Will of Jonathan Hubbard, 1836 - Patrick Co. VA

Patrick County, VA will book 5 page 88

     In the name of God, Amen.  I, Jonathan Hubbard of the county of Patrick
and State of Virginia, being of sound and disposing mind and body, do make
this to be my last will and testament as follows, that is to say
     I desire that be buried at the discretion of my family and friends, and
that all my just debts be paid, if any.
     I give and bequeath to my beloved wife Mary Hubbard six hundred dollars
in money or solvent bonds, and bed and furniture, one chest, one desk, one
cupboard, and one third part of the remainder of my household and kitchen
furniture at her disposal forever.
     The land I now reside on she is to have during her natural life.
     I give and bequeath to my two daughters, Nancy and Annie a certain
portion of my lands, namely, one hundred and three acres bought of William
Ayres, also the land I now reside on after my wifs decease.  Also one hundred
acres known as the mill Tract, bought of Richard Booth, one hundred and twenty
five acres bought of Isaac Adams, to be divided between them as follows, to
wit;  Beginning at the mouth of the new Shop Branch on Jacks Creek, thence
crossing Gills Creek, a straight line to a Hickory Stump in Isaac Adams line.
Annie to have the upper half, and Nancy the lower half.  Also all surplus
money and bonds to be divded as they may choose, Also all my horses, hogs,
cattle, farming tools, black smith tools, still hogsheads and casks, all my
household and kitchen furniture and mechanics tools to be equally divided
between them if they can agree if not to be left to some respectable man.
     I give my Grand son Adron Anglin a tract of land containing one hundred
and thirty two acres known as the Johnson Place, with fourteen acres adjoining
the lands of James Taylor to remain in the hands of my two daughters Annie and
Nancy until he is twenty one years old and if he should die before that age
said land to divided between my three daughters,  Also one tract of land
containing sixty six acres to be equally divided between my said daughters
Nancy, Annie, and Elizabeth.
     I give my son Samuel Hubbard a still that he has in his possession.
     I give my five grand children, namely, Claiborn B. Hubbard, Stephen W.
Hubbard, Thomas Hubbard, Stella Hubbard, and James K. Hubbard one dollar each.
I give my son Jonathan Hubbard one dollar.
     I order that there be no appraisement of my property.
     And last I appoint my two daughters Annie and Nancy my executrixs of this
my last will and testament hereby revoking all former wills by me made.  In
witness whereof I have hereunto set my hand and seal the 18th day of January
1836.

by Jonathan Hubbard the testator in the
presence of of each of us and was at the
same time declared by him to be his last
will and testament and we at his request
signed our names hereto as attesting witnesses.

Patrick January Court 1836
     This last will and testament of Jonathan Hubbard deceased was exhibited
in court by John Hubbard one of the subscribing witnesses, who being sworn
proved the said will in part, and the same is continued until the next court
for further proof.

February Patrick County Court 1836
     A writing purporting to be the last will and testament of Jonathan
Hubbard decd bearing date on the 18th day of January 1836, was this day again
produced in court by Mary Hubbard, Annie & Nancy Hubbard in order to be
proved, and thereupon William Pendleton and Elizabeth his wife appeared and
opposed the proof of the will whereupon divers of witnesses were sworn and
examined, and the parties aforesaid by their counsel fully heard an
consideration whereof the court is of opinion that the said Jonathan Hubbard
deceased at the time of making the said will, dated the 18th day of January
1836, was of sound disposing memory and mind, and that he was under no undue
influence and William Lee, John Hubbard, and Ben Hubbard the subscribing
witnesses to said will having testified in court that the said Jonathan 
Hubbard signed and published the same in their presence, as and for his last 
will and testament and that they subscribed their names as witnesses thereto 
in the presence of the said testator and at his request, and that the said 
testator was of sound sence and memory as far as they new or believed, it is 
therefore ordered that the said writing of the 18th day of January 1836 be 
recorded as the last will and testament of the said Jonathan Hubbard deceased, 
whereupon on motion of Annie Hubbard one of the Executrixs named in the will 
of the said Jonathan Hubbard decd who made oath thereto, and together with 
William Lee, John Tuggle, Elisha Anglin, and Abram Adams her securities 
entered into & acknowledged a bond in the penalty of $10,000 conditioned as 
the law directs: certificate is granted the said Annie Hubbard for obtaining 
letters of administration on the decedants estate with his will in due form.
