This Deed made the 15th day of July in the year 1856. Between Benjamin Frashure 
of the  one part and Rufus Turner  of the other part.  
Witnesseth; that the said Benjamin Frashure doth grant unto the said Rufus 
Turner the following property, to wit: 

The following real estate; One  tract of land containing one hundred and thirty 
three acres more or less and known as the  "Yellow Sulphur Springs Tract" and 
the appurtenances there unto belonging, and another containing one hundred 
thirty three and one quarter acres, more or less and known as the  "Hancock 
Tract", with all of it's appurtenances thereunto belonging, both of which said  
tracts of land and situated in the County of Patrick and State of VA.  

Also the following personal property, to wit; Six slaves, namely, Jerry, Hages, 
Jordan, Mary,  Pinkney and Martha with the increase of said slaves. All of my 
leaf and manufactured tobacco. Supposed to be seventeen or eighteen thousand 
pounds; all of my interest right or claim in the  estate of George Gunter 
deceased. It being the share or interest of one (?legativeI), which share  was 
purchased by the grantor of Hanson Gunter one of the Heirs of said George 
Gunter dec'd. 

The following debts due to this Grantor in the states of Georgia and Alabama to 
wit:
One due on E.A. Sledge for the sum of eleven hundred dollars or thereabouts, 
One on James M. Clough for the sum of eight hundred and twenty five dollars or 
thereabout. 
One on John Jones for the sum of one hundred and twenty five dollars or 
thereabouts. 
One on James B. & William Lou for the sum of one hundred and seventy five 
dollars or thereabouts. 
One on W. J. Harris & as for the sum of six hundred and fifty dollars or 
thereabouts, and (?Sundry?)  other debts due on other persons in said States of 
Georgia and Alabama to the amount of Eleven hundred and seventy dollars or 
thereabouts. They being all of the debts due to said grantor in the said 
States, a portion of the above  mentioned debts are not considered solvent. 
Three head of horses,  five milk cows, five calves, three work oxen and two 
yearlings, my stock of hogs, with the increases of said stock. About forty in 
number. Three wagons & harness, one oxcart, one set of Blacksmith tools. All of 
the fixtures belonging to my tobacco factory, whether at said tobacco factory 
or elsewhere, a stock of beer. The present growing crop of every description, 
upon the premises of the grantor. Eight beds, bedsteads and furniture together 
with all the rest of my household and kitchen furniture and plantation tools of 
every description, all of the lumber, glass and nails and paint upon the 
premises of the grantor. One gold watch, one rife gun, one Still and fixtures, 
three or four hundred pounds of iron, one lot of carpenter tools, all of this 
year's crop of small grain that has been (?). All of the corn and bacon now in 
the possession of the said grantor. One side saddle and three men's saddles, 
one set of Ally Balls and Pins.  And all the debts due me in the state of 
Virginia from William A Burwell and others.

In trust to secure the following debts and (?).  The following securities; One 
debt due the firm of  P.A.- J.G. Lee and Edwards, for the sum of eight hundred 
and ninety two dollars and eighty  seven cents. , being dated the 12th day of 
July 1850 and payable one day after date. One other bond due the aforesaid firm 
for (?) hundred and fifty six and thirty five cents dated 12th day of July 1856 
and payable one day after date. The last mentioned bond is subject to amount of 
one dollar and twenty seven cents.

One bond due the firm of Aldridge and Lee for the sum of one hundred and 
seventeen dollars and sixty six cents, dated the 12th day of July 1856, and 
payable one day after date. One bon due the firm of PA & JG Lee for the sum of 
thirty two dollars dated  the 12th day of July (?) and payable one day after 
date. 

One bond due the firm of  PA & J G Lee and Edwards for the sum of fifty 
dollars, dated 15th day of July 1856 and bearing interest one day after date.

A balance of a bond due to John Rangeley & Co., for one hundred and fifty 
dollars due 1st day of 
May (1856?)  The original bond (?co?) for eight hundred and fifty dollars & 
thirty nine cents which bond is (?credited) by a Negro woman and child and 
sundry other payments leaving the aforesaid balance of one hundred and fifty 
dollars or thereabouts. 
One bond due Haman Critz Sr., for the sum of one hundred & eleven dollars, 
dated 15th day ofJuly (1852).  And due one day after date. 
One bond due Richard Joyce  for the sum of one hundred and forty seven dollars 
and sixty eight cents, due the 1st day of January (1855). 
One bond due John B Payne for the sum of one hundred and forty two dollars and 
thirty cents, dated the 12 day of July 1853, and payable one day after date.
One bond due James Joyce for the sum of forty two dollars, due the 26th day of 
January 1852.
One debt due to Morris &  W. Bradley for the sum of twenty nine dollars and 
forty cents, money collected for said Bradley in the south last winter and not 
paid over.
One bond due the firm of Burton Hamlin & Co., for the sum of eighty dollars or 
thereabouts, the date of said bond not (?containing  uncollected?). 
One bond due to Thomas J. Penn for the sum of  three hundred and thirty dollars 
and ninety five cents, dated the 18th day of March 1856, and due the  first day 
of July 1858. This bond is subject to a credit of Thirty dollars and ninety 
five scents. 
One bond due to the said Thomas J. Penn for the sum of four hundred and sixty 
nine dollars and sixty two cents, dated 2nd November 1854, and due the 1st day 
of January (1855?).
And one for one hundred dollars paid 27th May 1858. And also a credit bearing 
date with the bond of two dollars seventy two cents.
One bond due G. B. Nichols for the sum of one hundred and eighty one dollars 
and fifty cents, dated 15th day of June (?1852/1855?) and payable one day after 
dated and assigned to P.P. Penn.
This bond is subject to a credit of one hundred and six dollars and fifty nine 
cents paid 25th day of October 1855.
One bond due William W. Gray for the sum of three hundred and twenty five 
dollars dated 15th day of July 1856. And due one day after date. 
One bond due James Nowlin for the sum of forty five dollars and eighty two 
cents, dated the 9th day of November 1855 and payable one day after dated, this 
bond is subject to a  credit of 
 __________dollars and ________cents, paid the ________day of _______18___(?)

The following on the securities to be identified  by this Deed of Trust to Wit: 
Peter A Lee, Hamon Critz and Crawford Turner, Securities to a bond executed to 
George (?C. Hylton?)  agent or attorney in fact for the Heirs of Washington 
Thomas, dec'd. by the said Benjamin Frashure with the securities aforesaid for 
the sum of Twelve hundred and eighty six dollars dated January 1856 and due 
January 1857. 

Asa Wood, Crawford Turner and Peter A. Lee securities to a bond executed to 
George W Hylton agent or attorney in fact for the heirs of Washington Thomas 
due by the said Benjamin Frashure with the securities aforesaid for the sum of 
six hundred and thirty one dollars, dated the __day of January  (?1858).
The bonds that the securities are intended to be (?indemnified) for exchange 
with the said Frashure   are present, but, they are the only bond executed by 
the said Frashure with the said securities to the said Hylton and the 
description of said bond is believed to be correct.  

William Critz Jr and Crawford Turner securities to a negotiable note payable to 
Pass, McCurdy & Co., in one of the banks at Dannville, Virginia for the sum of 
Two hundred and eighteen dollars, executed by the said Benjamin Frashure with 
William Critz Jr & Crawford Turner his securities, and payable the first of 
January 1857.  

Peter A. Lee & A T Edwards, securities to Jacob Clark for a bond for the sum of 
nine hundred dollars executed by the said Benjamin Frashure with the said 
securities to the said Jacob Clark, 

Hamon Critz and Allan T. Edwards securities to James H. Clark for a bond for 
the sum of Three hundred-----*end of page 398

and sixty dollars executed by said Benjamin Frashure with the said securities 
to the said James H Clark,  

George W. Clark & James Nowlin securities to a bond executed to William Critz 
administrator of Haman Critz, dec'd. by Benjamin Frashure with the securities 
aforesaid for the sum of five hundred and one dollars dated the 20th day of  
October 1858 and payable nine months after date. This bond is subject to three 
credits to wit: 
One for three hundred dollars paid 23rd April 1853.
One for One hundred dollars paid 17th December 1855 and also one for fifty 
dollars paid 2nd June 1857.  

Peter A Lee security to a Bond executed to Fleming Reynolds by Benjamin 
Frashure with the said security for the sum of one hundred and ten dollars and 
sixty four cents, due the 25th day of December 1855.  

Peter A Lee security to a bond executed to Andrew J. Spencer by  Benjamin 
Frashure  with the said security for the sum of seventy dollars or thereabouts 
the date of the said bond not collected.  

Peter A. Lee Security to a bond executed to Joseph (France?) by Benjamin 
Frashure with said bank for the sum of fifty dollars dated  25th day of August 
1855 and payable the 25th day of December 1855.  This bond is subject to a sum 
credit of twenty dollars  paid the 26th day of May 1856.  

Haman Critz security to a bond executed to H.W. Reynolds with said Critz 
Security for the sum of Three hundred and forty  some dollars. And one (?) 
dated 29th day of November 1852 and  payable one day after dated. 

Haman Critz security to a bond executed to (?Perin) Joyce by  Benjamin Frashure 
with said Critz security for the sum of one hundred dollars the date of the 
bond not recollected.  This bond is subject to a credit of fifty dollars paid 
sometime in the year 1855. 

Haman Critz security to a Bond executed this Firm  of Penn & Clark by Benjamin 
Frashure with said Critz as security for the sum of one hundred  and seven 
dollars  dated the 15th day of July 1856;  and payable one day after dated.  

A. Staples JR secured  to an Injunction bond executed to Robert (Daloss?) by 
Benjamin Frashure with said Staples as his security in the (?presently) of six 
hundred dollars dated the 10th day of May 1854, which said injunction bond was 
conditioned according to law and granted by the Judge of  the circuit Court of 
Patrick County to exhibit and restrain all further  proceedings on a payment of 
the County Court of Patrick rendered it to the February term 1853, of the said 
court in the name of Robert Deloss, Plaintiff, against Benjamin Frashure, 
Defendant. The among of which  said Judgement with the interest as claimed and 
the several Credits thereon will more fully appear from the records of the said 
County Court of Patrick..  

Haman Critz security on a bond executed  to Madison (?T/J) (?Cruth), Trustee 
for Adaline ?Smyth/Smith) by Benjamin Frashure with said Critz as security for 
the sum of Twenty eight dollars, dated  the 1st of March 1852, and due the 1st 
day of October 1856.

Brice M. Frashure, Peter A Lee, Allen J. Edwards, Haman Critz, and Joseph 
Bishop securities in a delivery Bond given to John A Mitchell, upon which 
delivery Bond Judgement has been given and in execution  expired and now in the 
hand of the Sheriff of Patrick County.  The unsatisfied  portion of that which 
is two hundred thirty dollars or thereabouts.

Haman Critz security  to a bond executed to John G Lee executor of  John (?
France) dec'd, by Benjamin Frashure with the said Critz a security for the sum 
of thirty dollars or thereabouts , dated the ----day of November 1852 and 
payable twelve months after date. This bond is subject to a credit of twenty 
dollars paid 23rd June 1856 and also one debt (omitted), in the beginning, due 
to the firm of  PA & JG Lee for the sum of one hundred dollars bearing interest 
from the first of January 1857. 

And it is distinctly understood and agreed by the parties to the Deed that the -

creditors  secured and securities indemnified and to share  (?rateably) in the 
proceeds of the property conveyed according to the debts and the conditions or 
the liabilities contracted by the securities and it is further understood and 
agreed by the parties to this and that the following debts and to be secured 
and placed upon the same footing in every respect  with the debts and 
securities above mentioned to Wit; 

A balance due on a bond (?executed) by Benjamin Frashure to George Dillard & 
Davis H Spencer for sixty dollars  or thereabouts,  the original  amount of 
said bond not now recollected.  The said bond was executed abut 1852-53.  It 
being the only bond that said Dillard & Spencer holds against said Frashure. 

A debt due Martin S. Spencer for the sum of sixty five dollars it being the 
balance due on a bond which said Spencer holds against said Benjamin Frashure, 
said bond being due the ---day of March 1856.  And a debt due Asa Wood for the 
sum of eighty eight dollars or thereabouts  due the ---day of March 1856.

Now if the said Benjamin Frashure shall well and timely pay all of the debts 
aforesaid due  and bearing interest as aforesaid indemnify the  securities 
aforesaid and also pay the costs of recording this deed on or before the 15th 
day of June 1857.  Then this deed of Trust shall be void, otherwise to remain 
in full force and virtue.

This Trust Deed from Ben Frashure to Peter A Lee and others was exhibited in 
said office acknowledge and admitted to record.
