NOTE: In the signature of Conrad Stultz the O becomes an U. Some of the
first letters of various words appear to start with an uppercase letter and have
been trans-cribed as they appear. If a word was unreadable or not in current
use, a question mark was inserted at the end of the word and a few question
marks have been inserted to indicate a missing or unreadable word. This will

In the name of God, Amen, I Conrad Stultz of Carroll County and the State of
Maryland being weak in body, but of sound and disposing mind memory and
understanding, considering the certainty of death and the uncertainty of the
time thereof and being desirous to settle my worldly affairs and thereby be the
better prepared to leave this world when it shall please God to call me hence do
therefore make and publish this my last will and testament, In the manner and
form following. First and principally I commit my soul into the hands of
Almighty God and my body to the earth to be decently buried at the discretion of
my executors herein after named and as to what worldly estate and goods it has
pleased God to bless me with I give devise and dispose of in the following
manner that is to say.
I give and bequeath unto my wife Mary Stultz, one chest of drawers one corner
cupboard, one tin plate stove and pipe, one horse two cows two hogs, two
feather beds bedsteads and bedding as many pots kettles and kitching furniture
such as she may think proper to chouse, and as much bread and meat as will
support her for one year from the date of my death.
Then ??? I give and bequeath unto my daughter Hanna Stultz one feather bed
bedstead and bedding, one cow, one spin wheel, one beureau and all the furniture
that she bought and is now in my house.
Then ??? I give and bequeath unto my grand daughter Mary Jain Rempsy [?] one
feather
bed bedstead and bedding one spining wheel and one beureau. It is my will and I
do hereby order and direct that my executors sell all my real estate and the
balance of my personal estate as soon as convenent after my death the real
estate to be sold in as many parcels as they may think will be the most
advantage to all partys interested, and to collect all my outstanding debts due
or becoming due and the money arising therefrom after
paying of all my just debt and funeral exppences, the balance of the money shall
be disposed of in the following manner that is to say My executors shall place
one third of the full sum upon interest and the ariseing therefrom shall be paid
over to my wife Mary annually for her maintenance in lieu of her dower but in
case the interest will not amount to one hundred and fifty dollars annually then
and in such case my executors shall pay her as much of the principal annually as
will amount too one hundred and fifty dollars and at her death the balance of
the principal shall be equal divided amongst all my children herein after named
share and share alike except Catharine Otto ??? which share shall be divided
between her and her children share and share alike and the other two thirds of
the money shall be disposed off in the following manner. That is to say pay To
My daughter Ann Dayhoff one equal share including the amount of money charged on
my books to her late husband Jacob Dayhoff, To my daughter Catharine Otto and
her children one equal share to be divided between her and her children share
and share alike, To my son Nicholas Stultz one equal share including the amount
of money he owes me on note and Book account To my daughter Elizabeth Wilson one
equal share, to my daughter Margreta Rempy [?] one equal share including the
amount due me by her husband either on Note or Book account, To my son David
Stultz one equal share including the amount he owes me on Book Account, To my
son Abraham Stultz one equal share Including the amount he owes me on Book
account, To my daughter Sarah Shriner one equal share Inculding the amount her
husband John Shriner owes me on Note and Book Account, To my daughter Hannah
Stultz one equal share, To my daughter Sophia Leas one equal share Including
three hundred dollars due me from her and her husband for the purchase of a
house and lot containing three acres and a half of land, and it is my will and I
do hereby direct that my executors deed said house and lot to my daugher Sophia
after my death or the survivor of them, To my daughter Mary one equal share
provided she calls on my executors in person on or before the expiration of
three years from the day of my death and in case she dose not come for her share
within the time above mentioned my executors shall divide said share equal
amongst the balance of my children herein before mentioned - - -
And lastly I do hereby constitute and appoint my friend Thomas Hook and my son
David Stultz executors of this my last will and testament authorizeing them or
the surviver of them to convey my lands to the purchaser of purchasers of the
same, and I do hereby revoke and annull all former Wills and testaments
heretofore made by me ratifying and confirming this and none other to be my last
Will and testament - - - In testimony whereof, I have hereunto set my hand and
affixed my seal, this Nineteenth day of May in the year of our Lord, one
thousand eight hundred and thirty seven. (19 May 1837)

Whereas I Conrad Stultz of Carroll County and State of Maryland have made and
duly executed my last will and Testament in writing baring date the Nineteenth
day of May in the year of our Lord one thousand and eight hundred and thirty
seven, which said will and testament and every claus, bequest and divise therein
contained I do hereby ratify and confirm, saving and excepting such clauses
bequests and divises therein mentioned as are by me herein after revoked and
made void and being desirous to alter such parts thereof and of makeing
additions thereto do therefore hereby make this my codicil which I will and
direct shall be taken and held as part of my said Will and Testament, In manner
and form following That is to say. And whereas by my said Will I did give and
devise ??? to my daughter Sarah Shriner one equal share with the rest of my
children of all the money arising from my real and personal estate including the
amount her husband John Shriner owes me on note and book account and whereas my
said daughter Sarah has since the date of my said Will and Testament departed
this life I do hereby order and direct that my executors dispose of the money so
directed to be paid to my daughter Sarah in the following manner That is to say
Pay over to my son in law John Shriner one third of the full amount including
the money he owes me on Note and Book account, and the other two thirds to be
Equal divided among all my daughters Sarah's children that may be living at the
time of my death share and share alike.
In Testamoney whereof I have hereunto set my hand and affixed my seal this
eighteenth day of May in the year of our Lord one thousand eight hundred and
thirty nine.

In the Orphans Court { On the 16th day of September 1839, came Thomas Hook, the
of { person who executed the foregoing instruments of writing
Carroll County { and makes oath on the Holy Evangely of Almighty God, that
{ the said instruments of writing are the true whole last will
{ and testament and codicil to the last will and testament of
Conrad Stultz, late of Carroll County, deceased, that hath come to his hands and
posession, that he received the same from the said Conrad Stultz for safe
custody, and that he does not know of any other will or codicil left by said
deceased of a later date.

On the 16th day of September 1839, came Daniel Shunk, John Koons and Jacob Hann
the subscribing witness to the foregoing last will and testament of Conrad
Stultz late of Carroll County deceased, and make Oath on the Holy Evangely of
Almighty God, that they did see Thomas Hook sign Conrad Stultz's name to said
will and seal the same in the presence of the said Conrad Stultz, and by his
express directions, That they heard the said Conrad Stultz, and by his express
directions, That they heard the said Conrad Stultz publish pronounce and declare
the same to be his last will & testament, That at the time of his so doing he
was to the best of their apprehensions knowledge and belief of sound and
disposing mind, memory and understanding, that they subscribed their respective
names as witnesses to said will, at the request of the said Conrad Stultz, in
his presence, and all in the presence of each other, The said Daniel Shunk, John
Koons and Jacob Hann being also the subscribing witnesses to the foregoing
codicil to the last will and Testament of the said Conrad Stultz, [do] dee,
further make oath on the Holy Evangely of Almighty God, that they did see Thomas
Hook ^ sign Conrad Stultz's name to said codicil to said last will & Testament
and seal the same in the presence of the said Conrad Stultz, and by his express
directions That they heard the said Conrad Stultz publish, pronounce and declare
the same to be a codicil to his last will and testament, that at the time of his
so doing he was to the best of their apprehensions knowledge & belief of sound &
disposing mind memory understanding, That they subscribed their respec[tive]
names as witnesses to the said codicil at the request of the said Conrad Stultz,
in his presence, and all in the presence of each other.
