My dear Judge:

Your roll for the Second Quarter has been received and I thank you.

I note that you failed to send in the application of Mrs. J.M. Byers for her
deceased husband’s pension for this quarter.  If Mrs. J.M. Byers is still in
life kindly have her file this application right away or furnish us with an
affidavit to the effect that she is still living, as we must be able to show our
authority for paying out a deceased pensioner’s money.

Dear Sir:

Replying to yours of May 31st relative to widow of J.M. Byers deceased, in which
you advise that you must have application from this widow before payment to her
can be approved, I beg to advise that upon the death of the pensioner, J.M.
Byers, his widow, Mrs. Ida Byers made application for payment to her of pension
due to her husband for the year 1929, (she having been married after 1880 could
not be enrolled for life, but only for the year in which the pension due); and
that her application was approved by you on the 29th of March 1929; and that she
was duly paid the first quarterly payment in April 1929.

From my construction of the statute, providing that where a pensioner dies,
leaving a widow, and his death occurring before he had received all the payments
due him for that year, that his name is carried on the roll, but the payments
made to the widow for that year; that is why I continued his name on the roll
and did not put Mrs. Byers name of the widows roll, as she can only be paid for
1929.

I hand you certificate showing you Mrs. Byers, the widow is still in life and
has not remarried.

I recall, that when you sent me payment etc., for the first quarterly payment
that you sent with the papers the approved application of Mrs. Byers, which was
returned to you with the receipted vouchers for such first quarterly payment;
and you will find such approved application among your files.

Trusting that the foregoing will be satisfactory to you, I am

I, John C. Butt, Ordinary for Marion County, Georgia do hereby certify that John
M. Byers, a Service Soldier Pensioner, of said County and State, died on the
21st day of March 1929 leaving his widow surviving him; that during the month of
March and after the death of said John M. Byers, his said widow, Mrs. Ida Byers,
made application for the pension due to said John M. Byers deceased for the year
1929; which said application was approved by the Pensioner Commissioner of
Georgia on the 29th day of March 1929, and the first Quarterly payment for 1929
due to said John M. Byers was accordingly paid to said Mrs. Ida Byers, widow as
aforesaid.

That the said Mrs. Ida Byers, widow of John M. Byers is still in life and has
not since remarried, and is the lawful widow of said John M. Byers and to whom
entitled to be paid the balance of the unpaid pension due said John M. Byers for
the year 1929.

Witness my hand and seal of office this the 1st day of June 1929.

Holy State of Matrimony according to the Constitution and Laws of this State and
for so doing this shall be your License.  

And you are hereby required to return this license to me, with your Certificate
hereon of the fact and date of the Marriage.

Given under my hand and seal this the 1st day of October 1919.

Personally before me, the Ordinary of said County, comes Mrs. Ida Byers of said
county, who after being duly sworn, on oath says that she is the widow of John
M. Byers and that said Pensioner was on the Pension roll of Marion County and
was paid a Pension of Two Hundred & Ninety ($290.00) Dollars from said County
for -----Quarter, 1929, and that the said Pensioner died in Chattahoochee County
on the 21st day of March 1929.  Applicant further swears that she married the
said John M. Byers on the 1st day of October 1919 in Chattahoochee County and
State of Georgia, and resided with him from that date of marriage to his death
as his lawful wife, and is now his dependent widow, and she asks that the $90
extra Blind Pension due and unpaid be paid to her.

AFFIDAVIT OF WITNESS

State of Georgia, Marion County

Personally comes before me B.T. Rainey, who on oath says that he knew John M.
Byers while in life and that he knows Mrs. Ida Byers, the above applicant; and
knows that the said John M. Byers and Mrs. Ida Byers were in due form of law
married in the county of Chattahoochee in the State of Georgia on the 1st day of
October, 1919 and that they were residing together as husband and wife at the
time of his death on the 21st day of March, 1929, and that she is his dependent
widow.

Ida Byers, the applicant, and that she is the lawful widow of John M. Byers, who
was on the pension roll of said Marion County for 1928, and at the time of his
death on the 21st day of March 1929, there was due to him and unpaid his pension
of Two Hundred and Ninety Dollars from the State of Georgia, and I know B.T.
Rainey, the within witness, and he is of a truthful and trustworthy character
and entitled to full credit.
