In The name of God Amen   I Benjamin Zimmerman
of Frederick County and State of Maryland being sick and weak in 
Body but of sound mind memory understanding, Thanks be to the 
Almighty God for the same and being desirous to settle and adjust
all my concerns in this world, before it shall please God to call me home
and therefore publish and declare this to by my
last will and Testament in manner and form following Viz. 
First I Give and Devise unto my beloved wife Catherine all my real
estate during her natural life and immediately after her decease I desire
that the same may be sold to the best Advantage as shall be concluded by 
my Executor herein after named and the proceeds thereof to be equally Divided
Share and Share alike among my five children namely Henry, Daniel
Benjamin, John and William as to my personal Estate it is my will and
desire that my funeral charges may be paid, secondly it is my will and
desire that after my Just Debts are paid that my beloved wife aforesaid
Shall have one third part of my personal estate aforesaid in Addition to the
following bequests Viz.  I give and bequeath unto my loving wife aforesaid
three beds and furniture such as may be her choice  also two cows and
four sheep of her choice of my Stock  also one walnut cupboard and one
Walnut table  Also one half of my kitchen furniture  also all the hemp
Linnen which may be in the House at the time of my Decease and not
made up  also all the hemp of this years Growth and not yet rotted
Also all the Bacon now on hand  Also five hogs of my Stock together with 
one Chest to be her choice out of my household furniture  It is further my
will and particular desire that my Executor shall build or cause to be 
Built on the real Estate aforesaid and Devised to my loving wife a good 
and comfortable Dwelling house and the costs and charges for such Building are 
to
be Deducted out of her third part of the personal estate bequeathed as
aforesaid  It is also my will and desire that my Executor shall sell
on a reasonable Credit all my personal Estate (except such as is bequeathed
as aforesaid) and out of the proceeds there to discharge the funeral charges
and Debts aforesaid and pay over to my loving wife aforesaid her third part
after Deducting the expense of the Building the aforesaid House  it is further
my desire that the Balance of the money in the Executors hands after the
foregoing parts of my will are fulfilled shall be put on Interest, and the 
Interest arising therefrom shall be paid by my executor to my loving wife
aforesaid in order to Assist her in the maintenance of my Children and towards
their Education  I Give and bequeath unto my five Sons Viz.
Henry, Daniel, Benjamin, John and William Zimmerman and to their
heirs and Assigns share and Share alike all such Balance as may
remain and be lent out  to be by them received when they respectively
arrive at Lawful age  it is my will and desire that my
Executor do bind or cause to be bound my children aforesaid when
they arrive at the Age of seventeen years to learn such Trades
as they may respectively choose  Lastly I do hereby constitute
and appoint my Trusty friend Nicholas Holtz Sole Executor
of this my last will and Testament hereby revoking and making void
all other will or wills by me at any heretofore made or Executed
ratifying and confirming this and none Other to be my last will and
Testament  In Witness whereof I have hereunto set my hand and
affixed my seal this third day of April Eighteen Hundred and Eight

Frederick County to wit on the 25th day of April 1808 then came Nicholas
Holtz and made Oath to the holy Evangels of Almighty God that the 
foregoing Instrument of writing is the true whole will and Testament of
Benjamin Zimmerman late of Frederick County Deceased that hath 
come to his hands and possession and that he doth not know of any other
Rich'd Butler Reg'r.

Frederick county to wit on the 25th day of april 1808 then came Lewis
Birely, Georgs Waughter and Nicholas Zimmerman three of the 
Subscribing witnesses to the foregoing last will and Testament of
Benjamin Zimmerman late of Frederick County Deceased and made
Oath on the holy Evangels of Almighty God that they did see the 
Testator herein named Sign and Seal this will that they heard him publish
pronounce and declare the same to be his last will and Testament that at
the time of his so doing he was to the best of their apprehension of a 
Sound & disposing mind memory and understanding that they respectively
Subscribed their names as witnesses to this will in the presence and
at the request of the Testator      And that they did also see Samuel Hedges
the Other Subscribing witness Sign his name as a witness to said will in the
presence and at the request of the Testator and all in the presence of each
Other --Rich'd Butler Reg'r.
