October Term 1859 - Circuit Court


I, Robert Easley of Halifax County and State of Virginia do make this my last will and testament
as follows. 
I will that my executor shall sell of my property (except my negroes) and pay all of my debts 
and then divide all the remainder of my estate equally between my sons James S. Easley, John S. 
Easley, William Easley, Daniel B. Easley, the children of my son Doctor R.[Robert] and my 
daughters Dolly H. Vaden, Nancy Barksdale and the children of my daughter Sarah M. Barksdale- I 
have advanced to my son Charles S Easley and my daughter Maria A. Davis their full interest in 
my estate. The amount that may be coming to the children of my son Doctor R Easley I wish given 
in money instead of negroes; and should it become necessary to sell my negroes to effect a 
division I should prefer them bought by some of my legatees living in this state. The property 
or money that may fall to my daughter Nancy Barksdale I wish retained in the hand of my 
executor as trustee and her children the interest and profits to be paid to her annually and 
any part of the principle necessary for her support giving him the discretion of giving up the 
___ ____ money to her as he may think est for her interst. They property or money that may 
fallto my daughter Dolly H Vaden I wish given over to my son William Easley as trustee for her 
and her children the interest and profits to be paid to her annually and any part of the 
principle necessary for their support the whole to be given up to her if ehe should think her 
interest required it. Any advancement made by me after the date of this will shall be changed 
against the legatee in settlement with my executor. In settlement between my son William and my 
executor (or my son William's Estate) my executor is to charge him with one thousand dollars 
and covey to him the tract of land on which I now reside. Appoint my son James Easley executor 
of this my last will as witness my hand and seal this 28th day of September Eighteen hundred 
and fifty eight.

Codicil 

In addition to the foregoing will I further will and decree that in the division of my estate, 
and to prevent any seperation between two of my servants (Adam & Dolly now husband and wife) 
that they should be put into the parcel that fall to that of my son Wm Easley and in 
consideration of the kindness and attention he has shown me, and the love I bear him it is my 
will he the said Wm Easley should have the two above mentioned negroes (Adam & Dolly) upon the 
following terms. That they shall be valued at the appeasement of my other property, and Adam 
should be put in his lot or parcel, at his true valuation and Dolly be put in at one half her 
true valuation. In testimony thereof I hereunto set my hand and seal this 2nd day of October 
1858

At a circuit court continued and held for the county of Halifax on the 5th day of October1859 
the within last will and testament of Robert Easley dec with the codicil thereto was presented 
to court and proved by the oaths of two witnesses there to subscribed and ordered to be 
recorded and on the motion according to law and with Bird S Ferrell, James Young and William 
Wilson his securities ordered into and acknowledged a bond in the penalty of Thousand dollars 
conditioned according to law certificate is granted him for obtaining probate of the said will 
and due form. The securities having justified as to their sufficiency.

Know all men by these presents, that we James S. Easley, Bird S. Ferrell, James Young and 
William Wilson are held and firmly bound unto the commonwealth of Virginia, in the just and 
full sum of Twenty Thousand dollars to the payment where of well and truly to be made, we bind 
ourselves, and each of us, our and each of our heirs, executors and administrators jointly and 
severally, firmly by these present, sealed with our seals and dated this 5th day of October one 
thousand eight hundred and fifty nine.

The condition of the above obligation is such that if he and James S Easley executor of the 
last will and testament of Robert Easley dec shall faithfully perform the duties of the trust 
reposed in him by the said will, then the above obligation to be void, otherwise to remain in 
full force and virtue.

Halifax Circuit Court October term 1859 (5th) 
The written bond was entered into and acknowledged by Jas S Easley and Bird L. Ferrell, Jas 
Young and Wm Wilson his securities who justified to their sufficiency and was admitted to 
record according to law.
