Trust Deed of Stephen McMillion to Richard Haynes,
Patrick County, Virginia, 1838
This Indenture made and entered into this 22 day of May 1838, Stephen
McMillion of the County of Patrick of the one part, Richard Haynes of the 2nd
part and John Branson of the 3rd part; Witnesseth that the said McMillion
stands fully indebted to the said John Branson in the sum of three hundred
dollars due by bond bearing date the 18th day of October 1837, payable
eighteen months after date, which said debt the said McMillion is willing and
desires to secure note. This indenture, Witnesseth, that for and in
consideration of the promised note for the further consideration of one
dollar to the above named McMillion in hand paid by the above named Richard
Haynes, the receipt whereof is hereby acknowledged. The said McMillion hath
bargained and sold and so by these presents bargains and sells unto the said
Richard Haynes one certain tract of land lying in the County of Patrick on
the headwaters of Loving's Creek containing one hundred acres more or less,
whence said McMillion now lives, also five head of cattle, two horse beasts,
two rifle guns, household and kitchen furniture, nineteen bee stands, and
fifty head of hogs, to have and to hold the aforesaid land and other property
to the only use and benefit of the said Richard Haynes upon special trust,
nevertheless that if the said McMillion shall fail to pay to the said Branson
the debt above mentioned or any part thereof on or by the 10th day of May
1839, and also the costs incident to this deed, then in that case the said
Richard Haynes shall whenever required by the said John Branson, sell the
land and property above mentioned or so much as will pay the said debt and
cost after accounting, the same time and place of date at least ten days for
ready money one out of the sale thereof pay the above named debt and cost and
the balance if any pay over to the McMillion, but if the said McMillion shall
on or by the 10th day of May 1839 pay off the debt aforesaid and cost, then
and in that case, This obligation is null and void.

This trust deed from Stephen McMillion to Richard Haynes trustee for the
benefit of John Branson so as presented in court, acknowledged by all the
parties to be their note and deed & admitted to record.

Notes
Note (1) Stephen McMillian is the son of Abraham and Elizabeth McMillian, and
married to Martha Blansett.
Note (2) Richard Haynes is the husband of Mary Haynes. They are the parents
of Lieutenant Colonel Alexander Haynes, of Company E, of the 29th Virginia
Infantry, who died in 1864 as a result of wounds at Drewery's Bluff, Virginia.
