Dodson/Sharp Deed of Trust, 1833

Date: 1 February 1833

     This Indenture made this 1st day of February in the year of our Lord 
1833 between Milton R. Dodson of the County of Patrick and State of Virginia
of the first part Thomas J. Penn __ of the same county and State of the 
second part and Samuel Sharp Trustee of the third part Witnesseth that the 
said Milton R. Dodson for the special purpose of securing the payment of the
sum of one hundred and forty five dollars and twelve cents due the said T. 
J. Penn by note, and also the sum [blank] dollars and [blank] cents due the 
said Penn on account, and for the further consideration of the sum of one 
dollar to him in hand paid by the said Saml Sharp trustee, the receipt 
whereof is hereby acknowledged hath granted bargained and sold and by these 
presents doth grant bargain and sell unto the said Saml. Sharp trustee the 
following property to wit, one negro boy Phill, ten or eleven years old, one
bay mare six years old, twelve head of hogs of different sizes marked with a
slit in the end of each ear, one black cow 1 calf, and the future increase 
of the hogs and cow.  To have and to hold the above granted property to the 
only use behoof and benefit of him the said Saml Sharp and his heirs forever, 
and the said Milton R. Dodson doth covenant and agree to and with the said 
Saml Sharp and his heirs that he will forever oblige himself to guarantee a 
good title to the above mentioned property, in trust nevertheless that if 
the said M. R. Dodson shall well and truly pay or cause to be paid unto the 
said T. J. Penn __ the aforesaid sum of one hundred and forty five dollars &
twelve cents with the interest that may accru thereon together with the cost
of recording this Indenture, on or before the 1st day of July next then this
deed shall be void and of no effect.  But if he shall fail to pay the said 
sum of money with interest and costs aforesaid then the said Saml Sharp doth
oblige himself when ever thereto required by the said Thomas J. Penn __ to 
sell the above mentioned property to the highest bidder for ready money 
previously advertising the time and place of sale at Patrick Courthouse and 
at some public place near the premises at least ten days, and out of the 
proceeds thereof first pay the said Thos. J. Penn the aforesaid sum of money
with the Interest due thereon and the cost of recording and carrying into 
effect the deed and the surplus of any pay to the said Dodson or his legal 
representative.  In testimony whereof the said M. R. Dodson, Thos. J Penn 
__ and Saml Sharp hath hereunto set there hands and affixed their seals the 
day and year above written.

          This deed of Trust from Milton R. Dodson and Saml. Sharp trustee 
to Thos. J. Penn __ with the certificate of acknowledgement thereon endorsed
was presented in court examined and ordered to be recorded.
