In the name of God, Amen. This twenty eighth day of September, in the year of our Lord
1817, I, James Stewart, of Armstrong Township, in the County of Indiana, being very
sick and weak in body, but of perfect mind and memory, thanks be given unto God,
therefore calling to mind the fraility of my body, and knowing that it is appointed for all
men once to die, do make and ordain this , my last will and testament , that is to say
principally, and first of all, I give and commend my soul unto the hands of Almighty
God, who gave it, and my body I recommend to the earth, to be buried in a decent and
Christianable manner, nothing doubting that at the general Resurrection , I shall receive
the same again by the mighty Power of God.
And so touching such my worldly estate wherewith God has endowed me with in this
life, I bequeath in the following manner , viz:
I give and bequeath unto my dearlybeloved wife, Mary, two hundred and ninety three
acres of land of this end of the place where we now live, with all the appurtenances for
her support during her life, and also I bequeath unto her all my personal property , save
the sorrel mare and the loom, which I bequeath to my daughter Jean. .
Likewise, I bequeath to my son, Michael, one hundred acres of land at that end of the
place where he now lives, with all the appurtenances to have and to hold by him, his
heirs, and assigns forever.
Likewise. the place over Crooked Creek, formerly occupied by David Johnston, to be
divided equally among my seven daughters to be disposed of as them or their husbands
deem proper.
Likewise the place where I now live is to be divided in the same manner after Marys
death.
And I likewise make, constitute and ordain John Trimble and Michael Stewart my sole
executors of this, my last will and testament, ratifying and confirming this, and no other,
to be my last will and testament.
In witness whereof I have hereunto set my hand and seal the year and date above
written.
Signed, sealed, published, and pronounced and declared by the said James Stewart to be
his last will and testament in the presence of us witnesses ,Sam Hall and Nicholas
Loughry

Be it remembered that the above last will of James Stewart was duly proved by Sam
Hall and Nicholas Loughry , the subscribing witnesses on the 31st day of October A.D.
