UTZ WILLS


Johann Jacob Utz, 1764-1826

In the name of God. Amen.  I  Jacob Utz of Frederick County and state of 
Maryland being sick and weak of body but of sound disposing mind memory and 
understanding considering the certainty of death and the uncertainty of the time 
thereof and being desirous to settle my worldly affairs, and be thereby better 
prepared to leave this world when it shall please God to call me hence, do 
therefore make and publish this my last will and testament in manner and form 
following, that is to say:  First and principally I commit my soul into the 
hands of the Almighty and my body to the earth to be decently buried at the 
discretion of my Executors hereinafter named, and after my debts and funeral 
charges be paid which I hereby order and direct my will is as follows, viz:  
Items I give and bequeath into my dear wife Catherine the house and premises I 
now occupy a lot or parcel of ground lying in Winters addition to the town of 
Westminster and also the lands I hold in Baltimore County during her natural 
life.  I also give unto my dear wife Catharine Eight hundred dollars all my 
household and kitchen furniture of every description all farming utensils my 
horse and cow hay and straw potatoes and garden stuff with all kinds of 
provisions in and about the house.  Items I give and bequeath unto my four grand 
children as follows.  To Mary Grammar two hundred dollars To John Utz two 
hundred dollars to Jesse Utz one hundred dollars and to Catharine Utz one 
hundred dollars Item It is my will and desire and I do hereby so, order 
authorize and direct that my said hereinafter named Executors sell convey and 
transfer according to the title.  I may have all the residue of my Estate 
wherever situate be the same real person or mixed in such manner on such terms 
as to them may seem most beneficial and the proceeds from the same to collect 
together with the residue of all the debts rights and claims to which I may be 
entitled and when so collected together I then order and direct my said 
hereinafter named Executors to pay the foregoing legacies to the proper persons 
to receive the same.  Item I give and bequeath unto my daughter Polly Grammar 
all ballences remaining on final settlement in the hands of my said hereinafter 
named Executors and direct the same to be paid over unto her I also give and 
bequeath after the death of my said wife Catherine   To my daughter Polly 
Grammer the house and premises we  now occupy and the lot or parcel of ground 
lying in Winters addition to Westminster and also all the lands in Baltimore 
County as bequeath to my said wife Catharine during her life.  And lastly I do 
hereby constitute and appoint my friend Isaac Shriver and Jacob Grammer to be 
sole Executors  of this my last will and testament revoking and annulling all 
former wills by me heretofore made ratifying and confirming this and none other 
to be my last will and testament  In witness whereof  I have hereunto set my 
hand and affixed my seal this thirty first day of October Eighteen hundred and 
twenty six.

of us who at his request in his presence the 
presence of each other have inscribed our names
as witnesses thereto

Frederick County to wit:  On the 9th day of November 1826 there came Isaac 
Shriver and made oath on the Holy Evangely of Almighty God that the foregoing 
instrument of  writing is the true whole will and testament of Jacob Utz, late 
of Frederick County, deceased, that hath come to his hands and possession, and 
that he doth not know of any other.

Frederick County to wit:  On the 9th day of November 1826 there came Jacob 
Groves and Thomas Gurley two of the subscribing witnesses to the foregoing last 
will and testament of Jacob Utz, late of Frederick County, deceased, and made 
oath on the Holy Evangely of Almighty God, that they did see the Testator 
therein named sign and seal said will, that they heard him publish pronounce and 
declare the same to be his last will and testament, that at the time of his so 
dying he was to the best of their apprehensions of  a sound and disposing mind 
memory and understanding and that they together with John Brown the other 
subscribing witness respectively subscribed their names as witness to said will 
in the presence and at the request of the testator and all in the presence of 
each other.

To the Register of Wills of Frederick County

I Jacob Grammer being by Jacob Utz deceased of Frederick County appointed one of 
the Executors by his last will and testament, do hereby refuse to act as such 
and do therefore renounce all my right title, and claim of the same, as witness 
my hand this seventh day of November Eighteen hundred and twenty six.
