No. 18 John Fails Will
" In the Name of God Amen I John Fails of [illegible] Township Westmoreland County
[illegible] being very sick and weak in health and in perfect mind and memory thanks be
given to God, calling unto mind the mortality of my body and knowing that it is appointed
for all men once to die do make and ordain this my last will and testament that is to say
principally and first of all I give and recommend my soul unto the hands of Almighty God
that gave it and my Body I recommend to the earth to be Buried in decent christian Burial
at the discretion of my Executors Nothing doubting but at the General resurrection I shall
receive the same again by the Mighty Power of God, bless me in this life I give demise and
dispose of the same in the following Manner and form. First I give and bequeath to Sarah Fails
my lawful wife to be kept upon the place where she formerly resided, and she is still, to have
a cow and to raise some stock not two much to hamper them she lives with, and also a bed and
bed clothes sufficient for a bed. AlsoI do here certify that my Son Thomas Fails was satisfied
with what he had got before this. And also to my Son Alexander Fails I give and bequeath that
Tract of Land that I formerly lived upon advancing out next blacklik as far as George
Kulabaughs [Kuldbaugh?] and then runing across from the Steep Banks of Blacklik till the river
Connemaugh and likewise two mares and a horse colt and I do allow him one Milk cow and three
[stirks?] and the plough and tachlings belonging to a plow likewise Alexander is to Give the
old woman his mother and Rachel his sister their Maintenance of the land whilst the remain
unmarried. and if the old woman Marries again Alexander is to have her cow and Rachel the bed
and clothing belong thereto Likewise to my Daughter Rachel I Do give and allow her the Bay
Filley, and the two year old heiffer and the two heiffer calfes and, also do I allow the sheep
to be divided between the old woman Alexander and Rachel. To James carrell, I Do allow him the
plantation that he lives on and the line Between him and, Alexander to run along the Path that
went from James Carrells to Johns, about twenty Rods up the hill to a big black oak tree to
the right hand of the path as you go to Johns. And to my Grand child Alexander McCoy I do
allow of my Son Alexander and my Daughter Rachel be pleased, to give him a heiffer Calf , to
have that, also I do allow my Son in-law Andrew Adams the lower end of the forks, and the land,
thereof to the amount of hundred and fifty acres and settle the line between Alexander and him
in peace, also I do give Andrew Adams my Loom and all the Geers belonging to the Loom I dont
desire any Vending or Selling any thing and, I do do hereby utterly disallow revoke and
disannull all, and, every other former testaments Wills, legacies, bequeaths and, Executors
and Confirming this and no other to be my last will and testament. In Witness whereof I have
hereunto set my hand and Seal this tenth day of March in the year of our Lord one thousand
seven hundred and seventy eight."
