and understanding, do make and publish this my last will and testament in manner
and form following that is to say. First I desire of my Executor herein after
named to pay all my debts and funeral charges out of my ready money as soon
after my decease as may be.
I give and bequeath unto my daughter Elizabeth Kieffer and to her heirs and
assigns forever all my personal Estate, consisting of stock, household and
kitchen furniture, all my ready money, together with all my bonds, Notes and
book accounts and every other description of personal property that I may have
at my decease-- requiring of her my said daughter Elizabeth Kieffer and her
heirs to permit and suffer quietly and peaceably my distressed daughter
Catherine to live with them in the same house during her natural life and to
provide and furnish her the said Catherine during said time with all necessaries
of life; but in case my said daughter Catherine should too frequently conduct
and demean herself in such a manner that other persons cannot live comfortably
and undisturbed in the same house with her, then my will is, and I hereby
require of my said daughter Elizabeth Kieffer and her heirs to build a small
house for said Catherine near their own dwelling for her the said Catherine to
live in by herself during her natural life remembering to furnish her with a
bed, stove and every necessary of life to keep her comfortable during her
natural life as aforesaid.
It is my will further that my Executors hereinafter named dispose of all my real
Estate either at public or private sale, as soon after my decease as may be, and
the proceeds of such sale or sales I hereby order to be paid to my said Daughter
Elizabeth Kieffer or to her heirs and assigns; and I hereby authorise and
empower my Executors hereinafter named or either of them, to convey by a good &
sufficient Deed according to law to the purchaser or purchasers all my right
title and claim of, in and to all my land with the appurtenances in order that
the purchasers may have an indisputable title of all my real estate. But be it
remembered that in case my said daughter Elizabeth Kieffer should prefer to keep
all my land or any part thereof then in such case the land that she wishes to
keep shall not be sold, and I hereby devise & bequeath the same to her my said
daughter Elizabeth Kieffer and to her heirs and assigns forever, leaving it to
her choice either to have it sold or keep the same as provided by this my last
will and testament.
And lastly, I do hereby constitute & appoint my trusty friends John You and
Jacob You, or either of them to be my Executor or executors of this my last will
and testament, revoking and annulling all former wills by me heretofore made,
ratifying and confirming this and no other, to be my last will and testament.
