Parish of West Feliciana Court of Probates Page 217.
Then came into open courts Adam Bingaman, John bingaman, Ann Ratliff
aided and assisted by her husband John Ratliff, Sarah Mulford aided and
assisted by her husband Clarence Mulford, and Catherine White, widow of
Washington White late of said Parish dec’d. by their attorneys Woodrouff
L.Dabnsy Esq. And filed filed their petition stating that Adam and John
Bingaman aforesaid are the brothers of the whole blood of Lewis Bingaman
late of said Parish dec’d. and your petition towit ________ Catherine
and Sarah are the sisters of whole blood of the said Lewis Bingaman dec’d.
That the said Lewis departed this life in the Parish aforesaid about
the 18th. Day of September AD 1825. Leaving a wife towit Elizabeth
Bingaman at __________ resident in the ________ of _________without any
descendants, also leaving a mother towit Sarah Bingaman a resident of
the Parish aforesaid, that the said Lewis left at his decease property
real and personal to the amount of nine or ten thousand dollars, as per
inventory. That your petitioners towit, Adam, John, ann, Sarah and
Catherine are the legal heirs of three fourths of the succession of said
Lewis, and their Mother Sarah aforesaid is entitled by inheirtance to
the remaining fourth part of said succession, that the proberty is of
a nature that cannot be conveniently devided in kind, and that in order
to a liquidation settlement and partition of the same between the Parties
interested; and also for the purpose of paying the debts of the
succession , a sale of the succession will be necessary. That Elizabeth
Bingaman the surviving wife has an interest in said property, and before
the amount of the estate can be asertained in order to a partition
Thereof between the coheirs aforesaid it is necessary that a settlement
of the community property be made between the said heirs collectively
and the said Elizabeth. That the said heirs are entlitled to claim from
the said estate that part of the same which was purchased with the
separate funds of the said Lewis towit the land and slaves and also
Dick a slave, given to the husband in his lifetime by his father
