WILL OF HENRY WALTER
I, Henry Walter of Union Township Bedford County and state of Pennsylvania do
make and publish this my last will and testament hereby revoking and making void
all former wills by me at any time heretofore made, and first I direct that my
body be decently interred, And as to such worldly estate as it has pleased God
to intrust me with I dispose of the same as follows: I direct that my son Jacob
shall have the privilege of farming my real estate during the life time of my
wife Ann Walter and shall have the use of two horses and whatever farming
implements he may need to carry on farming while he farms as a tenant and shall
give my wife a just share of all the products of the farm. Second I direct that
my wife Ann Walter shall have all the rents or shares of my farm and the house I
live in and all the personal property I possess (excepting the money loaned to
my children) during her lifetime. Third I direct that my son Jonas shall have
the use of the money I loaned to him till the First day of April A.D. 1876 and
shall pay but one years' interest on the same. I further direct that on the
first day of April A.D. 1876 the money loaned out shall be disposed of as
follows, one Hundred dollars shall be paid to my daughter Catharine and the
balance shall be equally divided between my children Joseph, Susan, Barbara,
Catharine, Elizabeth, Jacob and Jonas. Fourth I direct that after the death of
my wife Ann my son Jacob shall have the privilege of buying my farm for Twenty
One Hundred dollars payable as follows: Seven hundred dollars to be paid in one
year from the death of my wife Ann Walter and the balance in two equal annual
payments thereafter without interest and in case he refuses to buy the farm on
the above conditions then I direct my Executor to sell the same at public sale.
I also direct that after the death of my wife my personal property shall be sold
by my Executor and the proceeds of my real and personal property (after paying
all expenses) shall be equally divided between my children Joseph, Susan,
Barbara, Catharine, Elizabeth, Jacob and Jonas share and share alike, And I do
hereby make and ordain Joseph C. Ickes Executor of this my last will and
Testament, In Witness whereof I have hereunto this my last will set my hand and
seal this 30th day of October in the year of our Lord One thousand Eight hundred
and Seventy Four.

The above instrument was now here subscribed by Henry Walter the Testator in
presence of each of us and was at the same time declared by him to be his last
will and testament and we at his request sign our names as attesting witnesses,

Before me, the Register of Wills &c, in and for said County, personally appeared
Michael D. Burket and Samuel D. Burket, the subscribing witnesses to the within
instrument of writing who being duly sworn according to law depose and say that
they were present and saw and heard Henry Walter, (now deceased), sign, seal,
pronounce and declare said instrument as and for his last will and testament,
that they signed their names as witnesses thereto in the presence and at the
request of the said testator and that at the time of so doing he was of sound
and disposing mind, memory and understanding to the best of their knowledge and
belief.

Filed, proven and Letters Testamentary issued to J.C. Ickes on the 27th day of
September A.D. 1875.
Testator died on the 9th day of Sept. A.D. 1875 at about 9 o'clock P.M. per oath
of Samuel D. Burket, filed.
