Frederick County, Maryland Will Book GM 3, folio 475-477

In The Name of God Amen I Michael Maintzer of Frederick County & State of 
Maryland being Sick and Weak in Body yet of a Sound and disposing mind memory 
and understanding And considering the Certainty of Death and the uncertainty of 
the time thereof being desirous to Settle my Worldly Affairs thereby ---- better 
proposed when it shall please the God to call home do therefore make and publish 
this my last Will &and Testament in manner and form following   Viz - First and 
principally I commit my soul into the hands of the Almighty God and my Body to 
the Earth to be Decently Buried at the Discretion of my Executor herein after 
named and after payment of my Just Debts and funeral charges I Give and bequeath 
as follows (to wit)
Whereas by reason of the Improvident Conduct of my Son in Law Peter Spitler I 
Give and bequeath unto my Daughter Mary wife of the said Spittler and to her 
heirs the Sum of Seventy five pounds current Money   It being an Obligation from 
son Samuel to me For the sum of Seventy five pounds And bearing date May 
Thirtieth day Eighteen Hundred and one payable on the first day of April 
Eighteen Hundred & Six   The said obligation being now Lodged in the care of my 
Son Michael for the use and benefit of my Daughter Mary and her children to be 
paid them in the following manner  VIZ - That in case the said Peter Spittler 
should Survive my Daughter Mary Then it is my Will and desire that the sum 
aforementioned with the interest that may Arise there from be paid unto my Grand 
Children the Children of my Daughter Mary to be pd' them share & share alike as 
they come to Lawful Age or Marry which may first Happen  But in case my Daughter 
Mary should survive her present Husband It is my will and desire that the said 
Sum of Seventy five pounds with the Interest that may accrue thereon be paid 
unto her my sd' Daughter  And I order and direct that no part thereof be paid 
her during his lifetime  Item I Give and bequeath all the rest and residue of my 
Estate both real & Personal to all my Children to be Divided Amongst them 
equally in Equal Portions Share and Share alike         and Lastly I do hereby 
constitute and Appoint my two Sons Michael and Samuel to the be Executors of 
this my last will and Testament revoking and Annulling all former Will by me 
heretofore made ratifying and confirming this and none Other to be my last will 
and Testament  In Testimony whereof I have hereunto set my hand and affixed my 
Seal this 30th day of August Anno Domini one thousand Eight Hundred and one

as his last will & Testament in the presence of us who at his request and in his 
presence have subscribed our names as witness thereto

Frederick County November 3rd 1801  Then came Michael Mensor and Samuel Mensor 
and made Oath on the Holy Evangels of Almighty God that the aforegoing 
Instrument of Writing is the True and Whole will and Testament of Michael Mensor 
late of Frederick County Deceased that hath come to their hands and possession 
and that they do not have of any other

Frederick County November 3rd 1801  Then came George Beckenbaugh and Conrad 
Smith two of the Subscribing Witnesses to the aforegoing last Will and Testament 
of Michael Mensor late of Frederick County Deceased and made Oath on the Holy 
Evangels of Almighty God that they did see the Testator therein named Sign and 
Seal this Will that they heard him Publish Pronounce & Declare the same to be 
his last and Testament that at the time of his so doing he was to the best of 
their Apprehensions of a Sound and disposing mind memory and understanding that 
they respectively Subscribed their names as witnesses to this will in the 
presence and at the request of the Testator  And that they did also see Joseph 
Miller the Other Subscribing Witness Sing his name as a Witness to said will in 
the presence and at the request of the Testator and all in the presence of each 
other.
