Last will and Testament of James P. McCANS

In the Name of God, Amen, I James P. McCans being of sound mind memory and 
understanding do make and declare this my last will and testament in manner 
following:

And first, I direct that my body by decently buried in the cemetery of the 
Catholic Church at St. Austine [Augustine] and that $300 be paid by my 
executors herinafter named to the Parish Priest of the said Church for Masses 
to be said for the repose of my soul and the soul of my wife and deceased 
members of my family and my brother Robert McCans and that the further sum of 
one hundred dollars be paid for the repose of the soul of my daughter Mary 
Shareton deceased.

And the remainder of my property both real and personal is to be sold by the 
executors and proceeds thereof after paying all my just debts funeral 
expenses shall be divided into six and one-half shares and distributed among 
my seven heirs as follows: To my daughter Jane Dietrich one full share. To my 
son A.C. McCans one half share. To the heirs of my daughter Anna Hitch one 
full share. To my daughter Margaret A. now Sister Martina one full share. To 
my son James A. McCans one full share less $100 by me advanced to him. To my 
son Robert J. McCans one full share less $600 by me advanced to him. To my 
son B.J. McCans one full share less $700 by me advanced to him. In case any 
of the above heirs should be dissatisfied with the conditions of this my will 
and raise trouble or litagainst it, he, she or they so doing shall be 
disinherited and his, hers or their shares shal be added to the body of my 
estate.

And lastly I hereby nominate and appoint my son James A. McCans and John J. 
Dietrich to be the executors of this my will, hereby granting to them full 
power to sell any and all real estate that I may die seized of, and to make 
and execute deds of conveyance therefor and to do all things necessary for a 
full settlement of my estate.

In witness whereof I have hereunto set my hand and seal this 20 day of 
October 1900.

Before me, F.B. Jones, Register of the Probate of Wills and granting Letters 
of Administration in and for said County, personally came Paul Yahner and 
Alice Neason the subscribing witnesses to the foregoing Will who being duly 
sworn according to law, do depose and say, that they were present and saw and 
heard James P. McCans the within named testator, sign, seal, publish, 
pronounce and declare the foregoing instrument of writing as and for his last 
Will and Testament, and at the time of so doing he was of sound mind, memory, 
and understanding, to the best of their knowledge, observation and belief.
