Parcel of Land in the Smith River District

 Purchase of Land at Foreclosure Sale

 Deed Book 26, Page 505

 Patrick County Circuit Court Clerk's Office, Stuart, VA


 Whereas William C. Lackey and Martha J., his wife conveyed by trust deed dated 
30 May 1883 and recorded in Book 23, Page 454, the land herein after described 
to John Pendleton, Trustee, to secure to James P. Martin the payment of $230 
with interest as therein specified, and whereas said Lackey and wife made 
default in the conditions of said deed and the said trustee was required to sell 
said land to satisfy said debt and after due notice posted at various places in 
the neighborhood exposed on the premises, the land conveyed to him as trustee, 
for sale to the highest bidder for cash sufficient to pay the costs attending 
the execution of said trust and the remainder on a credit of six, twelve, and 
eighteen months, and whereas at said sale Wade A. Emberson being the last and 
highest bidder became the purchaser at the price of four hundred dollars and 
whereas the whole of the purchase money has been paid by said Emberson and W.A. 
Via to said trustee who in turn paid the debt of said James Martin and the 
residue to said W.A. Via under a garnishee issued out by him before H.H. Hall, 
J.P. Now therefore this deed made the 8th day of April, 1893, between John 
Pendleton trustee as aforesaid of the first part and Wade A. Emberson and 
William A. Via of the second part.  Witnesseth, that said first party in 
consideration of the promises and the payment to him of said purchase money to 
wit $400 doth grant and convey, with special warranty, to said second parties 
all that piece or parcel of land convey in said trust deed lying on Puppy Creek 
in Patrick County and bounded as follows:  Beginning at a hickory on said creek, 
above the mill,thence down said creek as it meanders to the mouth of a small 
branch, thence up said branch as it meanders to bushes on the north side of said 
branch, thence a straight line a S.W. course to the beginning.

                     Virginia, Patrick County to wit:  I, William D. Moir deputy 
for L.G. Rucker Clerk of Patrick County Court in the state of Virginia, do 
certify that John Pendleton, Trustee whose name is signed to the foregoing 
writing bearing date on the 8th day of April, 1893, has acknowledged the same 
before me in my said County, And the tax thereon being paid the same is admitted 
to record,
