Bedford Township
Written: February 1, 1777
Probated March 16, 1779
In the Name of god Amen, This first day of February one Thousand Seven Hundred
and Seventy (1 Feb 1777). I THOMAS KINTON of the County of Bedford and
Township of Bedford being sick and weak body but of perfect mind and memory
Thanks be to God therefore calling unto mind the mortality of my body and
knowing that it is appointed for all men once to die do make and ordain this
my Last will Testament that is to say first I give and recommend my sole to
the Almighty God that gave it and my body I recommend to the earth to be
buried in decent Christian Burial at the discretion of my Executors nothing
doubting but at the great reservation I shall receive the same again by the
mighty power of God and as touching my worldly Estate where with it hath
pleased God to bless me within this life I give demise and dispose of the
following manner I give and bequeath to RACHEL KINTON my Dearly beloved wife
her riding mare saddle and bridle and two cows her choice of one of my beds
and it's furniture, and the bound boy to be at her command until he is free if
she should live as long and the disposal of him until he is free to either
JOHN or SIMON and all the sheep belonging to my place to be for the use of
the family as long as they live together and at her decease for to be sold and
put to the remainder of my Estate and a sufficient maintenance for her and her
stock and liberly for herself and stock on the place as long as she lives and
the command of the part of land that falls to SIMON KINTON till he comes of
the age of twenty one years if she continues unmarried and sufficient for a
decent burial at her death to be taken out of the Estate for that use and the
two plow horses and all things necessary for to work the place. For the use of
the family that lives thereon and all necessary furniture for to be kept for
their use except there should be a call to sell some part of them for to pay
my just debts and as much as will be necessary to repair the fences and put
them in good order on that part of the land that falls to JOHN KINTON to be
taken out of my Estate and to be made use of in the same manner as in times
past for to support the family that lives on the place and him to have his
stock maintained on the place as in time passed until he is married and then
let his own part fall to himself for his own use except the part that falls to
him should be in grain at that time and if so he must allow his mother
sufficient to maintain her and her family during that year and if JEREMIAH
WARDER, Jno MOCK and hatter in Philadelphia has paid any money out on the
office on my account let it stand in behalf of the whole land and each of the
boys to have there divided part of the money in order to clear the land out
of the office and the fifty (50) pounds that Mr. STEVENSON is indebted to me
let it be equally divided between my three sons for to help them to clear
their Land out of the office and let their be as much of my stock or personal
Estate sold as will pay what they are warder has paid in the office on my
account. I give to my well beloved Son THOMAS all the land that is in the
survey on that side of the creek where he now lives by him freely to be
possessed and enjoyed forever and if he should disinherit a proper heir for
his land then falls to the other two of my Sons I give to my well beloved
Sons JOHN and SIMON KINTON all the remainder of my land for to be equally
divided between them both. To and at advantage that they may be equal shares
in the bottom and upland and JOHN KINTON is for to have the upper part of
the tract that we live on by them freely to be possessed and enjoyed and each
of them is to have a cow at the value of five pounds each and JOHN to have
a plow and two pair of gears and all things necessary for to fix a plow and
ax and mattock and SIMON is for to have a plow and two pair of gears and all
things necessary for to fix a plow and ax and mattock and a rifle gun or five
pounds instead of it and SIMON KINTON and the bound boy if he stays in the
family are both to be sold out of the Estate and JOHN KINTON if he
continues in the family until he is married is for to have one years board for
himself and his wife allowed them of the place and if JOHN KINTON or SIMON
KINTON should die without a proper heir the land is to fall to his brothers
and SIMON KINTON is to have the filly that come of my mare that runs at
John Anderson's. I give to my beloved Daughter ANN a cow to the value of
five pounds and a feather bed and bed cloth for the same and household
furniture equal to the other girls that is married. I give to my beloved
Daughter JEAN one cow to the value of five pounds and a feather bed and cloth
for the same and household furniture equal to the other girls already married
and the remainder of my estate to be sold and be equally divided between my
five daughters by them for to be possessed and enjoyed. ALLEN ROSE, THOMAS
KINTON, Junr. and JOHN KINTON. I like wise constitute make and ordain my
executors of this my last will and testament And I do hereby utterly
disallow, revoke and disannual all and every other former Testaments Wills
legacies and bequeaths and Executors by me in any wise before named, will and
bequeathed ratifying and Confirming this and no other to be my last will and
testament in witness whereof I have here unto set my hand and seal the day and
year above written.

Bedford County JS... Before me David Espy Esq. Register for the probate of
will and granting letters of administration in and for the County of Bedford
in the State of Pennsylvania personally came the above named WILLIAM PROCTOR
and WILLIAM TODD the two subscribing witnesses to the foregoing instrument in
writing and on there solemn oath respectively taken before me according to
law do depose and swear that they were personally present and heard and saw
the above named THOMAS KINTON sign seal publish and declare the foregoing
instrument in writing as his last will and testament that at the time of doing
thereof the said THOMAS was of sound and disposing mind and memory
according to the best of these Deponents Knowledge and beliefs that they
subscribe Their names as witnesses of the same at the request of the testator
and in his
presence.

BE IT REMEMBERED that on the 16 day of March in the year of our Lord One
thousand seven hundred and seventy nine (16 Mar 1779) the Last will and
Testament of THOMAS KINTON deceased was in due form of law proved before me
and Probate and Letters Testamentary thereof were granted to ALLEN ROSE ,
THOMAS KINTON and JOHN KINTON in the foregoing will mentioned as executors
thereof they being first duly Sworn well and truly to Administer the said
Deceased Estate and exhibit and Inventory thereof into the Registor's office
at Bedford on or before the --- day of ---- and just account of the said
administration on or before the next Given under the Seal of the said office.
