1934 Deed - J.R. Hill to Roscoe F. Hill
NORTH CAROLINA, LENOIR COUNTY
THIS DEED made this the 29th day of December, 1934, by J.R. Hill (single),
party of the first part, to Roscoe F. Hill, party of the second part, both of
the above named parties being of the State and County aforesaid, WITNESSETH:
THAT WHEREAS the said Roscoe F. Hill and J.R. Hill are seized as tenants
in common, share and share alike, of three certain tracts of land containing
116 acres, more or less, devised to them under the Will of their father, F.D.
Hill, deceased, which duly appears of record in the office of the Clerk of the
Superior Court of Lenoir County in Book of Wills D, Page 408; and whereas they
have caused to be made a survey of said lands for the purpose of making a
partition thereof between them to the end that each may hold his share in said
lands in severalty, and the said first party now desires to convey and
quitclaim to the said second party all of his right, title, interest, estate,
and property to the hereinafter described tract of land, the same being the
share of the said second party in the agreed partition between them.
NOW, THEREFORE, the said first party for and in consideration of the
premises and of the sum of $10.00 to him in hand paid by the said second
party, the receipt of which is hereby duly acknowledged, has bargained, sold,
conveyed, and quitclaimed, and by these presents does hereby bargain, sell,
convey, and quitclaim to and unto the said second party, his heirs, assigns,
and legal representative in fee simple forever, all of his right, title,
interest, estate, and property in and to that certain parcel or tract of land
situate in Institute Township, Lenoir County, North Carolina, and more
particularly bounded and described as follows:
BEGINNING at an iron stake on the West bank of the run of Wheat Swamp,
Garfield Gregory's corner, and runs thence with Garfield Gregory's line S 75-0
W 1760.0 ft. to the center line of the Hull Road; thence with the center line
of the Hull Road S 50-0 E 385.0 ft.; thence S 19-0 E 210.0 ft.; thence
leaving the road S 82-0 W 937.0 ft. to an iron stake, another corner of
Garfield Gregory; thence N 43 0 W 891.0 ft. to an iron stake near the Duck
Pond; thence N 73-45 E 940 ft. to the head of a ditch; thence with the center
of this ditch the following courses: N 82-30 E 137.0 ft; S 56-45 E 140.0 ft; S
81-0 E 370.0 ft; N 85E 500.0 ft.; thence N 80-0 E 280.0 ft. to an iron stake
on the West bank of the run of Wheat Swamp; thence up the run of Wheat Swamp
to the beginning, containing 57.0 acres, more or less. The magnetic bearings
in this description are as of 1934. And being a portion of the lands devised
to J.R. Hill and Roscoe F. Hill under the Will of F.D. Hill, deceased, which
duly appears of record in the office of the Clerk of the Superior Court of
Lenoir County in Book of Wills D, page 408, to which record reference is here
made.
TO HAVE AND TO HOLD the above conveyed lands and premises, together with
all rights, privileges, and appurtenances thereunto in any wise appertaining
and belonging unto the said second party, his heirs, assigns, and legal
representatives in fee simple forever, to his and to their only use and behoof.
IN TESTIMONY WHEREOF, the said first party has hereunto set his hand
affixed his seal this the day and year first above written.

I, Grace Spencer, Notary Public, do hereby certify that J.R. Hill
(single), grantor above named, personally appeared before me this day and
acknowledged the due execution of the foregoing deed for the purposes therein
expressed.
