THE WILL OF MATTHIAS MARTIN (1813)

In the Name of God Amen, I Matthias Martin of Frederick County 
State of Maryland being sick and weak in body but of sound and perfect 
mind & memory thanks be given unto God, calling unto Mind the Mortality 
of my body and knowing that it is appointed for all Men once to die but 
the time of death being uncertain, and being desirous to settle my 
worldly affairs and thereby to be the better prepared to leave this 
world when it shall please God to call me hence:  I do therefore make 
and publish this my last will and Testament in manner and form following 
that is to say First and principally I commend my Soul into the hands of 
Almighty God that gave it and my body to the Earth to be buried in a 
decent Christian burial at the discretion of my Executors hereinafter 
named and debts and funeral charges are paid.  I Divide and bequeath as 
follows.  Item  I give and bequeath unto my beloved wife Barbara Martin 
two hundred pounds current money & ___ Beds and bed cloths, two Milch
Cows, with the choice of the two bed rooms in my house where I now Dwel 
with the liberty of the use of the Seller and kitchen during her Natural 
life: it is my Will and desire that my Wife shall have her firewood 
hauld to the house by my son George Martin And pasture for two cows 
with my said Sons Cattle with the liberty to keep two hogs.  I also give 
and bequeath to my Wife my _auld horse; And the third part of my Garden 
And as much fruit out of my Orchard as she shall want for her own use.  
Item  I give and devise unto my son George Martin the Plantation where I 
now live containing about one hundred and sixty acres known by the name 
of part of the resurvey on Diggs lot & Martin Intent. & A Mountain 
lott called Carrolina containing about seventy five acres, with the 
incumbrance of what I have bequeath to my Wife and the sums of Money he 
is to pay to my Six Daughters namely Elizabeth Sheets Magdalena Motter 
Barbara Smith Mary Wampler Catharina Ott Margarete Firor the sum of 
two thousand four hundred Dollars current money to be equally divided 
between them Share and Share alike to be paid in the following manner.  
it is my will and desire at the expiration of two years after my decease 
my Son George Martin to pay to my Daughter Elizabeth Sheets wife of 
George Sheets one hundred dollars current money & Magdalena Motter Wife 
of Lewis Motter one hundred dollars current money & to Barbara Smith 
wife of George Smith one hundred dollars current money to Mary Wampler 
wife of Leonard Wampler one hundred dollars current Money to Catherine 
Ott wife of Frederick Ott one hundred dollars current money & to 
Margaret Firor wife of Daniel Firor one hundred dollars current money 
and so on annually till each one received four hundred dollars current 
money.  Item  I give and bequeath to my son John Martin the sum of ten 
dollars current money.  Item  I give and bequeath to my son Peter Martin 
the sum of tenn dollars currant money  it is my Will and desire that 
after my Pertional property is sold by my Executors herein after named and 
all my debts due me upon bonds Notes or book accounts that they 
immediately pay unto my son George Martin the sum of Eleven hundred & 
Sixty Six dollars current money as he hath to pay all my Daughters their 
portion out of my Land, and also pay my wife two hundred pound current 
money the sum I have here before bequeathed.  Item  it is my will and 
desire that when my personal estate is sold and my debts as herebefore 
collected and the Legacies herein before mentioned and paid and the sum of 
Eleven hundred & Sixty six dollars current money paid to my son George 
as has before mentioned to enable him to pay my daughters their Legacies 
and if there should be a residue to be divided by my Executors Equally 
between all my Children  My Waggon I give to my Son George Martin.  And 
lastly, I do hereby constitute and appoint My son in law Daniel firor 
and my son George Martin to be Executors of this my last will and 
testament revoking and annulling all former Wills by me herebefore made 
ratifying and confirming this and none other to be my last will and 
Testament.

In Testimony whereof I have hereunto set my hand and affixed my Seal 
this Ninth Day of July In the year of our Lord one Thousand Eight 
hundred and thirteen.

Testament, in the presence of us who at
his request and in his presence and in
presence of each other have subscribed
our names as witness thereto

Frederick County to wit

On the 6th day of March 1815 Then came Daniel Firor & George 
Martin and made Oath on the holy Evangels of Almighty God that the 
foregoing Instrument of writing is the True whole Will and Testament of 
Matthias Martin late of Frederick County Deceased that hath come to 
their hands and possession and that they do not know any other.

Frederick County to wit

on the 6th day of March 1815 then came George Flack and Isaac 
Wilson two of the Subscribing Witnesses to the foregoing last Will and 
Testament of Matthias Martin late of Frederick County Deceased and made 
Oath on the holy Evangels of Almighty God that they did see the Testator 
therein named sign and seal this will; that they heard him publish 
pronounce and declare the same to be his last Will and Testament that at 
the time of his so doing he was to the best of their apprehensions of a 
sound and disposing mind memory and understanding that they respectively 
subscribed their names as witnesses to this will in the presence and at 
the request of the Testator, and that they did also see Frederick Crabs 
the other subscribing witness sign his name as witness to said will in 
the presence and at the request of the Testator and all in the presence 
of each other.
