James Wallace
probated 8 Nov 1774

In the Name of God Amen

I James Wallace of Frederick County & Province of Maryland being weak in body 
but of sound mind and memory (blessed be God) to this sixth day of September one 
thousand seven hundred seventy & four make and publish this my last will & 
testament in manner following, hereby revoking all other wills contrary hereunto 
by me made, ratifying and confirming this and none other to be my last will & 
testament.

First, I give and bequeath to my son Herbert Wallace two hundred & seventy acres 
of land being part of a tractofLand called Brothers Industry and as laid out by 
Zachariah White on the plat, as also forty seven acres of a Tract called 
Magruder's Industry as also a tract of land called Piney Livel containing one 
hundred and thirty four acres. I also give him the said Herbert a Negro man 
named Cato, also a Negro woman named Dina & her children a girl named Beck & boy 
Jam & a mulatto boy named Tom say I give the above Lands Negroes & Mulattoes to 
my son Herbert Wallace his heirs and assigns forever.

Item I give and bequeath unto my son William Wallace three hundred acres of land 
being part of the Brothers Industry as laid out on the plat by Zachariah White, 
as also a tract of land called Discovery containing eighty four acres more or 
less. I also give him the said William a mulatto man named Frank & a mulatto boy 
named George I say I give the above lands & mulattoes to my son William Wallace 
hisheirs & assigns forever.

Item I give & bequeath unto my son James Wallace my Dwelling Plantation being 
part of Brothers Industry containing four hundred acres as laid out by Zachariah 
White. I also give and bequeath unto my son James the Plantation where he now 
lives on containing one hundred acres of land more ore less, also a negro man 
named Will, also a Mulatto man named Nat & mulatto boy named Alexander. I say I 
give the above lands Negro & Mulattoes to my son James Wallace his heirs and 
assigns forever.

Item I give and bequeath unto my Daughter Eleanor Hopkins a Tract of land called 
the Weavers Denn containing two hundred acres more or less. And whereas I 
formerly give her a mulatto woman who is now dead I now give her the mulatto 
woman's two sons viz Rob & Sam least there should be any disputes I also give 
her a Negro woman named Pere I say I give the said land mulatto woman's sons & 
negro woman to my daughter Eleanor her heirs and assigns forever.

Item I give and bequeath to my Daughter Ann Douglas a Negro woman named Philis, 
also a negro man named Sam, also negro girl name Dell also a negro boy named Sam 
& a negro boy named Kitt. I say I give the said negroes to my daughter Ann her 
heirs & assigns froever.

Item I give and bequeath unto my granson John Wallace Douglas a young negro 
woman named Cloealso a mulatto girl named Cate and a negro boy named Harry I say 
to him & hisheirs & assigns forever.

Item I give and bequeath to my grandson Robert Douglas a negro boy named Tony 
and a negro boy named adam & a negro girl named Deoll I say to him & his heirs & 
assigns forever.

Item I give and bequeath unto my aforesaid grandsons John Wallace Douglas & 
Robert Douglas one hundred pounds sterling each and it is my mind & will that 
the said money be put out at interest by my Execrs. & the interest yearly apply 
by them towards the support and education of my said grand children & when they 
attain the age of twenty one - then the principal money of two hundred pounds 
sterling to be paid them or the survivor of them. It is also my mind & will that 
if either of then should die before they come of age that the survivor shall 
have all the slaves & money I have willed to both & if they should both die then 
& in that case I give and bequeath the slaves and money willed to them to my 
daughter Ann Douglas & her heirs forever.

Item I give negro Nan her freedom & leave her free & clear of all manner of 
servitude and Flora to have her choice of my children for a master or mistress.

Item all the rest & residue of my estate real & personal whatsoever or 
wheresoever I will shall be equally divided amongst all my children in equal 
given proportions share & share alike.

Lastly I constitute and appoint my sons Hebert William & Jaes Wallace Excrs to 
this my last Will & Testament. In witness whereof I have hereunto set my hand & 
seal the day and year first written.
