The will of JOHN BENNETT deceased was duly proved in open court by the oath of 
JONATHAN TIPTON a subscribing witness thereto, recorded at this session in the 
following form to wit.
I JOHN BENNETT of the County of Buncombe and state of North Carolina being of 
sound mind and memory bless be God do this eighth day of February in the year 
of our lord 1831 make and publish this my last will in manner following that 
is to say first I give and bequeath unto my beloved wife SARAH all my cattle 
all my sheet and hogs all living stock of every kind this enduring her 
widowhood. how so if do marry then I want what she has not made use of to be 
devided equally with her and the children.  I give and bequeath the ISAAC 
STEVENS place to my son URIAH when he comes of age.  This tract of land that I 
now live on equally between rest of my children  also my corn and provisions 
and household furniture now on hand to the use of my wife and children.
I make my worthy brother ARCHIBALD BENNETT my executor in this my last will 
and testament.  I hereunto set my hand and seal in the presence of us the year 
and day first above written

A mortgage from ISIAH FRANKLIN to SAMUEL CALLOWAY,  JACOB CARPENTER,  
SAMUEL FRANKLIN & SAMUEL CARPENTER was produced in open court in the following 
words & figures to wit:
Know all men by these presence that I Isiah Franklin of the County of Yancey & 
State of North Carolina for and in consideration of the sum of sixteen in 
current money to me in hand by Samuel Calloway, Jacob Carpenter, Samuel 
Franklin, & Samuel Carpenter  all of the County and State aforesaid  the 
receipt where of I do hereby acknowledge have bargained sold and delivered and 
by these presence do bargain sell and deliver unto the said S. Calloway, J. 
Carpenter, S. Franklin, S. Carpenter their Estates, Administrators and assigns 
forever.  I the said Isiah Franklin for myself my executors & Administrators 
shall & will warrent & forever defend against all persons by these presents 
the said bargained premisis unto the said S. Calloway, Jacob Carpenter, S. 
Franklin & S. Carpenter their heirs Executors Administrators and assigns, 
provided never the less that if I the said Isiah Franklin, my heirs, 
administrators or Executor or assigns or any of us do or shall, will and 
hereby pay or cause to be paid unto the said Samuel Calloway, Jacob Carpenter, 
Samuel Franklin and Samuel Carpenter, their heirs administrators or assigns 
the sum of Sixteen dollars on the seventeeth day of April ____ ensuing the 
date here of with interest for the sum for redemption of said bargained 
premises then this bill of sale to be void  otherwise to remain in full force 
and ___  witness where of I have here into set my hand and seal this 17th day 
of April 1835.

A bill of Sale from ISAAC T. AVERY & the McDowell Administrators to SAMUEL 
BYRD in consideration of Four Hundred & Eleven dollars for three Negros was 
duly proved in open court by the oath of WILLIAM A. HENSLEY a subscribing 
witness thereto in the following words & ___  to wit:
1832 February the 22nd.  Received from SAMUEL BYRD of Buncombe County No. Ca.. 
a note of hand bearing date 21st February 1832 for four hundred and eleven 
dollars which when paid will be in full for the purchase of three Negro Slaves 
towit:  CELIA about thirty Six years old and one child about two years old 
named SARY and the other child about eight months old named BETSY.  Which said 
Negro Slaves we hereby warrent against the claim or claims of all persons what 
so ever laying claim to the same.  And we further warrant them to be salves 
for life & no further.

A written contract between LEVY BAILEY and MARY PEEK was duly proved in open 
court by the oath of W. C. BAILEY a subscribing witness thereto in the 
following words and figures to wit:  State of North Carolina, Yancey County.
Know all men by these presents that we LEVY BAILEY and MARY PEEK both of the 
county and State afore said have this day entered into the following 
Mortgage(towit).  
The said LEVY BAILEY agrees to enter into the Bonds of matrimoney with the 
said MARY PEEK and it is agreed that the said BAILEY have and enjoy all of his 
own property real and personal clear and free from the said MARY PEEK & her 
heirs forever and if the said BAILEY should decease leaving the said MARY PEEK 
living, the said MARY PEEK is not to have any of his property real or 
personal.  But the said MARY PEEK doth agree to relingush all her right to 
dowery and all other claims on the estate of the said LEVY BAILEY and the said 
LEVY BAILEY is to have and hold all of his own property as above entirely as 
his own and the said MARY PEEK is not during her life before or after his 
death to dispose of or have any part or interest therein.  And the said MARY 
PEEK is to have and enjoy all of her own property and effects wheather real or 
personal entirely disencumbered and from him the same LEVY BAILEY or his heirs 
forever in witness whereof we have hereunto set out hands & seals this 7th day 
of April 1835.
