RECORD OF THE WILL OF WARREN GOODELL
Last Will and Testament
I, Warren Goodell of the town of Birdsall County of Allegany and state of New York, do
make, ordain, publish and declare this to be my last Will and Testament, in manner and form
following, that is to say: First. - I direct the payment of my just debts, if any. Second.
- I give, devise and bequeath to my sister Olive Dexter of Birdsall, Allegany County, N.Y.,
all my property, both real and personal of every name and nature, wheresoever the same may
be situated to be hers absolutely, to do with it as she desires. Likewise, I make,
constitute and appoint my niece Lizzie Scoville of Birdsall, Allegany County, New York, to
be my executrix of this my last Will and Testament, hereby revoking all former wills by me
made. In Witness whereof, I have hereunto subscribed my name and affixed my seal, the 25th
day of December, in the year of our Lord one thousand eight hundred and ninety seven.

The above partly written and partly printed instrument was subscribed by the said Warren
Goodell, in our presence and acknowledged by him to each of us, and he at the same time
declared the above instrument, so subscribed by him to be his last Will and Testament: and
we at his request sign our names as attesting witnesses hereto, in his Presence and in the
Presence of each other, and write opposite our names our respective places of residence.

BE IT REMEMBERED, That on the day of the date hereof, the Last Will and Testament of Warren
Goodell, late of the town of Birdsall in the County of Allegany and State of New York,
deceased, being the within and foregoing written instrument, was duly proved before Elta
Reynolds, Surrogate of the said County, according to law as and for the Last Will and
Testament of the real and personal estate of the said deceased, which said Last Will and
Testament, and the proofs and examinations taken thereon are recorded in this office.

In the Matter of Proving the Last Will and Testament of
Warren Goodell
Deceased
ALLEGANY COUNTY, SS.
Dawson D. Dickson and Lizzie Humphrey being first duly sworn in open Court, each for
himself, doth depose and say, that he is a subscribing witness to the last Will and
Testament of Warren Goodell late of town of Birdsall in the County of Allegany and State
of New York deceased And these deponents do further say that the said Warren
Goodell deceased, did, in the presence of each of these deponents subscribe his name at
the end of the instrument in writing, which is now here shown to these deponents, and
which purports to be the last Will and Testament of the said deceased, and which bears
date on the 25th day of December one thousand eight hundred and ninety-seven. That said
deceased died on or about the 3rd day of February, 1904, at Birdsall, Allegany County, New
York That said the decased did, at the time of subscribing his name to the said instrument
as aforesaid, declare the same to be his last Will and Testament; and these deponents did
respectively subscribe their own names at the end of said instrument, as attesting
witnesses to the execution thereof, each at the request of the said deceased, and in his
presence, and in the presence of each other: That the said deceased, at the time of so
subscribing his name to said instrument as aforesaid, and publishing said instrument as
aforesaid was of full age; that he appeared to be, and deponents believe he was of sound
mind, memory and understanding, and not under any restraint, and, as deponents verily
believe, in all respects competent to devise real estate; that each of these deponents saw
the other sign his name to the said instrument in the presence of the said deceased, and
the said Lizzie Humphrey says, further that she is the same person as Lizzie Scoville
whose name is attached to said Will as witness thereto.
Subscribed and sworn to before me, this 17th day of June 1904.
