and jointly interested in 
the land aforesaid that on account of the situation of the said laws and the 
great number of the parties interested therein as expressed and just division 
Hind can not be swode there of.  The promises considered your petitioners pray a 
? said land may be sold  by as order or this Hall Correct on sixth terms as your 
Honor may direct and the powers of arising therefrom equally divided among the 
parties in interest and that Josephine Weathersby, J.N. Westbrook, F.M.

	KNOW ALL MEN BY THESE PRESENTS, THAT WE Gabriel Allen, 
McCleden Carson, James Martin, Joseph Conn and Thomas Sallawhite 
	of Madison County and State of Mississippi are held and firmly bound unto 
	N. Calliham Judge of Probate in and for the said County of Madison, and 
his successors in office, in the sum of thirty thousand dollars; for which 
payment well and truly to be made, we and eachof us bind ourselves, our and each 
of our heirs, executors and administrators, jointly & severally, firmly by these 
presents, sealed with our seals and dated this 25th day of March A.D. one 
thousand eight hundred and thirty-four.
	THE CONDITION OF THIS OBLIGATION IS, That if the said Gabriel Allen 
and McClellen Carson administrators of the goods, chattles and credits of Robert 
Carson, Senior deceased; to make a true and perfect inventory of all and 
singular the good, chattles and credits of the said deceased, which have or 
shall come to the hands, possession or knowledge of the said Allen and Carson or 
in the hands of possessions of any other person or person for they and the same 
so made do exhibit unto the Orphans Court of Madison County, when they shall be 
thereto required by the said Court, and all the rest of the said good, chattles 
and credits which shall be found remaining upon the account of the said 
administration, the same being first examined and allowed by the said Court, 
shall deliver and pay unto such persons respectively as are entitled to the same 
by law, and if it shall be hereafter appear that any last will and testament was 
made by the deceased, and the same be proved in Court, and the executor or 
executors obtain letters testementary, and the said Allen and Carson do in such 
case being required, render and deliver up their letters of administration, then 
this obligation to be void, else to remain in full force and virture.
