Will Book 4, page 147
In the name of God, Amen. I Jeremiah W. Hylton of Patrick County,
Virginia being in perfect health and memory, do make and ordain this my
last will and testament.
First, I recommend my soul to God, who gave it, and my body to be
buried in a Christian manner at discretion of my executors.
I give to my son Jeremiah Hylton the place I bought of Burd Com__ in
Surry County, No. Carolinia with the stock of cattle, hogs, crops, corn
fodder, horses, a new wagon, bed and furniture with 2 negroes, Manual
and Frederick, and other things too tedious to mention, then I give to
my daughter Sophia, now the wife of George Overstreet, Thomas and Sarah
and Zinia and a tract of land in Bedford County with a beast and saddle
and stock, cotton, bed and other things too tedious to mention.
I give to John West that married my daughter Charlotte one dollar and
no more of my estate as she is dead. That is all I shall give him of my
estate.
I give to Cammillus King that married my daughter Sallie the place
whereon Wm Clifton now lives, which land I bought of Elijah Harris and
Wm Lee now sold to John Clifton, with 5 negroes Masia, Tilda, Pat,
Lezea & Lezea, the offspring of her body. Also one beast and saddle,
bed, cow and calf and other things too tedious to mention.
I give to my two sons, Valentine Hylton & George Hylton the land I
bought of James Penn, bounded by the Mayo river to be equally divided
between them, to make the division themselves. Also 8 negroes, John,
Henry, Su___ & her child Ruth, Anderson & Posse for the said Valentine
and George to divide themselves,with a bed and furniture to each of
them and some cattle & hogs they may divide to suit themselves as they
live together in their own right.
Then I give to Mary Ann my daughter, the land whereon Wm Shelton now
lives, which land I bought of Stephen Adkinson agreeable to the deed I
got from the said Adkinson. Also I give her Rachael, Mary, Mike and
Preston, which negroes I give to her with the increase of the said
negroes to her and the offspring of her body forever. Also one beast
and saddle, a bed and furniture, cow and calf and if either of my
children should die without issue, my will and desire is that the
property devised to them be equally divided between those that are
living.
Then I give to my two sons Gabriel Hylton and Augustus [Austin] Hylton,
my youngest sons the place whereon I now live, with the land I bought
of Alexander Jones & Richard Corn and Samuel Corn & Harston lying on
South side of the Mayo river to be equally divided between them. At the
death of their mother with except their mother thinks proper to let
them have it before her death, or marriage, but if she should marry,
then they are to have the land. I also give to my son Gabriel, Charles
and his wife Lettece, Silla and Jim, with the increase of the said
negroes, with one beast which he has got, with a bed and clothing to
said bed, one cow & calf, sow and pigs also.
I give to my son Augustus, Locky and her child Jules, Bit, Fortin
Rackals son. Bit is Aim__ daughter with a beast and saddle, worth fifty
dollars. But if either of my sons should die without issue, my will and
desire is what I have given them shall be divided between the rest of
my children then living.
I give to my daughter Nancy Jane my youngest child the place whereon
Enoch Wilson now lives, on Mill creek, the land I bought of James
Murphy adjoining lands of John France and others. Also I give her May,
Catherine her child & Solomon, her child and Senea. At the death of my
wife, Nancy Hylton, also my daughter Nancy Jane is to have the increase
of the said negroes from this date which negroes I gave to her and the
offspring of her body, but if she should die without issue, my will is
the property devised to her should be divided between those living.
Then I give to my wife Nancy Hylton, Fortin, Winey, Mat and Julus,
yeller Charles and Martin and Tucker and Margaret, Edmond Will and
Jean, to her during her life or widowhood, but if my wife Nancy Hylton
should marry or die, then the negroes devised to her with the increase
of said negroes shall be equally divided between the rest of my
children then living.
After my children has got what I have allotted them, the rest of my
stock and horses and cattle and hogs & household furniture I give to
Mary Ann Hylton and Gabriel Hylton and Nancy Jane Hylton, at the death
or marriage of my wife, and Augustine [sic] Hylton for the reason I
leave them the balance is because Gabriel Hylton and Augustine [sic]
Hylton to take care of after my decease.
I constitute my wife, Valentine Hylton, George Hylton and Gabriel
Hylton my extrs of this my last will and testament as signed, sealed
and delivered in the presence of revoking all former wills and
testaments by me made.

The last will and testament of Jeremiah Hylton, deceased, was presented
in court, proved and ordered to be recorded, & thereupon Valentine
Hylton and George W. Hylton, the executors therein named appeared in
court & having taken the oath required by law & entered unto and
acknowledged a bond in a penalty of twenty five thousand dollars,
conditions as the law directs with Clark Penn, Absolom Scales, Edward
Tatum & Pryer Tatum, their securities, certificate of administration is
granted them in due form of law.
