Lenoir County, NC - Will of Thomas P. Hill, 1897

North Carolina - Lenoir Co.
I THOMAS P. HILL of the aforesaid County and State, being of sound
mind, but considering the uncertainty of my earthly existence, do make
and declare this my last will and testament: FIRST my executor,
hereinafter named, shall give my body a decent burial, suitable to the
wishes of my friends and rel-atives, and pay all funeral expenses,
together with all my just debts, out of the first money which may come
into his hands belonging to my estate.
SECOND, I give and devise to my beloved wife, SARAH C. HILL the tract
of land, on the south side of the A & N.C. R. Road (description of land
refers to ISAAC FIELDS line, WARTERS line, THOMAS DAWSON line) being
in Mosley Hall Township in aforesaid County being about seventy five
acres more or less for her natural life in satisfaction of her dower
and thirds in all my lands.
THIRD, I give to my sons THOMAS HILL & ALBERT HILL & NOAH HILL &
OFFIE BRYANT HILL & my daughters FANIE D. HARTSFIELD & HARIET E.
HILL the amount of one dollar each then all of my real estate to my
Daughter SUSAN and her husband FRANKLIN DAIL during their natural Life
then to my grand daughter ANNIE L. DAIL to have and to hold in fee
simple, in case of her the said ANNIE L. DAILS death without issue then
it is my will that the above named Lands shall be equally divided
between her sisters & Brothers being two Hundred and sixty seven acres
more or less in Mosley Hall Township Lenoir Co.
FOURTH, I give and bequeath to my said beloved wife one Bed and
furniture her choice all the kitchen furniture during her natural Life
and enough provis-ions to last her for one year.
FIFTH, I give and bequeath to my daughter SUSAN wife of FRANKLIN DAIL
all of my entire Personal property to hold and to have during her
natural life then to go to my grandaughter ANNIE L. DAIL consisting of
Three Beds and Kitchen furniture one sorrel filly about 2 years old one
black Horse, mule age about 12 years, one two horse waggon one cart,
six head of cattle and all of my Farming Implements and all of my Bees,
to have and to hold.
EIGHTH, My will and desire is that all the residue of my estate, if
any, after taking out the devises and legacies above mentioned, shall
be sold and the debts owing to me collected and if there should be any
surplus over and above the payments of debts expenses and legacies
that such surplus shall be given over to SUSAN wife of FRANKLIN DAIL to
have and to hold during her natural life then to go to her Daughter
ANNIE L. DAIL.
I hereby constitute and appoint my trusted friends JAMES A. PRIDGEN
and JOSHUA L. ROUSE my lawful executors to all intents and purposes
to execute this my last will and testament according to the true intent
and meaning of the same and every part and clause thereof hereby
revoking and declaring utterly void all other Wills and Testaments by
me heretofore made.
In witness hereof I the said THOMAS P. HILL do hereunto set my hand
and seal. This the 7th day October 1896

request and in his presence do subscribe
