DAVID N. SMITH

The will of David N. Smith, 1890, Queen Anne's County,
Maryland, Liber FR, Folio 1, page 60.

In the name of God Amen - I David N. Smith of Queen
Anne's County Maryland; being in feeble health of Body
and of sound and disposing mind memory and understanding
considering the certainty of death and the uncertainty of the time
thereof and being desirous to settle my worldly affairs and thereby
be the better prepared to leave this world when it shall please God
to call me hence, do therefore make pronounce and publish this my
last will and testament in manner and form following that is to say:

First and principally: I commit my soul to Almighty God and my
Body to the earth to be decently buried at the discretion of my
Executors.

Item 2. I do hereby authorize and empower my Executors
hereinafter named to sell to sell (repeated in document) all my real
and personal estate wheresoever, the same may be situated and
located on such terms of cash and credit as the orphans court for
Queen Anne's County may direct.

Item. After payment of my just debts cost of administration, and
funeral Expenses out of the sales of my aforesaid real and personal
Estate I do hereby give bequeath and devise the residue of the
sales aforesaid real and personal Estate to my beloved children;
Mrs. Mary E. Higgins wife of James W. Higgins, David N. Smith,
Mrs. Susan A. Mullikin wife of Thomas M. Mullikin, Joseph N.
Smith, William W. Smith, George D. Smith, Ann Rebecca Smith,
Sarah C. Smith, Francis Ellen Smith, and John Wesley Smith - the
same to be equally divided between them share and share alike.

I do hereby constitute and appoint David N. Smith and James W.
Higgins the Executors of this my last will and testament ratifying this
and none other to be my Last will and testament where of I hereto
set my hand and seal this sixth day of January - A.D. 1881.

Signed, sealed, published, and declared by the aforegoing named
David N. Smith as for his last will and testament in our presence
who at his request in his presence and in his presence (repeated in
document) and in the presence of each other have hereto set our
hands as witnesses hereto.

In the orphans court, Queen Anne's County, Sept 9th 1890

Then came James R. Meredith, William F. Meredith, and John W.
_____ (unreadable) and made oath on the Holy Evangely of
Almighty God that they saw David N. Smith sign his name to the
foregoing will that they heard him publish pronounce and declare
the same to be his last will and testament that at the time of his so
doing he was to the best of their apprehensions of sound and
disposing mind, that they signed their names as witnesses to said
will in the presence of each other in the presence of the testator and
at his request.

Sworn before Finley Roberts

Register of Wills

In the orphans court, September 9th 1890

Then came David N. Smith Executor and custodian of said will and
made oath on the Holy Evangely of Almighty God that the
foregoing is the true whole last will and testament of said David N.
Smith deceased, and that he does not know of any other.
