Tobias Hammer
In the name of God, Amen. I, Tobias Hammer of Napier Township in the county
of
Bedford and being in a weak state of body but of perfect sound mind memory, I
understanding and considering the uncertainty of this transitory life do make
and publish my last will and testament in manner & form following, to wit:
First of all, I request that my body may be buried in a Christianlike manner
at the discression of my Executors herein after named. And as to such
worldly
property as it has pleased the Lord to bless me with in this life, I give and
dispose of in the following manner to wit: I give and bequeath unto my wife
Catherine two fether beds beding & bedstead, one beaurough,
One dining table, six green window clothes, all my carved furniture and some
of my hitching furniture as she shall think fit and necessary for her to keep
house with. Also I give to my said wife one sorrel mare, side sadel & bridle
and her choice of two cows out of all my cattle. Also to be paid to her my
said wife by my Executors yearly and every year during her natural life for
her use Fifteen bushels good wheat, six bushels of ege, two hundred weight of
beef or Pork at her option, fifteen dollars in Spices and two tuns of
Hay & pasture in the summer for her mare. Also to be paid to my said wife
by my Executors yearly & for the term of four years twenty dollars for her
to put to use of scholling & maintaining of my two sons David and Joseph.
I give unto her my said wife during her natural life the dweling House in
the medaw & the out buildings attached thereto for her dweling and my
Executors must furnish her with a sufficient quantity of Firewood to be
delivered at her house. & her Hay to be delivered in the stable loft. I give
and bequeath unto my daughter Mary one side sadle and Bridle to be paid for
out of money ansuing from my estate. Also one fether bed, beding and
bedstead and two cows out of my stock of my cattle. Also so much of my
other Furniture as will make her Eaual to what my daughters Elizabeth and
Catharine hath already received from me. It is my will that my Executors
Immedeately after my decease shall proseed to appraise & sell all my personal
estate (Except such as before bequathed) and shall put to rent all my real
estate which rent shall be applied to process the grain, meat, hay and money
which is to be paid to my aforesaid wife by my Executors & it is my will that
my Executors shall collect all monies now due to me, or thereafter to become
due and pay all my just debts & funeral expences. And it is my will & desire
that within the term of two years or sooner after the decease of my
aforesaid wife that my Executors and them I do here by impower to sell &
convey all my real estate & all money arising thereupon together with all
money arising out of my Estate by Bonds, Notes, Book Accounts or
otherwise and yet remaining to be equally divided between my eight children
to wit, William, John, Francis, David G., Joseph, Elizabeth, Catharine, &
Mary. Lastly, I nominate, institute & appoint my two sons John and Francis
to be the Executors of this my last will and Testament hearby revoking all
other wills, Legacies and bequests by me heretofore made and Declearing this
and no other to be my last will & Testament. In witness whereof I have
hereunto set my hand and seal the twenty-seventh day of May in the year of
our Lord one thousand eight hundred and twelve.

Of us who in his presents & at his request have subscribed as Witness

Be it known to all men by these presents that I Tobias Hammer of Napier
Township Bedford County have made and declared my last will & testament in
wrighting bearing date the twenty seventh day of May in the year of our Lord
one thousand eight hundred and twelve. I, the said Tobias Hammer, by this
present Codicil do ratify and confirm my said last Will & Testament. I do
give and bequeath unto my wife Catharine (in lieu of the two tons of Hay
heretofore wiled, the one third of all the Hay that will be made on my
plantation. Also, I give unto my Wife in addition to the grain already wiled
unto her, fifteen bushels of wheat and sin bushels of rye to be paid unto her
yearly during her natural life by my Executors. Also one other cow and one
fether bed and beding in addition to what has here already wiled unto her.
I also give unto my wife Catharine the (?) of Edna Miers a bound child, and
her free ?ois to move to the hous as before wiled unto her or continue in
the mansient dweling house. Also, I give unto my wife one hundred weight of
meat in addition to what has bin already wiled unto her to be paid unto
her yearly by my Executors out of my estate. And my will and meaning is that
this Codicile or shedule be adjusted to be a part and parcel of my last
Will and testament and that all things therein mentioned and contained be
faithfully and truly performed and as fully and amply in every respect as
if the same were so decreed and set down in my said last Will and testament.
Witness my hand and seal this twelfth day of April in the year of our Lord
one thousand eight hundred and thirteen.

Bedford County PS personally appeared before me the subscriber Register for
the
probate of Wills and granting letters of Administration on and for said
County
Herbert Otto, Ephraim Williams and James Williams, subscribing witnesses to
the foregoing instruments in writing who being all duly sworn according to
law the said Herbert Otto and Ephraim Williams do say that they were
personally present and heard & saw Tobias Hammer the testator sign seal and
declare the foregoing instrument in writing dated 29th day of May A.D. 1812
as and for his last Will and testament that at the time of so doing the said
testator was of sound and disposing , memory and Understanding according to
the best of said deponents knowledge and belief and deponents further say
that
they saw John Hewitt subscribe as a Witness thereto in prescence of the
testator and that by the said John Hewitt is since deceased. And the said
Ephraim Williams & James Williams do say that they were present and heard
and saw the said testator sign seal and declare the foregoing Codicil bearing
date the 12th day of April A.D. 1813 as and for a part of his last Will and
testatment that at the time of signing the same the said testator
was of sound and disposing mind, memory and understanding according to the
best of their knowledge and belief-Sworn to & subscribed the 29th day of
May A.D. 1815
