WILL

MELCHOR TABLER

FREDERICK, MARYLAND

In the Name of God, Amen.   I, Melchor Tabler of Frederick County Maryland 
being in perfect health of  body and sound and disposing memory and 
understanding considering the certainty of Death and the uncertainty of the 
time thereof and being desirous to Settle my worldly Affairs and thereby the 
better prepared to leave this world when it shall please God to call me hence 
do therefore make and publish this my last will and Testament That is to say; 
First and principally I commend my Soul into the hands of Almighty God and my 
Body to the Earth to be decently buried at the Discretion of my Executors 
hereinafter named and after my Debts and funeral charges are paid I devise and 
bequeath as follows--

I do hereby devise order and direct my Executors hereinafter named or the 
Survivor of them after three Months Notice in Newspapers in Frederick Town and 
Advertisements put up for the same space of time at the court House and other 
places in the Neighborhood to sell at Public Venue to the Highest bidder the 
whole of my real and personal Estate (except what may be Otherwise how it 
disposed of) the terms of the sale for the real estate to be one fourth in hand 
the residue in three Equal Annual payments from the day of Sale on bond with 
Good Security the conveyances to be made on the full payment of the whole 
Purchase Money the Personal Estate I direct to be Sole on One Year Credit and 
bonds taken with good security for the payment - Item I give and bequeath to my 
beloved wife Philopena during her Natural life or widowhood the House and Lot 
in Pence Town which I purchased of Elijah Beatty after her death or Marriage I 
direct it to be sold as I have done the rest of my Real Estate and the money 
arising from the Sale to be divided as I shall direct my other moneys amongst 
my Children; I also devise to my said beloved Wife to be at her own disposal my 
Negro Girl Hannah and her Increase Also my Wife's Bed and furniture and her 
Saddle and Bridle Also Two Hundred Pounds Current Money to be paid her by my 
Executors out of the Sales of my lands Viz.:  One Hundred Pounds out of the 
payments in hand and One Hundred Pounds more out of the Second Payment; I 
likewise further devise to my said wife one third part of all the moneys that 
may arise from the sale of my Personal Estate to be paid her at the end of one 
year from the day of Sale those Several bequests I design in full of her Dower; 
Item having Heretofore given to my Sons George Tabler and William Tabler a full 
proportion of my Estate, I Devise to each of them one Shilling and no more.

Item having heretofore given to my Daughter Christina Witmer two Hundred Pounds 
Current Money to my sons Jacob, Adam and Peter to the Amount of one Hundred and 
twenty pounds Current Money each to my son Michael Ninety four pounds Current 
Money to my Daughter Barbara, Wife of Jacob Whip fifty pounds Current Money to 
my Daughter Catherine Wife of John Getzondonner fifty six pounds current money-
but to my Daughter Elizabeth Wife of Jacob Martin heretofore given nothing.  
Now my will and desire is that each of my last mentioned eight children should 
be equally benefited; taking into consideration the advances I have already 
made them.  I therefore direct (not interfering with the payments to my wife; 
out of the first Moneys my Daughter Elizabeth Shall receive Two Hundred pounds 
to make her Even with Christina and them the Other Six Children shall receive 
Money to make what I have already given them two Hundred pounds each them the 
remainder of my Estate shall be Equally Divided among my said Eight Children 
Viz.: Jacob, Adam, Peter, Michael, Christina, Barbara, Catharine, and Elizabeth 
Share & Share alike;

 And Lastly I do hereby constitute and appoint William Tabler and John 
Hetzandanner within mentioned  Executors of this my last will and Testament 
revoking and Annulling all former Wills by me heretofore made ratifying and 
confirming this and none Other to be my last Will and Testament.  In Witness 
whereof I have hereunto set my hand and Affixed my seal this twenty ninth day 
of March in the Year of our Lord one thousand Seven hundred and Ninety Nine.

Signed, Sealed, Published and declared by Melchor Tabler the Testator as and 
for his last will and Testament in the presence of us who at his request and in 
his presence have Subscribed our names as---

Frederick County August 21st 1804 Them came William Tabler & John Getzendanner 
and made Oath on the Holy Evangelic of Almighty God that the aforegoing 
Instrument of writing is the True  & whole will and Testament of Melchor Tabler 
late of Frederick County Deceased that have come to their hands & possession 
and that they do not know of any other

Frederick County August 21st 1804 Then came John Brunner (miller) and Jacob 
Medart two of the subscribing  Witnesses to the aforegoing last will and 
Testament of Melchor Tabler late of Frederick County Deceased and made Oath on 
the Holy Evangelic of Almighty God that they did see the Testator there in 
named Sign and Seal this will that they heard him publish pronounce and declare 
the Same to be his last will and testament that at the time of his so doing he 
was to the best of their apprehensions of a sound and disposing mind memory and 
understanding that they respectively Subscribed their names as witnesses to 
this will in the presence and at the request of the Testator and that they 
verly believe they saw John Brunner (Miller) and John Bury the other 
Subscribing Witnesses Sign their Names as Witnesses to said Will in the 
presence of each other

I Melchor Tabler of Frederick County and State of Maryland do make and publish 
this Testament of writing as a Codicil to my last will and Testament bearing 
Date the twenty ninth day of March in the year of our Lord Seventeen hundred 
and Ninety nine.  Whereas I did in my said last will and testament direct that 
all my personal Estate (Except such Articles therein bequeathed to my wife) 
should be sold and the money arising from such Sale to be Divided as said Will 
directs--

I now will and direct that my Negro man Tom Slave serve my son William Tabler & 
his heirs four Years after my Decease and at the Expiration of said four years 
I do hereby Emancipate and set free from Slavery the said Negro man Tom and 
Lastly it is my desire that this my present Codicil be annexed to and made a 
part of my last will and testament to all Intents and purposes.   In Witness 
whereof I have hereunto set my hand and Seal the twenty first day of October in 
the year of our Lord Eighteen Hundred and two- Signed Sealed published and 
Declared by the above named his

Will and Testament in the presence of G Hoffman, John Colegate, Augustine Waskey

Frederick County August 21st 1804 Then came George Hoffman & Augustine Waskey 
two of the Subscribing Witnesses to the aforegoing and Annexed Codicil to the 
last will and Testament of Melchor Tabler late of Frederick County Deceased and 
made oath on the Holy Evangelic of Almighty God that they did see the Testator 
therein named Sign and Seal this Codicil that they heard him publish pronounce 
and declare the same to be a Codicil to his last will and Testament that at the 
time of his so doing he was to the best of their Apprehensions of a sound and 
disposing mind memory and understanding that they respectively Subscribed their 
names as Witnesses to said Codicil in the Presence and at the request of the 
Testator and that they did also see John Colegate the other Subscribing Witness 
Sign his name as a witness to said Codicil in the Presence and at the request 
of the Testator and all in the Presence of each other.
