Last Will and Testament of Jacob YAGLEY

In the name of God Amen, I Jacob Yagley, of the Twp. of Carroll, County of 
Cambria, State of Pennsylvania do make this my last Will and Testament, I 
being of sound mind I Desire that I be buried in the Catholic Cemetery in 
Carrolltown by the Side of My deceased Wife. I Bequeath to my son Charles 
Yakley all my personal property and cash remaining after my death and I 
require that he shall pay my funeral expences and all debts of mine excepting 
a note held by the Prior of The Masting of St. Benedict in Carrolltown the 
amt of Said Note, being one hundred dollars. I Bequeath to Theodore the Sum 
of One hundred and fifty dollars to be paid as herein after to be directed.

I bequeath to Pauline the Sum of one hundred dollars. I bequeath to my son 
Frederck Yakley the Sum of Five hundred and fifty dollars, also to my son, 
Charles and Andrew Yakeley the sum of five hundred and fifty dollars each to 
be paid as I herein direct my son Charles shall passess and own my farm on 
which I now reside upon these conditions, that he pay the above bequests to 
Theodore, Pauline and Frederick and Andrew Yakley. First he shall pay at the 
end of the first year after my death the Note which I owe to the Prior to 
Carrolltown and also to Theodore Yar the sum of fifty dollars during the 
second Year to Frederick Yakley my son the sum of one hundred and fifty 
dollars the next year to my son Andrew One hundred and fifty dollars and the 
next year to Theodore the sum of one hundred dollars and to my son Frederick 
the sum of fifty dollars and so on each year he shall pay the sum of one 
hundred and fifty dollars in the order as above Mentioned until all of the 
above bequests are paid. None of these bequests shall bear interest and under 
no circumstances shall be compelled to pay more than one hundred and fifty 
dollars each year and direct My Executor to make him a deed for the said farm 
when he has complied with the above conditions I direct that the said farm 
that is the possession and ownership as herein provided shall be in lieu of 
the bequest to my son Charles I direct that the bequest to Pauline shall not 
be paid to her until after the death of her present husband but in case she 
shall die before her husband then the amt bequeathed to her shall be equally 
divided between my sons Frederick, Charles and Andrew and also Theodore.

I hereby Appoint my sons Frederick, Charles and Andrew the Executors of this 
my last Will and testament, I also direct that the bequest to Pauline Shall 
not be paid until all the bequests in this Will shall be paid in full. I 
hereby revoke all former Wills by me made.

Witness my hand this Twelth day of October one thousand Eight hundred and 
Eighty four I hereby Revoke the appointment of my son Charles as one of my 
Executors.

Before my John H. Brown, Register of the Probate of Wills and granting 
Letters of Administration in and for said County, personally came Charles 
Yaeckle and Andrew Yaeckle, the subscribing witnesses to the foregoing Will, 
who, being duly sworn according to law, does depose and say that they were 
present and saw and heard Jacob Yagley the within-named testator, sign, 
publish, prounounce and declare the foregoing instrument of writing as and 
for his last Will and Testament, and at the time of so doing he was of sound 
mind, memory and understanding to the best of their knowledge, observation 
and belief.

Letters of Administration in and for said County, personally came James J. 
Thomas and Benjamin Wirtner witnesses to the foregoing Last Will and 
Testament who being duly Sworn according to law, do swear depose and say, 
that they were present and saw and heard Jacob Yaeckle, the within-named 
testator, sign, seal, publish, pronounce, and declare the foregoing 
instrument of writing as and for his last Will and Testament and at the time 
of so doing he was of sound mind, memory, and understanding, to the best of 
their knowledge, observation and belief.
