Will of John G. Waite, late of Tyrone Boro., Deceased

  In the name of God, Amen, I John G. Waite of Tyrone Pennsylvania do 
make and publish this my last will and testament hereby revoking all 
former wills by me heretofore made,
  As to such estate as it hath pleased God to intrust me with I dispose 
of the same as follows,
  Item, after the payment of all my just debts and funeral expenses I 
give to my beloved wife Isabella Waite all the rent, issues interest 
and profit of all real and personal property of which I may die 
possessed or seized excepting the farm in Warriors Mark Township, 
Huntingdon county, Pennsylvania and the personal property thereon for 
her use during the term of her natural life with full authority to 
manage and control all such estate as in her judgment appears best, but 
without any authority to convey or dispose of the same without the 
concurrence of our daughters Maggie and Drucie evidenced by their 
joining with her in any conveyance or transfer she may desire to make. 
Out of the income of my estate she is to maintain, clothe, and support 
our daughters Maggie and Drucie so long as they remain unmarried and 
desire to reside with her in our home on Lincoln Avenue, Tyrone, Pa., 
which under no circumstances is to be sold or disposed of during the 
lifetime of my beloved wife.
  Item Second. To my daughter Annie, intermarried with F.L. Peck and 
the children of her body begotten I give devise and bequeath my farm in 
Warriors Mark Township, Huntingdon county, Pennsylvania, with all the 
land pertaining thereto subject however to the payment by her, of the 
sum of twenty two hundred and ten 04/100 ($2210.04) dollars to my 
executor hereinafter named, after the death of my beloved wife, as 
follows.--
  She is to pay interest on twelve hundred and ten 04/100 dollars, at 
the rate of four (4) percent, per annum payable sum annually, to my 
beloved wife during her lifetime. (At her death: (interest to be 
computed from October 1st 1890) the principal is to be paid in four 
installments, the first one payable one year after the death of my 
wife, and the balance in three equal payments payable, one, two, and 
three years computing from the date of payment of the aforesaid payment 
-- all of said amount of twenty two hundred and ten 04/100 dollars to 
bear interest as aforesaid rate, excepting the sum of One thousand 
dollars which is to be without interest until maturity of all payments.
  Provided however that if my wife, during her lifetime shall find it 
necessary in her judgment to use any part of said principal debt, she 
may collect the same from time to time as she may need provided she 
does not collect in any one year more than ($400.00) four hundred 
dollars. The aforesaid amount being a balance according to my account 
with Anna and her husband F. L. Peck due me after deducting such 
allowances as I have made to them on account of the same, and included 
an amount to equalize the valuation of Real estate herein devised. All 
claims on book account on my books, or notes of date prior hereto 
against herself or her husband up to Oct. 1st 1890, are to be satisfied 
on payment of the aforesaid amount.
  In addition to said amount she is to pay my wife during her lifetime 
the sum of two hundred (200) dollars per annum in lieu of any other 
rental for said farm, during the lifetime of my wife.
  I direct that all the personal property on said farm in any way 
belonging to me shall be sold by my widow the spring following my 
decease, if not sooner disposed of by myself, the one half of the 
proceeds thereof will belong to and is payable to our daughter Annie 
Peck, who jointly owns the same with me.
  Item. To my daughter Maggie Waite and her heirs and assigns I give, 
devise and bequeath the brick building and ground pertaining thereto on 
Main Street, Tyrone, Pa., now occupied by Stevens and Owens, and 
adjoining property of W.F. Conrad and A. C. Toner.
  Also the house and lot of ground on the South East side of Main 
Street, Tyrone, Pa., and adjoining property of E. E. Lytle: Also the 
vacant lot of ground on the north east corner of Main and Dallas Street 
fronting fifty (50) feet on Main Street and adjoining other property 
owned by me.
  Also the sum of three hundred and thirty five (335) dollars to be 
paid to her in cash by my executors hereinafter named out of any money 
that may remain after the death of my beloved wife if not paid to her 
sooner by myself during my lifetime.
  Item. To our daughter Drucie Waite I give devise and bequeath the 
house and ground pertaining thereto with all the household goods and 
personal property therein contained, situate on Washington Avenue, 
Tyrone, Pa. adjoining property of A. P. Hoover and A. J. Mattern,
  Also the two lots of ground with the plank-frame houses thereon 
erected situate on Main Street, Tyrone, Pa. and adjoining property of 
F. B. Riddle and other property belonging to me,
  Also the sum of three hundred and thirty five (335) dollars in cash 
to be paid to her out of any money that may remain in the hands of my 
executors after the death of my beloved wife, unless paid by myself to 
her during my lifetime.
  Item. Should any property remain after the death of my wife not 
herein disposed of then my executors shall divide the same share and 
share alike among my three daughters, or their heirs.
  Item, all claims or accounts against my daughter or either of them up 
to the date hereof is to be forgiven excepting the amount to be paid by 
my daughter Annie as herein set forth.
  Item. I appoint Howard B. Calderwood and my daughter Maggie Waite to 
be the executors of this my last will and testament with the 
understanding that their charges are not to exceed the minimum allowed 
by law in like estate, giving unto them full power and authority to 
make any sale and conveyance of Real estate that may at any time become 
necessary.
  In witness whereof I have hereunto set my hand and seal this 18th day 
of October A.D. 1890.

have subscribed our names as witnesses thereto.

This 9th day of November A.D. 1891 before me J. Lee Plummer Register 
for the Probate of Wills and granting Letters of Administration in and 
for the County of Blair, personally came G. L. Owens and W. F. Taylor 
the subscribing witnesses to the above will, and being duly sworn 
according to law, did depose and say they were personally present and 
saw and heard John G. Waite, the testator, sign, seal, publish, 
pronounce and declare the foregoing instrument of writing as and for 
his testament and last will, that they signed their names in the 
presence and at the request of the said testator, and in the presence 
of each other, and that at the time of so doing he, the said testator 
was of perfect and sound mind memory and understanding, to the best of 
their knowledge and belief.

Before me the Register for the Probate of Wills and granting Letters of 
Administration in and for the County of Blair, personally came Howard 
B. Calderwood and Maggie E. Waite who being duly sworn, do depose and 
say that as executors of the last will and testament of John G. Waite 
deceased they will well and truly administer the goods and chattels, 
rights and credits of said deceased according to law, and also will 
diligently comply with the provisions of the law relating to collateral 
inheritances.

MEMORANDUM. Died November 2th, 1891. Proof of Death filed November 9th, 
1891. Letters Testamentary on the estate of John G. Waite late of 
Tyrone Boro deceased were, on the 9th day of November A.D. 1891 granted 
to Howard B. Calderwood and Maggie E. Waite both of Tyrone, Penna.
