Nowlin/Sharp Deed of Trust, 1829

THIS INDENTURE made and entered into this twentieth day of January in the 
year of Christ One thousand eight hundred and twenty-nine between William 
Nowlin of the first part Samuel Sharp of the second part and John Jones of 
the third part, whereas the William Nowlin has this day executed two bonds 
to the said John Jones one for fifty dollars payable 25th day of December 
next, and the other bond for Sixty dollars payable 25 day of December 1830 
the payment of the said bonds the said Nowlin is desirous of securing to the
said John Jones his heirs etc.  Now therefore this Indenture Witnesseth that
the said Nowlin for and in Consideration of the premises and for the further
Consideration of the sum of One dollar to him in hand paid by Saml. Sharp 
the receipt whereof is hereby acknowledged, has granted, bargained, sold, 
aliend enfeoffed and Confirmed and by these presents does grant, bargain, 
sell, alien enfeoff and Confirm to the said Samuel Sharp his heirs & 
executors one Certain piece or parcel of Land lying in the County of Patrick
Containing one hundred acres be the same more or less being the tract of 
Land on which said Nowlin now resides and bounded as follows to wit by 
bounded on the south by the lands of M. Sandefur and on the west by the land
of Robert Rowan and Wm. Boaz and on the east by the Lands of Wm. Keaton __? 
and James Nowlin decd. it being the tract sold by Wm. Clark to Claiborne 
Bunderant.  To Have and to hold the same with all its appurtenances to the 
only use behalf and benefit of him the said Saml. Sharp his heirs etc. 
forever from the Claims of all persons whatsoever in fee simple forever.  
Upon trust nevertheless that the said Saml. Sharp his heirs etc. shall 
permit the said Nowlin to hold and enjoy the said Land and its profits 
until the 25th of December 1830 and upon this further trust that if the 
said hundred and ten dollars shall not be paid on the time before mentioned 
that then the said Saml. Sharp shall proceed to sell the same for Cash to 
the highest bidder having first given ten days notice of the time and place 
of selling the same and out of the proceeds thereof shall pay the said Jones
 his debt aforesaid having first deducted all expenses attending the 
recording and executing the provisions of this deed and the residue after 
the payments aforesaid if any shall pay over to the said Nowlin or to his 
legal representative.  But if the said Nowlin shall pay the said Jones his 
debt and charges of this deed on the 25th of December 1830 then this deed to
be void.  In witness of the premises the parties have set their hands and 
seals this day and date aforesaid.

        This deed of Trust from William Nowlin and Saml. Sharp Trustee to 
John Jones with the certificate thereon endorsed was exhibited in Court 
examined and ordered to be recorded.
