A Short Will in a Legal Form.

In the name of God Amen this seventeenth day of January in the year of our Lord 
one thousand seven hundred and fifty.  I Theodores Malott in Frederick County 
and province of Maryland plaintive(?) being of very sick and weak of body but of 
perfect mind and memory.  Thanks be to God thereby calling to mind the mortality 
of my body and knowing that it is appointed for all men to dye do make and 
ordain this my last will & testament that is to say principally first of all I 
give and recommend my soul into the hands of God that gave it and my body.  I 
recommend to the earth to be buried in a decent Christian burial at the 
discretion of my executors nothing doubting but at the General Resurrection I 
shall receive the same again by the mighty power of God.  And as touching such 
worldly estate wherewith it hath pleased God to bless me in this life.  
I give demise and dispose of the same in the following manner and form  

First I order that all my funeral charges and debts to be paid.  I likewise 
constitute make and ordain John Perrin and Joseph (illegible) my sole executors 
of this my last will and testament.  

Item give to my son Peter Malot two mares and a yearling cock and a rifel given 
by him freely to be possessed.

Item I give to my beloved daughter Elizabeth Malot a three year old heifer, and 
to my beloved daughter Catherine a two year old heifer and to my son Benjamin a 
two year old mare and a smooth board gun.

Item I give to my well beloved wife all my stock of horses and mares, cattle, 
sheep and hogs during her widow hood and after wards to be equally divided 
amongst all my children and I do hereby utterly disallow revoke and disannul all 
and every of former wills testaments, wills legacies and requests and executors 
by me in any ways before named willed and bequethed ratifying and confirming 
this and no other to be my last will & testament.  In witness whereof I have 
hereunto set my hand and seal the day and year above.  To my son John Malot one 
shilling & to Theodotius Malot one shilling & to my daughter Mary a two year old 
heifer.

    March 19th 1751 Joseph Lazer Senior David Enochs two of the subscribing 
witnesses to the within will being duly sworn on the holy Evangels of the 
Almighty God depose and say that the said the son the testator Theodores Malot 
sign the within will & heard him publish & declare the same to be his last will 
& testament.  That at the time of his so doing he was to the best of there 
apprehentions of sound disposing mind & memory and at the same time they saw 
Joseph Lazer Jun subscribe the within will, as an evidence & which they 
subscribe in the presence of and at the request of the testator.
