Viriginia Fulkerson Frashure through P.A. Lee, Trustee;
Dower Assignment Deed
Benjamin Frashure;

This Deed, made the 12th day of November 1856 between Benjamin Frashure of the 
one part, and Virginia Frashure, wife of the said Benjamin Frashure and Peter A 
Lee, Trustee, of the second part. Witness; that whereas the said Benj Frashure 
having heretofore become greatly in debt and having executed deeds of Trust to 
Rufus Turner, for the purpose of securing this just debt  and in said deeds the 
said Virginia his wife, not having assigned her dower interest to the said 
trustee in a certain tract of land therein conveyed, therefore in consideration 
of the promises, the said Benjamin Frashure covenant and agrees to and with the 
said Peter A Lee, trustee, for the said Virginia Frashure and also with the 
said Virginia that he will pay to the said Peter A Lee for the benefit of the 
said Virginia all of one third of the proceeds and remainder of all personal 
and real property after paying of his said debts. If any shall remain after the 
satisfaction of said deeds of trust and other just claims, now (?awaiting) 
against him, and also one third of all solvent bonds, notes or other security 
of debts now existing and solvent at this date which shall remain after 
satisfaction of said debts now against the said Benjamin Frashure, and the said 
Benjamin Frashure binds himself to pay over to the said trustee the above 
property, or money or bonds immediately after the sale herein is completed or 
as soon as  it can be  conveniently done.  
The said Benjamin Frashure further covenants to and with the said trustee to 
pay him one third of the proceeds of all debts or evidence of debts now in his 
hands not deemed solvent when they may be here after realized.  
The said property hereby conveyed to before from all control whatever of the 
said Benjamin by virtue of his marital or other rights to be at the full and 
firm control of the said Virginia as if she  were a (? feme- sole). 
The said Benjamin further covenants with the said trustee that the said 
Virginia is to have possession and control of all her infant children that are 
now under the age of  twenty one years, and he further covenants that he will 
not interrupt,  molest or in any other manner what ever interfere with the 
rights and privileges herein granted. And the said Peter A Lee & the said 
Virginia Frashure in consideration of the previous covenant to and with the 
said Benjamin to convey to the purchaser or purchasers of all lands to which 
the said Frashure is now entitled or any one for his benefit, all right and 
title to dower or any other interest which she has or may hereafter have in the 
same as wife of the said Benjamin. In testimony where of the said parties have 
hereunto set their hands and affixed their seals, this day and year above 
written.

Patrick County, to Wit;
We Rueben Zigler and W Critz Jr, Justice of the Peace for said County do 
certify that the said Benjamin Frashure, Virginia Frasure and Peter A Lee 
parties whose names are signed to the above writing bearing date on the 12th  
November 1856 has acknowledged the same before me to be their acts and deeds 
and desire us to certify the same to the Clerk of our Court in order that the 
same may be recorded. Given under our hands and seals, this 12th day of 
November 1856.

Patrick County to wit;
We, Wm. Critz and Rueben Zigler, Justices of the Peace for the County 
aforesaid, do humbly certify that Virginia Frashure the wife of Benjamin 
Frashure, parties to the within deed, personally appeared before us, and having 
the same fully explained to her and having been by us examined privately and 
apart from her husband, acknowledges that she has willingly signed sealed and 
delivered the same and did not wish to retract it, desired us to certify the 
same to the Clerk of the County Court in order that the same may be recorded. 
Given under our hands and seals this 12th day of November 1856.
