TUDOR TO WARD DEED OF TRUST (1850)
Recorded in Deed Book 13, Page 456, Patrick County, Virginia
THIS INDENTURE made and entered into this 23rd day of February 1850 between
William Tudor of the first part, Benjamin T. Ward of the second part and
Hardin W. Reynolds of the third part, all of the County of Patrick and State
of Virginia: Witnesseth That whereas the above named William Tudor is the
undertaker of the building of a Meeting House called the Centre Meeting House
Baptist Church, for which the said Tudor is to have One hundred and Ninety
nine and fifty cents, for the building said House. When the work is
completed, and the said Tudor not having completed the work as yet and being
in want of some money agrees to give the said Reynolds an order on the
Trustees of the same Meeting House, for the sum of One hundred dollars for
which the said Reynolds pays him the sum of One hundred dollars, the receipt
of which is hereby acknowledged before the signing of these presents, and the
said William Tudor being desirous (in case the said Reynolds should fail to
collect the above named sum of One Hundred Dollars by the first day of May
next) to secure to the said Reynolds, the above named sum of One hundred
dollars or any part thereof that may remain unpaid on the 1st day of May
next, do hereby for and in consideration of the sum of One dollar to him in
hand paid by the said Benjamin T. Ward the receipt whereof is hereby
acknowledged hath bargained and sold and by these presents doth convey unto
the said Benjamin T. Ward the following property to wit: 1 yoke of oxen, 1 ox
cart, 7 head of cattle, 5 head of sheep, stock of hogs supposed to be about
40 head, 2 stills, plantation tools, the ensuing of this year consisting of
corn, fodder, wheat, oats and tobacco, also the tract of land on which I now
live supposed to be two hundred and thirty six acres, it being the land I,
the said Tudor, bought of Elisha Anglin, for which I hold a title bond. In
trust nevertheless if the above named Hardin W. Reynolds shall receive the
above named sum of One Hundred Dollars at the time above named; Then the
obligation to be null and void - but if not, then the above named Benjamin T.
Ward shall at the request of the said Hardin W. Reynolds or his assigns,
after giving ten days notice at, at least two public places, priced to sell
for the highest bidder for cash, the above named property or so much thereof
as may be sufficient to pay the balance that may remain unpaid of the order
abovenamed together with all cost attending such sale, the said Tudor binds
himself to pay all cost attending the recording of this deed.
