The Last Will and Testament of Peter Pool, dec'd.

I Peter Pool of the Township of Tyrone, County of Blair and State of 
Pennsylvania, do make and publish this my Last Will and Testament, 
hereby revoking and making void all former wills by me at any time 
heretofor made. - And first - as to such worldly estate as it hath 
pleased God to entrust me with.  I do dispose of the same as follows.  
I direct that all my debts and funeral expenses be paid as soon after 
my death as possible out of the first moneys that shall come into the 
hands of my executors herein after named from any portion of my estate.  
I direct that my executors or the survivor of them cause all my 
personal effects to be appraised and my wife if she be then living to 
have to amount of one third of said appraisement to be selected by her 
to hold and possess the same during her natural life or so long as she 
remains my widow.  At her death, or if she marry again, the same to 
revert to the benefit of my heirs hereinafter directed, the remainder 
of my personal effects to be sold at public or private sale and the 
nett proceeds thereof with any moneys that may be in their hands from 
my estate after the payment of all my just debts and expenses to be 
distributed by them as follows.  Share and share alike between my three 
daughters hereinafter named.  I also further order and direct my 
executors or the survivor of them as soon after my decease as they may 
think proper to sell at public or private sale my mansion tract of land 
where on I now reside with the appurtenances for such price or prices 
and on such terms, cash or otherwise as they may consider most 
advantageous.  The one third of the purchase money to remain in the 
purchasers hand so long as my wife may live or remain my widow, the 
interest to be annually paid to her. If my said executors can make any 
other satisfactory arrangement with her, by a specific payment in lieu 
of said interest, they are directed to do so.  And the nett proceeds of 
my real estate I direct to be distributed as follows:  One hundred 
dollars to be paid to my daughter Margaret intermarried with John 
McMullen.  One hundred dollars to be paid to my daughter Sarah Ann 
intermarried with John W Hasson - Said two payments being made, I 
direct that the balance be paid, one third to my daughter Margaret 
herein named one third to my daughter Sarah Ann herein named and the 
remaining third to be placed at interest and the said interest to be 
annually paid to my daughter Wilhelminah intermarried with Curtis 
Kidder during her natural life, and at her death to be paid to her 
children then living, share and share alike.  And for the purpose 
aforesaid, I do hereby authorise and empower my said executors or the 
survivor of them to sign, seal, execute, and deliver such deed of 
conveyance as may be necessary for the granting and issuing said tract 
of land to the purchaser thereof.  And I do hereby nominate constitute 
and appoint my trust worthy neighbours James Crawford and Joseph 
Crawford executors of this my last will and testament.  In witness 
whereof I Peter Pool the said testator have herewith set my hand and 
seal this seventh day of December in the year of our lord one thousand 
eight hundred and sixty one.  (The word seal interlined before signing)

subscribed the same in the presence of testator and of each other.

I Peter Pool Testator named in Will on this sheet of paper desire that 
said Will be altered and amended where my Executors are required to pay 
my daughter Wilhelminah the interest annually on that share of my real 
estate to which she will be  entitled so long as she may live - It is 
my will and desire that if her husband Curtis Kidder should die before 
her that my Executors proceed to collect and pay to my said daughter 
Wilhelminah the principal of the dower herein willed to her children, 
and the same to be my said daughters absolute.  In Witness whereof I 
Peter Pool Testator as aforesaid have hereunto set my hand and seal to 
this codicil of my Last Will and Testament this second day of May

the same in presence of Testator -

Blair County SS - Before me the Register for the Probate of Wills and 
granting letters of Administration in and for Blair County personally 
appeared James Clark & John Keith who being duly sworn did depose and 
say that they were personally present and did hear and see the above 
named Peter Pool sign, seal, execute, publish, pronounce and declare 
the within and foregoing instrument of writing as and for his Last Will 
and Testament that they signed their names as Witnesses thereto in the 
presence of each other and in the presence & at the request of the said 
Testator, and that at the signing of the same the said Testator was 
sound and desposing mind, memory and understanding to the best of their 
knowledge and belief.

Sworn and subscribed before me this 11th day of June AD 1862 - 
            H A Caldwell, Register. 

Blair County SS - Before me the Register for the Probate of Wills and 
granting letters of Administration and for the said County personally 
came James Clarke and John Biegel who being duly sworn did depose and 
say they were personally present and did see and hear Peter Pool sign 
seal execute, publish, pronounce and declare the within and foregoing 
instrument of writing appended to this paper to be a Codicil to and 
part of his Last Will and Testament that they signed their names as 
Witnesses thereto in the presence of each other and in the presence and 
at the request of the said Testator, and at the time of signing of the 
said Codicil, the said Testator was of sound and disposing mind memory 
and understanding to the best of their knowledge and belief. - Sworn 
and Subscribed before me this 11th day of June AD 1862 -

Memorandum: Renunciation of James & Joseph Crawford & widows filed, and 
Letters of Administration cum testamento annexo issued this day to 
Matthew Stweart & John McMullen on the estate of Peter Pool, late of 
Tyrone Township, Blair County, dec'd.  An Inventory of the goods to be 
exhibited in thirty days and a just and true account, calculation, & 
reckoning of their said administration within one year from this date 
hereof or when thereunto legally required or In Testimony whereof the 
forgoing is given under my hand and official seal at Hollidaysburg, 
June 11th, 1862. - Inventory filed June 30th 1862. Vendue List filed 
some day ___.  Real Estate Bond filed Sept 26th, 1862 - Partial Acct 
filed Dec 18th 1862.  Certified  to O. Court to Jany. 2, 1864.
