Will of Daniel Nail, son of Philip Daniel Nail, July 11, 1828.
"In the name of God Amen, I Daniel Nail of Frederick County, in the State of
Maryland, being sick in body, but of sound and disposing mind, memory, and
understanding, knowing the certainty of death, and the uncertainty of the time
thereof, and being desirous to settle my wordly affairs, and thereby be the
better prepared to leave this world, when it shall please God to call me hence,
do therefore make and publish this my last will and testament in the manner and
form following that is to say. First, and principally, I commit my soul into
the hands of Almighty God, and my body to the earth, to be decently buried, at
the discretion of my executor herin after named. Item. I direct that the
whole of my estate both real and personal shall be sold by my Executor
herinafter namd as soon as may be, after my death either at publick or at
private sale as he may think best, and after my debts and funeral charges are
paid, I direct that the proceeds of such sale or sales shall be divided as
follows. Item. I give and bequeath unto Ester Stoneseiffer (the woman who
now lives with me) fifty dollars current money for her services rendered.
Item. I give and bequeath unto Peter Nail son of Jacob two dollars current
money, the ballance of the money arising from the above named sale or sales I
give and bequeath unto my brothers & sisters children, share and share alike to
be paid to them when they shall arrive at lawfull age, or to their Guardian,
excepting Peter Nail son of Jacob who is to have no more than the above named
two dollars. And lastly I hereby nominate, constitute and appoint my friend
Jacob Mathias sole executor of this my last will and testament, authorising my
said Executor to convey by deed of conveyance all property he may sell under the
directions of this will, in as full & ample a manner as I myself would do, were
I personally present & yet living, revoking and annulling all former wills by me
heretofore made, ratifying and confirming this and none other to be my last will
and testament. In testimony whereof I have hereunto set my hand and affixed my
seal this eleventh day of July Eighteen hundred and twenty eight.

sence of each other have subscribed our names as

Maryland Frederick County to wit; On the 21st day of July 1828, came Jacob
Mathias and made Oath on the Holy Evangels of Almighty God, that the foregoing
instrument of writing, is the true whole will and testament of Daniel Nail, late
of Frederick County, deceased, that hath come to his hands and professes, that
he doth not know of any other.

On the 21st day of July 1828, came Robert Crawford and _____, two of
the subscribing witnesses to the foregoing last will and testament of Daniel
Nail, decd., and made oath on the Holy Evangels of Almighty God, that they did
see the Testator, therein named, Sign and seal this will, that they heard him
publish, pronounce and declare the same to be his last will and testament, that
at the time of his so doing, he was to the best of their apprehensions, of a
sound and disposing mind, memory and understanding, that they respectively
subscribed their names, as witnesses thereto, at the request of the testator,
and in his presence, and they did also see ______, the other subscribing
witness, subscribe his name, as a witness thereto, at the request of the
testator, and in his presence, and all in the presence of each other. --
