NICHOLAS STULTZ Last Will and Testament
Last will and testament of Nicholas Stults/z of Frederick County, Maryland dated
27 December 1786 and transcribed by Jack Novicki, 16 March 2004,
<pajznovici@aol.com>, from a SAMPUBCO copy, Will Book Vol. #3, page #235.
Note: The surname is spelled STULTS in the document but the signature of
Nicholas Stoltz ends in a Z and the U becomes an O. The name Conrad is
misspelled Conrod in the document. Many of the first letters of various words
appear to start with an uppercase letter and have been transcribe as they
appear. If a word is unreadable or not in current use today, a question mark
was inserted at the end of the word and a few question marks have been inserted
to indicate a missing word. Will was transcribed with original spelling.

IN THE NAME OF GOD AMEN I Nicholas Stults of Frederick County and State of
Maryland being Weak in Body but of perfect mind and Memory, and calling to mind
the uncertainty of this Life, do make and publish this my Last Will and
Testament, hereby Revoking and Disannulling all other Will and Wills heretofore
by me made; that This only shall be taken for my Last Will and Testament and
none other Imprimis ~ I give unto my Well Beloved Wife Mary Stults The
plantation whereon I now Live to have & to hold as her property until my Son
James Stults arrives to the Age of Twenty one Years; I also give and Bequeath
unto her my said wife my whole personal Estate of whatsoever it may Consist (and
after my Just Debts and Funeral Expenses be fully paid) to be her property she
paying to each of my Daughters the sum of fifteen pounds, a Cow, (abed)

a bed, and a Spinning Wheel, (Vizh)(?), unto Ann, Elizabeth, Mary Margaret (no
comma between names could be two people) and Magdelin Stultz, and also unto my
Neas, Catharine Shreder, one Cow, one Bed, and three pounds in money. It is also
my wish that after my Son James arrives at the age above mentioned, that my
Beloved Wife shall then have one third of the plantation or the Incomes Thereof
with the House I now Live in to be her property and at her disposual during her
Natural Life, ~ Item, ~ I give & Bequeath unto my Son Conrod Stults, the
plantation whereon he now Lives Supposed to Contained the Quantity of one
hundred and fifty acres to be the property of the said Conrod Stults his Heirs
and Assigns for ever, ~ Item ~ I give and
Bequeath unto my two Younger Sons, Niz.t(?), Henry and James Stultz, the
plantation whereon I now live supposed to Contain the Quantity of two hundred
Acres to be Equally divided between my two Sons afforesaid quality and quantity
so near as may be, to be the property of them their Heirs and Assigns for ever,
~ And as the Title of all my Lands nowlye in the Hands of another person (tho
paid for) and the Deed soon expected, my Will and desire is, and I hereby order
that when the Deed abovementioned comes to hand, that when my Son Conrod Stultz
shall make or cause to be made a sufficient Deed of Conveyance To Conrod Jacobs
for the Land whereon said Jacobs now Lives Supposed to be one hundred and fifty
acres to him the said Conrod Jacobs his Heirs and Assigns for ever, and it is
further my Will and I hereby Order that when my two Sons Nezh.(?) Henry and
James arrive at there Age, then my said Son Conrod Stults, shall Convey or cause
to be conveyed by Sufficient Deeds of Conveyance all the Lands which I have
heretofore bequeathed; unto them their Heirs and Assigns for Ever ~ Lastly I do
hereby Nominate and appoint my Well beloved Wife Executrix and my respected Son
Conrod Executor to this my last Will and Testament In Testimony whereof I have
hereunto set my Hand and Affixed my Seal this twenty seventh Day of December:

Signed Sealed published by the above named Nicholas Stults to be his last Will
and Testament in the presence of us who have hereunto Subscribed their names as
Witnesses in presence of the Testator ~

Then came Mary
Stultz and Conrod Stultz and made Oath that the aforegoing Instrument of Writing
is the True and whole Will and Testament of Nicholas Stults late of Frederick
County deceased that hath come to their Hands and possession and that they doth
not Know of any Other.

Then came John
Happenner(?) And Jacob Hightshoe two of the Subscribing Witnesses to the
aforegoing Last Will and Testament of Nicholas Stults late of Frederick County
Deceased and made Oath on the Holy Evangels of Almighty God that they did see
the Testator therein named Sign and Seal this Will that they heard him publish
pronounce and Declare the same to be his Last Will and Testament that at the
time of his so doing he was the best of their Apprehensions of a Sound and
disposing Mind memory and Understanding that they Respectively Subscribe their
Names as witnesses to this will in the presence and at the request of the
Testator and that they did also see Allen Farquhar Jun.~ Sign his name as a
Wittiness thereto in the presence and at the request of the Testator and all in
the presence of each Other ~
